新聞少年を６キロ引きずり、死なす...ひき逃げの大工逮捕（2008年11月16日22時39分 読売新聞）
またか、という感じの腹の底から憤りが湧いてくる事件ですが、衝突時の状況がはっきりしませんでしたので、（遺族側にとって）最悪の場合、道交法違反（不救護・不申告）しか成立しないかも知れないという気もしておりました。
しかし
発表によると、市川容疑者は１６日午前２時５０分頃、軽ワゴン車で東川さんのバイクに追突してけがをさせたが、救護せずに逃走し、駐車場に放置して死亡させた疑い。市川容疑者は「飲酒運転だったので必死に逃げた。（はねた）後のことはあまり記憶にない」などと供述。逮捕後、呼気からアルコール分が検出された。市川容疑者は今年６月にも酒気帯び運転で検挙され、免許停止３０日の処分を受けたばかりだった。
ということで、この発表のとおり「追突」であれば、基本的に容疑者に過失は認められますから、自動車運転致死罪、道交法違反までは成立しそうです。
また、被害者を引きずっていることを認識しながら６キロも走ったということであれば、衝突時に被害者が即死状態でもない限り、殺人既遂罪も成立しそうです。
しかし、以上の記述からお気づきのように、自動車運転致死傷罪も殺人罪も当然に成立するわけではありません。
いずれも、いくつかの条件があります。
本件に即して言えば、
自動車運転致死傷罪が成立するためには、過失が必要です。
不可抗力の衝突のような場合は、自動車運転致死傷罪は成立しません。
本件で殺人罪が成立を考える場合、別事件のようにわざとぶつけたのでない限り、引きずりながら走り続けたということが殺人行為としての検討の対象にあたります。
そして、引きずりながら走り続けたということが殺人行為になるためには、ひきずり始めたときに被害者がまだ生きていることが必要です。
死者は殺せませんから。
そして、走行中の容疑者に引きずっているという認識があったことが必要です。
このようにクリアすべき条件が多いということは、容疑者側にいろいろ言い訳するネタも多いと言うことになります。
もっとも、（特に車両対車両の）交通事故というのは、客観証拠がたくさん残っている代表のような犯罪ですから、安易な言い訳は後で馬脚を表す場合が多いです。
ところで、先ほど「死者は殺せない」と言いましたが、死者に対する殺人行為が殺人罪を構成する場合も考えられます。但し、殺人未遂ですが。
ここまで考えて、ふと気になったことがあります。
裁判員制度が始まった場合、検察官が本件を殺人罪で起訴すれば裁判員裁判の対象事件になるのですが、自動車運転過失致死罪で起訴すれば対象事件にならないのです。
裁判員制度に批判的な私ですが、実施するならこういう事件こそ裁判員の判断を仰いでみたいという気がします。
今回は、法律家的視点で考えて見ました。

殺人でしょうね。
引きずっていることの認識が問題になりますが、普段と違う音や振動を感じないはずはないと思われます。
ダミーを使うなどして何らかの再現実験をすれば、よりはっきりすると思いますが、下手なやりかたをしますと弁解のネタを作ることになりますので慎重な検討が必要です。

大阪府警は、市川容疑者が感じた違和感が引きずりによるものか、事故で生じた車の不具合などによるものか慎重に調べる。
殺人で起訴するためには、この違和感が被害者の引きずりによるものであることを裁判官に（近い将来では裁判員にも）納得してもらえる形に証拠化する必要があるのですが、このあたりに捜査官のセンスとか経験が影響する場合があります。
プレゼンテーションの一場面と考えていただければわかりやすいと思います。
最近、ドカチンの引き逃げ事件が多いですね。

ということですので、殺人罪を成立させるのは困難なのではないでしょうか。あくまで今後の捜査次第だとは思いますが・。
飲酒事故にしても、薬物使用での事故にしても、他の事故に比べれば、より憤慨を感じるのですが、本人の意識が、飲酒・薬物の場合、事故時に希薄すぎる故、事故原因の解明が困難になってしまうところがじれったいというかなんというか・・・。
