交通違反「これで許して」と５千円札 贈賄で現行犯逮捕（asahi.com 2009年1月13日8時35分）
同署の説明によると、１１日午後１０時２０分ごろ、自宅近くの市道交差点で、普通乗用車を運転中の高橋容疑者が、点滅していた赤信号を無視したのをパトロール中の同署員が発見して呼び止めた。酒のにおいがしたため、呼気検査などをしようとしたところ、同容疑者は「これで許して下さい」と言って財布から５千円札１枚を抜き取って差し出し、署員に交通違反の取り消しを求めた疑いがある。
ときどき似たようなニュースが報道されますが、何を根拠にこの手の手段が通用すると思うのでしょうか？
しかも５０００円というのもかなりせこいですし。
冷静に考えれば、かなりお巡りさんをバカにした話です。
冷静な思考力がなくなるほど酒に酔っていたということなんでしょうか？
いずれにしても、タイトルに書いたとおり、かなり高くつくことになります。
同署によると、普通乗用車で赤信号（点滅）を無視する交通違反をした場合、減点２点と反則金７千円が科される。一方、刑法１９８条では、公務員にわいろを渡そうとした者は「３年以下の懲役または２５０万円以下の罰金に処する」と定めている。
しかし、ここはニュースソースを「同署によると」と書くところでしょうか？
「法の定めでは」あたりでいいのでは＾＾
なんでもかんでも警察情報に依存しているというマスコミの体質が表れていると見るのは穿ちすぎでしょうか。
しかも、アルコールの検出量が規定水準以下で、金なんか掴まさなくても酒気帯びにはならなかったそうですね。信号無視だけなら行政処分で済んだのに、いらんことをしたせいで前科者になってしまうのですね。もし自分だったら家族にどう申し開きしたものか見当もつきません。
「記者は自分では道交法に当たってウラを取ったりしてません」 という正直な自白ですね。

警察情報の裏をとることをする習慣が、記者クラブで仲良し組合を作っている大手マスコミにはないのかもしれません。
大手新聞社くらいは、新司法試験合格した弁護士を大量雇用して良いのではないかと思います。
新聞社の高給であれば、特別にポストを作らなくても有能な記者となり、編集者となり日本のジャーナリズムに貢献してくれることでしょう
大量に弁護士さんが生まれている今がチャンスだと思うのだけどなぁ・・・・・
えーと・・・某IT弁護士とか某某人権派かけだし弁護士みたいな実例を目の当たりにしている以上「ホーリツのオベンキョーができる」＝「まともな記者になる」ではないのは自明と思うんですが。
それと、被疑事実に関して警察が「こうこうの理由です」と説明したことを「同署によると」と書いたわけですよね、これは。裏を取るとかとらないとかの話じゃあ、ぜーぜんないと思うんですけど。
もひとつ言うと、記者クラブが仲良しなのかどうなのか外部からは窺い知ることができませんが、仮にそうだとして「裏を取らない」こととどう直線でつながるのか理解しがたいです。
よーするに、お二方はマスコミの悪口を書きたいだけなんじゃないですか？ということです。
少なくとも「法律を知らない記者」より「法律を知っている記者」の方が良い属性であることを否定するという論拠が良く分かりません。
更に、「法律を知らない記者」の方が、「法律を知っている記者」より良い属性だと主張される論拠は更に分かりません。
日本のマスコミには「法律を知っている記者」より「法律を知らない記者」の方が扱い易いというのであれば、理解できます。
「裏を取らない」と「記者クラブ」を直線で継ぐのは、警察情報＝記者クラブ広報を疑わないことが通例だからです。
「記者クラブ」からの情報は、他のマスコミからの批判も受けることがなく、情報を流すときに緊張感を生みません。
日本のマスコミが正しい批判能力をなくしている大きな原因とも、ジャーナリズムが崩壊しているともいえる証左が「記者クラブ」です。
日本のマスコミの悪いところがあり、それを指摘することが”悪口”というのであれば、甘んじて悪口を受け止めるべきだろうと思います

なお、上司による添削云々についての部分は「原稿の論旨・盛り込むべき情報と削除していい情報」の整合性に関しての記述に過ぎず、「腐っているか/いないか」の話とはまったく関連がありません。
この程度の記述の内容さえも正確に読み取れないような人には、書物典拠の情報であっても、その人の記述の信憑性には疑いの眼を向けざるを得ませんがネ（笑）。

