ニュースを読んだだけで眼がうるうるしてしまいます。
法曹三者のどの立場でも法廷に立ちたくない事件です。
いや、それは嘘です。
検事も弁護士も裁判官も、法廷における一言一言にそれぞれの人生観が表れそうです。
そして彼らの一言は、被告人にとってどれも大きな意味を持つ可能性がありそうですから。
「長男がダウン症を持って生まれてきたことには必ず意味がある。あなたが生き残ったことにも意味がある」
という裁判長の言葉は被告人の胸にどのように響いたでしょう。
それにしても、求刑１０年ですか。
重すぎるか、軽すぎるか、適切か？
こういう事件こそ裁判員の量刑感覚を聞いてみたいです。
障害を持つ身になると他人事ではありません。家族にこの先迷惑をかけ続けるなら、加齢でもっと障害が悪化して家族に過酷な迷惑をかけるなら、いっそ…。…(つД`)グスン
ご遺族のご冥福を祈ると共に、元被告人の幸多からぬことを祈ります。
神が私たちを試しているんでしょう。
障害者の受け入れ施設の過少であることは、ＮＩＣＵの受け入れ能力に少なからぬ影響を与えているという点でも話題になっています。
どんな子であっても自分の子は自分の子だと思うんですが、それでなくとも家族介護は無間地獄です。
介護者が赤の他人であることの方が大切である場合は、やっぱりあるだろうと思います。
選択の余地が無かったのであろうかと思います。知らなかったのか、知っていても受け入れ不能であったのか…。
何というか障害があってもその子の命はその子のものであって、親が辛いからって一緒にってのは大間違いですよね。
それを世話が出来なくなったから一緒にって思わせちゃう社会が問題なんだろうけど.....
福祉もちゃんと調べてサービスを要求する人にしか提供されないけど、最悪の状態のときはアクセスすることも出来なかったりしませんか？
本当に追い詰められてる人を救い上げるシステムって無理なのかなあ....
人が生きていることに意味を見出すのは周りの人間の想いだと思います。
上手く言えないのですが、どんな人間でも、母親から生まれてきて最後は死ぬ、という点では平等です。その生涯において周囲の人々からどう評価されるか、というのは別の話のようにも思えるのです。
このご一家の人たちが生まれてきたことは、少なくとも、自分勝手な理由で他者を殺めたり傷つけたりする人間よりはすっと意味のあることだった、と私は思いたいです。
もし私たちが、要介護の人間の介護をその家族に押し付けることの是非を考え、社会を変えていこう（Change. Yes,we can!)という気持ちになるならば、それだけでも彼らが生まれてきたことの意味があるように思います。
自閉症の弟と20年をともに過ごし、また医師として命の重みをある程度は知っている立場からの感想です。
10年は軽すぎると思います。
一生をもって償うべきです。
ただし、刑務所での通常の懲役刑ではダメです。寿命が尽きるか、自らが要介護者になるまで知的障害者の介護にあたる、というのが相当の刑罰と考えます。

８年でも１０年でもダメ。
後追い自殺したくなくなるまで刑務所いれとくのも何だし。
知的障害者施設での介護が一番だと思います。
一生とは言わないけど親が無くても他人の支援ででも大丈夫だったんだって判るまで。
それでそう思えたら、同じような思いつめた人を救う仕事をやって欲しい。
あいかわらず本当に必要なところに必要なものが届いていない。なんだかなぁ〜。
はっきりこの件の事を知っているわけではないが記事を読んだ限りでは刑の長短はこの被告人にとってあまり意味はないのではと思う。既に抱いたその苦しみや葛藤は私の想像をはるかにこえているであろうから。
まだ私が医者知らずの若いとき「障害者は票にならん、票になるのは老人福祉だ」と吐き捨てるように言った議員の顔を今でも覚えています。その老人福祉ですら老人医療でさえも……。

「今さかんに少子化問題が取り上げられているけれど、生まれる子どもは健常児ばかりとは限らない。さかんに産めと言われても生まれた子に障害があったら親が自分たちで何とかすべきだと言われる。
若い夫婦は将来の設計のすべてがくるって途方にくれることになる。
本当に少子化をどうにかしたいのならば、これから親になる人にどんな子が生まれても大丈夫ですよと言ってあげられる社会にすべきだ。」
私はこの園長先生をすっごく尊敬してるんですよね〜。
あと私の尊敬する先生で障害者も成人したら健常者と同じく親と離れて自立すべきって意見もあります。
もちろん自立というのは一人で何でもやるという意味ではありません。
必要な支援を受けて自立するということ。
それには親以外の支援でも受けられるように育てるということ。
ただし障害者自立支援法ではノーマライゼーションは絵に描いた餅ですが。（施設解体して地域で暮らすって言ったって，グループホームじゃ無理な重度の人のためのケアホームはどこにあるんだ？！）
この事件の場合はご両親がお子さんが２０歳くらいまでしか生きられないと思って親だけで抱え込んだのが問題なのだと思います。
ダウン症で身体的な問題もあるのでそういう覚悟もしておいて下さいという意味だったのでしょうが、そのために成人したあとの見通しを立てていなかったのでしょう。
時にヘルパーさんを頼むとか，ショートステイを利用するとかして３人だけの閉ざされた家庭に風を通す必要があったのだと思います。

そういえばシベリアに釣りに行った時、旧ソ連はタテマエとして、万民平等を謳っていた（シベリア抑留経験者によると男女差別も民族差別も殆どなかったとか）から、ロシア人は非常に障害者に優しい、と聞いた事があります。医療も確かタダじゃなかったかな。ただし、「男子一生の仕事」とはとても言えないような処遇とステータスだったので、女医さんが非常に多かったとか。もちろんレベルはおして知るべし。
「民族的気質」ではなく、イデオロギーによる人為的なモノだったとしたら、180度転換した完全資本主義の現代のロシアの障害者はさぞかしヒドイ事に…。

後期高齢者問題とかも同じなんですよね。
老人病院潰すとか障害者の施設無くすというのは、そういうのを無くして地域で暮らしましょうと言えば聞こえはいいですが、身内が自分達で死ぬまで世話しろよ、無理なら心中でもしてねって感じに思えるんです。
それでもまったくいいところが無いと感じる後期高齢者医療制度に比べれば、障害者自立支援法はいい部分も含んでいると思うんです。
ただしいい部分でも利用するためには理解と努力が必要だということ。
本当に思いつめてるくたくたになった人が支援を要求できるかというと難しいと思います。
同じことは後期高齢者医療制度にも感じますが、批判されてからあわてていろんな救済方法を付け足しましたが、当人の後期高齢者はそれを正しく理解してお役所で手続きできてるのかなって疑問です。
いろんな福祉関係のお金が細かく制度を調べ上げて悪用する人に使われちゃってる気がしてなりませんね～。
本当に必要な人がほったらかされてるのに。
この量刑は直感的には重いと思います。 20年間ずっと介護し続けてきた奥さんの言葉を見る限り限界だったのでしょう。 母が自らの子の死を望む状況と言うのは想像を超える物があると思います。
そして裁判長が言った言葉は重いですね。 どんな人にも生まれてきた意味があり、そして被告が死ねなかった事にも意味がある。 ７年という判決はその時間を使ってその意味を探しなさいと言う事なのかもしれない。
最初に直感的には重いと書きましたが、被告の心のケアと再出発にかかる時間と言う意味では適切な判決の様な気もします。