酒を飲んで運転するのは絶対に止めましょう！
酒を提供した人が、飲んだ人が帰る時に強制的に代行なりを手配するくらいのことを決め事にしないとダメかな。
なんだか「大阪で引きずりが大流行！」みたいな流れになっていて胡散臭いですね。
JR尼崎事故の後のオーバーランや福岡３児死亡事故の後の公務員飲酒運転、産婦の受け入れ不能のように、マスコミが恣意的に集中して取り上げて印象操作している感じがします。実際のところ、ひき逃げ事故の中にはもともと相当程度の引きずり型が含まれているように思うのですが。
ところで、夜の高速道路などで何台もの車に轢かれるケースがあります。また、誰かにひき逃げされて転がっていた人を別の車が轢いてしまうケースもあります。このように複数の車に轢かれた場合は各加害者の責任範囲をどう考えるのでしょうか。何台目の車が致命傷に負わせたかとか、どういう順番で轢いたかといった点を精密に検証するのでしょうか。
交通事故を起こして逃げたら必ず損する仕組みを作り、周知する必要があると思います。
例えば「逃げたら危険運転だったとみなす」とか「一定以上の距離を引きずったひき逃げは殺意があったとみなす」とかを思い浮かべます。これは乱暴な意見でしょうが、立法も司法も「逃げどく」を許さない方向に向かって欲しいと思います。
自分が裁判員になったとして考えてみると…
自動車の下に何かを巻き込んで引きずっている間は、相当の衝撃が持続的に車内に伝わってくる、と前回のひきずり事件の際にどなたかがコメントされていたことを思い出します。
裁判員制度対象の事件になった場合、この点から
『いくら酩酊していたとしても、これほどの衝撃に気づかないわけがない！』
と判断しそうな気がします。
実際に、引きずり状態を裁判員に体験してもらうのもアリでしょうか。
個人的な意見ですが、酒を飲んでハンドルを握った段階で、アウト！でしょう。酒を飲んで車を運転することが悪いことであることを認識していたにもかかわらず、敢えて運転した。未必の故意どころか悪意すら感じてしまいます。

やっぱり通報・救護・待機訓練ですかねー（＾＾；
「後のことは覚えていない」。これをどの時点と捉えるべきでしょうか。記事にあるように、はねた後のことであれば、はねた時点を覚えているということになりますが、車を降りてから跳ねてしまった事に気が付いて、その後のことを覚えていないと言っているのかもしれません。ですが、もしも後者ならば、「はねたことを覚えていない」と言うように思います。
飲酒運転でひき逃げ等が頻繁に取りあげられている状況で、自らもそれに手を出して、免許停止受けても、なお、やめないところから見ると、自動車運転という「業務」を安易に考えていたと思います。故に、無免許による業務上の過失は、少なくとも生命身体に危険をもたらす事を知っていながら運転する点から、それらは傷害致死傷に匹敵するのではないかと考えています。本件では、はねた時点を気付いていながら、救護活動を行わなかったことに問題を置くべきだと思います。
記事には、「『飲酒運転だったので必死に逃げた。（はねた）後のことはあまり記憶にない』などと供述。」とあります。この記事からは、人をはねたことを認識して逃げたと読めます。
そこには、救助義務を遂行すれば危険運転がバレるとの冷静な判断があり、さらに、後半の「記憶にない」との供述には立場を少しでも有利にする計算がある、と私には思えます。
飲酒運転の例ではありませんが、事故を起こすとパニックになるというのは、自分自身が経験したことがあります。
運転を誤って反対車線を横切って、ガードレールに斜め前から衝突したことがあります。幸い、速度が低かったので、人的被害は奇跡的にありませんでした（同乗者なし）。が、その瞬間、頭が真っ白になってしまって、次に何をすればよいのかが思い浮かびませんでしたね。社外に出て、被害状況を確認する前に、必死になって車を道路に戻そうとしていた記憶があります。