私は「元の記事がダメ」と言っているのではありません。
「同署によると」の一フレーズが不必要であり、そんな不必要な記述をわざわざするのは１：記者がバカであるか、２：そのフレーズが必要な記述が当初はあったが、その部分を削除した際に一緒に削除するのを忘れた のいずれかではないかと見立てているのです。
１の「記者がバカ」だった場合には、この記述を素通りさせたチェック担当者（まぁ上司でしょう）も同レベルのバカであると言うことですし、２の「削除漏れ」であったなら、記者ではなく校閲した者がマヌケです。
ところでこのブログでは頻繁に、法務業の末席さんや感熱紙さんはじめ何らかの専門知識を持ち実務に従事している（と推認される）方から、専門分野にかかわる法律関係知識を示していただいて、それに基づいて見解を組み立てたり修正したりしてコメントが記述されています。
警察から適用法条の解説を受けたとの記述があることをもって「裏取りをしない」だの「仲良しクラブ」「腐っている」と飛躍した『批判』が当然であるとするならば、こうした方々からの情報も逐一、法律書と照合してからでなければ非難されるに値するのでしょうね？
それとも、働き口のない弁護士に新たな仕事を与えるために、当局が広報した内容を原稿化する前には逐一、弁護士に相談料払って「ウラトリ」しないといけないとか？なんすか、その『利権に群がるアリ』みたいな話は。

今回の記事の 「同署によれば」 の言い回しがおかしいことには誰も異存がない。
それを、「そんなこと書いたら警察での聴き取りだけをそのまま書いただけで、ウラ取りもろくにしてないと読まれてもしょうがないですなあ」と冷笑してみせるのがそんなにカンに障るんですね。
いえいえ、貴殿が顔真っ赤にして代理戦争を挑んでくださるので、ちょうどバランスがとれてよろしいかと。

法律勉強している人にとっては、条文にあたらない人はバカ呼ばわりが当然だけど、
一般人にとっては、六法なんて見ない方が当たり前だから

要するに、断片的な記事というソースが限定されているから、想像や推測を逞しくやっても又は精緻にやっても、議論には自ずと限界があると思います。また、そこから派生する断片的な意見を論難しても非生産的で最悪は非難合戦に終わる、という典型例ではないでしょうか。ずっと読んでみて徒労感と強い不快感だけが残りました。

一応、道交法にあたってみましたが、
と出ているだけで、信号無視で警察につかまった場合、実際に罰金をいくら取られるのか、実際に減点が何点なのかということは、法律にあたっただけではわからず、警察に聞くしかないのでは？と思ってしまったのですが…
私の見落としだったり、私の調べ方が間違っていたりするのでしょうか？

うん、なかなかお上手な印象操作ですね。それとも自己正当化のための「勝手読み」解釈かな？ マスコミ記者よりも自分は一段高い位置にいるつもりになって、新聞記事を上から嘲笑していい気分になってるのに、その「上から目線の高笑い」を品がないと指摘されたのが、よほど我慢できないようですね。 もしかして、一段高い位置にいると自認する根拠である『法律のお勉強経験』にまで疑義を示されたのでアイデンティティが危機に瀕しちゃったりしてますか？×２の件、場外乱闘等でご自身名乗ってらっしゃるようなのでそれでいいかと判断しましたが、お嫌でしたか、確認せず使用して失礼しました。
悪意の見える漢字表現に置き換えるのとは違うので問題ないだろうと考えたのですが、悪意を窺わせる『誤変換』と、ご自身がなさっている省略を私が用いたことを同列と認識なさるのであれば、一連のやり取りの中で勝手に改変表記したのは私ですので非はこちらにあります。尤も、それを『ダブルスタンダード』と感じる感覚は、ちょっと私には了解不能ですけども。
ご自身、先のロイター騒動のときに、あの文脈の中で『マスコミは息をするように嘘を吐く』云々のステキな認知バイアスを表明なさってたのに、今になって「私は一般化などしていない」ですか？
あの時も「そんな単語は用いていない」的な弁解を繰り返してらっしゃった記憶がありますが、どっかのIT弁護士センセイみたいに印象操作・誘導をしただけだって仰り様なんですかねえ？
一応付言しときますと、モトケンさんのエントリーにある
の記述には私、なんの不快感もないんですよ。
モトケンさんの書いたイヤミ・皮肉・当てこすり、どう呼んでも大差ないですけど、それと fuka_fukaさんのおっしゃる『冷笑』ですか？それとは決定的に大きな違いがありますよね。それが何か理解できますか？
その違いは『ステロタイプのマスコミ批判』や『ただマスコミの悪口を言いたいだけ』と、そうでないものを分ける一つの分水嶺ですよ。
念のために補足しておきますが、その違いはかつて、モトケンさんが光市事件裁判の被告人弁護団に向けたネガティブ評価と、匿名の多くのネットユーザーが同弁護団に向けたネガティブ評価の差異と同質です。大人と子供の違い、と言い換えることも多分可能です。
回答は求めません。なぞなぞやってるわけじゃありませんから。
ただ、この違いを fuka_fukaさんが自覚もしくは認識できないのであれば、あなたは光市事件弁護団に罵詈雑言を投げかけ続けた人たちや『たらいまわしの病院や医師』を非難し続ける人たちと大差ない・・・と言うだけのことです。
私は前２例において、弁護団非難のコメントに反対の弁を述べ続けましたし、『たらいまわし』非難に対しても同様です。
今回、あなたの「マスコミ批判（かぎカッコつき）」に対して私が書いている姿勢について『顔真っ赤にして』と言うのであれば光市事件弁護団の騒動の折にネット上で刑事裁判における司法の役割を説き続けた各位に対しても、同様の評価をなさるよう。『たらいまわし』批判は当たらないとする医療関係者の皆様に向けても同じように『顔真っ赤にして』とのご見解を表明なさってくださいませ。
ちょっと気の利いた捜査官なら、この手の珍しい事件の報道発表の場合、関係する法律の条文なんかを報道案文の備考欄に書き添えたりするのは普通にあるんですけどね。
私もそんな案文を作った経験がありますし。
ついでに言うと、この朝日記者氏の記事で警察からの情報提供によるのは「普通乗用車で赤信号（点滅）を無視する交通違反をした場合、減点２点と反則金７千円が科される。」の部分で、後半は刑法条文からの引用に読めるんですが・・・
「赤色信号（点滅）無視」は結構レアな違反なので、この違反に関する行政処分点数と反則金の額については、警察に聞くのが一番手っ取り早いんですよ。
むしろ私は、警察から聞いたことを律儀に記事に書き入れるこの朝日記者氏は正直者だなと思うんですがね。
場外乱闘板への速やかな移動を厳しく勧告します。ここまでくればトピ違いスレチガイ迷惑千万アク禁も考慮されてしかるべきかと愚行します。
惰眠さん、お気持ちは分かりますし仰ることも十分理解できますが、既にモトケン先生からも警告がなされています。
何事も度を過ぎれば毒となります。

ちなみに、道路交通法と電波法は、下部法規（政令や省令などを含む細則）が多数あり、それらを詳細に踏まえた道路交通六法や電波六法まであります。道交法のベテラン副検事さんでも全部頭に入っているわけではないし、交通課のベテラン交通警察官でも細則にいけば道交法六法を引いても該当箇所に行き着かないことがあります。
軽々しく六法引けとは言えないでしょう。もちろん私は引いたこともありません。無線従事者免許試験の受験勉強で、はるか昔の学生時代に電波六法を引いたことがあるだけです。(^^ゞポリポリ

昨年だったの思うのですが、犯罪報道について新聞各紙が情報源をできる限り明示するという方針を打ち出しているはずですね。
裁判員制度をにらんで、裁判員に不当な予断を抱かせないようにするというのがその目的だったと思います。
で、最近は、「○○署によると」とか「警察幹部によると」というような頭書きをつけることが目に付くようになりました。
このニュースの「同署の説明によると、」というのもその方針に従ったものだと思われます。
その意味では、この記者は、前に二文字をつけてもいいくらい「正直者」だと思います。
しかし、取材源の明示が必要になるのはニュースソースによってその評価が問題になる「事実の報道」についてであり、明文の法規範については、警察官が説明しても弁護士が説明しても自分で勉強しても、それが法令に合致している限り関係のないことです。
で、何が言いたいかといいますと、この記者は、なぜ情報源を明示する必要があるのかということについて、自分の頭で何も考えていないのではなかろうか、ということです。
自分が調べて主体的に判断するという姿勢がどの程度あるのだろうかという疑問が生じました。