その後、動かないので、車外に出て、初めて前面が大規模に破損していることがわかりました。が、携帯電話で警察に電話しようにも、手が震えて、携帯電話のボタンがまともに押せませんでした（かろうじて、110番までは覚えていました）。近くの民家の方が来てくださり、警察に電話をしてくれて、事なきを得ました。
その後、レッカー車が来るまで警察官と話をしたのですが、事故を起こすとパニックになって、車の周りをうろうろと歩き回り、はねられるケースが多いから、絶対に道路に出ないように注意されました。
もちろん、飲酒運転ではありませんが、パニックになるとはこういうことなのかと実感した一件です。
ですから、後から「とんでもないヤツだ」と批判することはできますが、事故後、本人の判断に頼るのは難しい側面があると思います。そこで、エアバッグのように一定の衝撃を受けた場合、自動車を緊急停止（エンジンを止めてしまう）システムなどの方が、効果があるように思います。
長文失礼しました。
パニクッて、皆が皆逃げ出すわけじゃないからね。パニクっちゃいましたという言い訳は通じないでしょう。
締め上げる方向だけではこの手の輩は減らないと思います．

私が思う「逃げたら必ず損する仕組み」も、その仕組みがあることで、逃げずに即座に救護することを狙っているので、相通ずるお考えだと思います。賛成です。
以前のエントリで、「事故後の対処方法を指導して、事故後に反射的に対処できるようにする」といったようなコメントをみたことがあります。
業務上で使う機械などについても、「トラブル時にはこうする」ということが分っていて身についているからスムーズに対処できる部分があると思います。
「～するな」ということが頭では分っていても「どうするか」ということが咄嗟にでないと、パニック時や頭に血が上った状態では不適切な行動をとってしまうこともあるかと。
教習所あるいは運転免許更新時に、事故時の対処方法を座学だけでなく、「車を止めて～」と一連の流れで行うような研修をいれて「こうする」ということができるようにしてもいいのではないでしょうか。
酒が入ってる上に、交通事故を起こすなんて、思いもよらない状況にあるにも関わらず、そこまで頭が回るって事は、きっと、犯人は、轢き逃げのプロですね。(棒読み)
自動車学校の教習で、コース中に人形を飛び出させてわざと轢かせ、そのまま救護の練習もさせるというのはどうでしょうか。
人をはねた時のびっくりとその場で何をすべきかの両方を体験できていいのではないでしょうか。
それはものすごく実践的でいいのでは。
教習では、負傷者救護もいいかもしれませんが、そういう「救護に至るまで」のシミュレーションを体験できるカリキュラムがあったらほんとに有益だと思います。
あと、どの事件報道でも思っていることですが、警察発表の「被疑者／被告人はこのように供述している」報道は、
「ほんとうにそのように言葉どおり供述しており、かつ、自分が想像する（その報道からはそう読める）文脈で発言していたとしたら」
という留保つきで受け止めるという意識を常にもつべきだなあ、と。
誰だってとっさに逃げたくなる衝動に駆られることは容易に想像できます。飲酒や無免ならなおさらです。でも、ほとんどの人は理性ある行動をとってるわけですよね。自分に自信のないアレな方は、ハード面の対策で強制連行されたほうが、良いかもね。
パニくったときに適切に行動できる人もフリーズする人も逃げ出す人もいるでしょうけど、無知ゆえに適切が何か分からないってのはありそうなので、可能なら実地訓練希望です。
あと、道交法をザル法じゃなくすって方面の対策は無理ですかね……なんか、道交法違反って、どっちかってーと違反するのが悪いのではなく捕まるのが悪いか運が悪いかって感じじゃありません？一回捕まってもそういう感覚のままだからる違反するような気がするです。
……って、現実に合わせて緩めるのか、法律に合わせて締めるのか、どっちが適切なのかもよくわかりませんが……（ぉ
ところで、「逃げちゃった君」さんは、まさか、「自分は大丈夫だ」「自分は絶対にやらない」と、根拠も無く思いこんでたりしませんよね？
本件のマスコミ報道ではアルコール依存症の文字を目にしていないので、あくまで一般的な話としての質問ですが....
仮に加害者が重度のアルコール依存症でアルコール幻覚症も認められ、現実と幻覚の区別がつかない可能性があると鑑定された場合(精神鑑定は縁がないのでそんな鑑定がアリかどうか分かりませんが...)、責任能力の有無は、争点になりうるのでしょうか。

この方、警視庁の飲酒運転対策担当をされていたそうですね・・・、なんと申し上げてよいやら・・・・・・。
実際のところ、「パニクって逃げちゃいました、悪気はなかったんです」なんて言い訳が、簡単に通用するほど世の中あまくないですよ～（棒読み）
そういえば船の免許取得時の講習には落水した人を助ける人命救助の練習もありましたね(実際は海に投げ込んだブイを拾うだけですが)
救急蘇生法だけでなく自動車事故発生時の対処法、具体的な講習なども必要かもしれません。
轢き逃げを減らすと言う観点からは、「悪気はなかったんです」云々は枝葉末節。
で、調べてみた結果、「世の中」にとって受け入れ難い結果が出たら、「世の中」の方こそ、変わるべきな訳で。
そうしなければ、頓珍漢な轢き逃げ対策が、なされる事になり、良くて轢き逃げ対策をしても轢き逃げが減らない、悪けりゃ轢き逃げ対策をすればする程轢き逃げが増えるなんて事態が起こってしまう。
個人なり、集団なり、「世の中」なりが、事実よりも感情を優先させた選択を行ってしまえば、その報いは、そんな愚かな選択を行った者に返ってくるんですよ、何らかの形で。
ま、轢き逃げ犯を罵る事を娯楽の1つとして消費してる方々にとっては、轢き逃げが減るのは、歓迎したくない事態かもしれませんが。
自動車事故発生時の対処法を教えないと出来ないようじゃ情けないですね。
「ちゃんと110番するんですよ～」なんて講習をしないと駄目ですかね。
でも、その場合、人を轢いた際に、パニクってしまう人が多数派だった場合とは、別の意味で轢き逃げを減らす方法etcを検討し直す必要が有ると思いますよ。
だって、事故で人を傷つけ/殺しても、パニクらない程度の心理的ストレスしか感じ無い人(≒人を殺しても罪悪感を感じ無い人)が、世の中にゴロゴロ居る(下手すりゃ、そう言う人の方が多数派)って事に成るんですから。
「知っている」ことと「咄嗟に出来る」ことの間には意外に差があるものですから。
「被害者を助けることが優先で」行動できる人には不要かもしれませんし、効果がどれくらいあるかは分りませんが。
実際の轢き逃げによる被害を減らす、事故を起こしてしまったドライバーの意識のベクトルを被害者を助ける方向に向けて実際に行動させて被害者が助かるようにする、ためには、いろいろな対策が必要で、様々な対策がなされるに越したことはないと感じます。
ところで、講習をしたとして、平気で飲酒運転するような人にどうやって聞く耳を持たせるのでしょうか？
「事故を起こしたら、救急車を呼ぶ」etcの事を体に覚えさせ無いと。
それこそ、免許の取得・更新の時に、そう言う訓練をやるとかの方法で。
そうすれば、もし、轢き逃げの内の何割かが、「パニクって逃げ出してた」為に起こったんなら、今まで「パニクって逃げ出してた」人の全員では無いにせよ、その内のいくらかは、「パニクってるがゆえに救急車を呼んだ」となる事が期待できる訳で。
だって、パニクってる状態では、訓練で身に付いてる事・体で覚えてる事しか出来無くなり、頭で考える事・普段やって無い事は、どんな簡単な事でも出来無くなる。
で、事故起こしてパニクった場合、出来る事は、その場で茫然自失するか、体が覚えてる事(車を運転する)の2つの選択肢しか無い。
そこに、救急車を呼ぶと言う第3の選択肢を加える事が出来れば、交通事故の被害者の死亡率を下げる事が出来る様になりますよね。
追記その２を加筆しました。
追記と追記その２の説明を拝見し、捜査官のご苦労を想いながら、捜査の進展に期待しています。
この事件の裁判員に選ばれたと仮定すれば、法廷での主張や証拠を吟味して判断する積もりです。しかし、以下のことが事実であれば、それだけでも容疑者が自己中心的な人物であると強く印象付けられて、その上でその他の主張（例えば、運転中の違和感についての主張）を聴くことになるだろうと思います。
・容疑者が飲酒運転で検挙・処分されて間もないのに、飲酒運転をした。
・人身事故を起こした時、飲酒運転だったので救護義務を放棄して逃げた。