という揶揄表現をしてしまったわけですが、どうも説明不足が荒れの原因になってしまったようで反省しています。
昔、柳田邦男氏（「マッハの恐怖」の著者の方）のエッセイでこんな話を読んだことを思い出しました。

記者「今朝は寒いですか？」
デスク「自分で外に出てみろ！(怒)」
柳田氏は、記者は客観的なデータ(？)が欲しくてデスクに電話したのだろうが、デスクは自分で実感（取材）しろ！と言いたかったのだろう、と書いておられました。

警官に「賄賂」は通用しない、ということが報道され、ある意味安心しています。
現場の方々の倫理観を、エラ～い方々にも見習って頂きたいですね。

おかげさまで、道路交通法施行令の該当個所に行き着くことができ、本件の信号無視が「減点２点、反則金7000円」であることを確認することができました。
しかし、実際に調べてみた率直な感想として、これをイチから素人が調べようとすれば、該当個所にたどり着くだけでも、やはりけっこう大変なのでは…と思ってしまいました；^^
また、仮に該当個所にたどり着けたとしても、普通車で「信号無視（点滅）」なら反則金は7000円とちゃんと出ている一方で、
普通車で「信号無視（赤色等）」だと反則金は9000円とも出ていて、素人が予備知識のない状態でこの該当個所にあたった場合、本件の場合にどちらが適用されるのか、警察に確認しないと確信がもてないのでは…と、あくまでも個人的な感想ですが、思いました。
法に明文化されていることを、「同署によると～」と書いたら、たしかに文章の体裁としてはおかしい気もしますが、この記述をどう評価すべきか、私には難しいところです。
単に『警察署の発表内容の中に、減点及び反則金７千円と定められている旨が含まれていたという事実』を、淡々と伝えたいという意図以外は無いのでは。。。担当記者氏が今回の事案に於ける減点点数及び反則金の規定を自己の見識として承知した上で、警察署の発表に含まれていたという事実を示したいだけかも知れませんから。
「一方、刑法１９８条では、」以下の部分では、記者氏が別途刑法を調べて、読者の刑罰の比較に資するために、敢えて前記警察発表のあった事実の直後に、付記したのかも知れませんから。
前者は警察発表、後者は新聞社に於いて刑法にあたった、という情報源の差異を明示する意図があったとも考えられますし、それはそれで「情報が記者氏 or 第三者のいずれによるのか？」を明らかにする意味で、裁判員裁判を踏まえた報道姿勢としては為されても良い配慮ではないかと。

感熱紙（刑）さんとハスカップさんからのご教示を戴き、先に記した「この記者はバカ」「校閲担当者はマヌケ」を撤回しなければならない可能性があることに思い至りました。
それは、狡猾といっていい類の（責任回避のための）『賢明さ』を発揮した可能性です。
つまり署員から説明を受けた適用法条と処分内容について確認を取ったが『本当にそのとおりなのか、記者としては確信が持てない』とします。あたるべき原典も膨大、当該箇所の記述もシロトには分かりづらいようですから。
それで万が一、記事に書いたことが正しくなかった場合、読者の抗議、県警からの抗議、場合によっては警察庁からの抗議も覚悟しなくちゃならない。『朝日さ～ん、間違ったこと書いてもらっちゃ、困るんだよね～』などなど。
そこに『同署によると』の一言を付するとアラ不思議、仮にその解説が間違っていたとしても、お叱りを受けるのは『間違ったことを教えた所轄署』になって、朝日さんの責任じゃないってことになりましたとさ・・・・。
原典にあたっても分からず、狡猾な責任回避というのはちょっととは思いますが、原典にあたるという姿勢があるのであれば良いなあと思います。
マスコミから質問を受けたりする立場にあるのですが、
「～の場合はどうなりますか」
「○○になります」
で終わってしまうのが通例です。
「根拠はなんでしょうか？」
と聞かれると、この記者さんしっかりしてるなと思うくらい、そこまで聞かれることは少ないです。
ましてや「××を見てちょっと分からないのですが」というようなことを言われるのと何か重大なことでもあったのかとドキッとするくらい、このようなやりとりは稀です。
自分で調べようというよりも聞けば良いというような印象を受けます。
原典にあたるような面倒なことをしてると締め切りに間に合わないとか、そんなことをしても部数・視聴率が伸びるわけではないとか、いろいろと事情はあるのかなとは思いますが。原典にあたるとか、そういう取材を経たものを受けて側がろくに望んでいないというのも問題かもしれません。
