病気で黒ずきん姿の高校生へ警官「お前はタリバーンか」（asahi.com 2009年3月7日6時20分）
この報道の意図はなんなんでしょう？
紫外線を浴びると皮膚が炎症を起こすポルフィリン症のため、黒いずきんをかぶって自転車に乗っていた鳥取県境港市の男子高校生（１８）に警察官が職務質問した際、「お前はタリバーンか」と発言し、ずきんを取るよう求めていたことがわかった。
黒いずきんをかぶって自転車に乗っていた若い男性に対して、職務質問をしてずきんと取るように求めたことが問題なのか、その際に「お前はタリバーンか」と発言したことが問題なのかどちらなのでしょうか？
「黒いずきんをかぶって自転車に乗っていた」というのは一般的には「怪しい」と見てもおかしくはないと思います。
つまり、職務質問自体には特に問題はないと思います。
そして
高校生がその場で病気を説明したため、ずきんは取らずにすんだ。
というのであれば、この警察官はちゃんと聞く耳を持っていたことになります。
では、「お前はタリバーンか」と発言したことがどの程度問題かというと、これは個人的な感覚の問題だと思われますが、それほど目くじらを立てるほどの発言とは思いません。
私としては、この記事が悪者に知恵を付けることになることを憂慮します。
朝日の記者さんもそういう意識はありますよね？

重度身障者の子供が転倒防護用のヘッドギアを付けて外出すると「オ◎ムの子」と苛められた暗い時期を思い出します。当時は、ちょうど身障者対応部署にいたものですから。m(_ _)m
どこかの政府高官もそうですが、立場に見合った発言をしないとバカにされますよ、ということでしょうか。

まぁヘリクツの言い逃れをするんなら「"タリバン"は差別語ではない」みたいな、ガキの弁解みたいな恥の上塗りも可能でしょうけれども。
例えば、相手が聞こえないフリをしたときに「お前は聾か」だとか、黙秘する相手に「お前は唖か」だとか、あるいは標識無視の違反ドライバーに「お前は盲か」などの言葉を投げかけたとして、果たしてそれらは「正当な職務執行」の範疇に収まることなんでしょうか。
・・・という話だと思いますよ。
「お前はタリバーンか」と言う言葉をどういうニュアンスで聞きますか？
私は、当該高校生に対しての発言としては、冗談の範疇と聞きます。
日本国内ではですが。
もちろん、タリバーンのメンバーがこのニュースを聞いてどう思うかは別問題です。
その場の雰囲気が分かりませんので、一般論的感覚に基づく意見です。

補足ですが
警察の（検事でもありますが）調書によく、「強い口調で」とか「語気するどく」とか「脅すような言い方で」というような記載がありますが、これらは原則的に「印象操作」だと考えています。
弁護士的にも検事的にもです。
つまり、本人に直接確かめてみないと判断がつきません。

たとえ冗談ではなく叱っていても、皮膚全体を頭巾で覆うというスタイルは、ふざけているにしてはかなり手が込んでいます（朝日に写真がありました）し、普通の不良の間で見られるような類の格好ではないことは見れば分かるでしょう。
ですから、本人が「私はポルフィリン症という病気で紫外線を浴びると皮膚が炎症を起こすのでこの頭巾を被っています」と説明すれば、理屈は通ってますし、自身に知識はなくても家族や学校に問い合わせるくらいはするんじゃないでしょうか。別にウソならそれから厳しく叱ってもいいわけですから。
もし、言うことを聞かずに無理やり外させて、実際に炎症を起こせば、それこそ“ごめんなさい”程度ではすまないのですから、「冗談」であれ「詰問」であれ、余程冷静さを失っていない限り、警察官ならその程度の「危機管理」はすると思うのですが。
当の高校生は冗談だとは感じなかったから、警察に抗議したり県議会で取り上げられてニュースになったのですよね？
いつも好奇の目で見られている者の立場は理解できないということですか…。
可能性の問題ですが、当該の警察官の主観においては、空気を和ませようとしてかフランクな冗談を言ったつもりになっているのかも知れません。
その可能性は否定しませんが、ごく一般的に誰かを指して「お前、タリバンみたいだ」というのは、ニュース報道などでごく普通の人がその名称から受ける「＝テロリスト」の印象、さらにそれを言ったのが取り締まり当局の官憲であることを考えれば、悪意のベクトルを孕んだ（もっと言えば、先に書いたように「侮辱的」）揶揄と看做さざるを得ないと私は考えます。
ネガティブな評価がなされるようなものに喩えることは適切を欠いているんじゃないでしょうか。
これが例えば「お前は『影の軍団』の服部半蔵か」だったらまだマシだった・・・とも言えないか。当該の生徒はそれでもいい気はしないだろうなぁ、好きでそういうカッコしてるわけではないだろうから・・・
まぁ、なんといいますか、なんで余計な一言をいうんだろうなぁと思うのです。ストレートに「で、そのカッコの意味は？」と聞くんじゃ、なにか不足あったんでしょうか。

ええ、いずれにせよ服装のことを言われれば、当該高校生は不快感を抱いたろうと思います。
ですので、ある意味『結果論』の部分はあるんです。私も、その部分を批判（ないしは非難）するつもりは毛頭ありません。が。しかし。
ことさらに相手を嘲弄する必然性はないわけで、そういう態度で職務に臨んでいたとするならば「お前、オイコラ警官か」と指弾されるのはむしろ健全なんじゃないかと思うんですよ。
別のトピックにあった「舐められたらおしまい」はそのとおりですが、しかしその方便として「市民を見下し嘲弄し尊大に振舞う」のは（もしそうだとするなら）大間違いと思いますんで。
んで、県議会ならば、こういうことは得てして取り上げられては問題視されると思うのです。都道府県議会というのは、そういう所だというのが私の認識だったりします。

私は、この発言はたとえ冗談だとしても言ってはいけない類の言葉だと思います。病気への無知、イスラム教徒への偏見などが幾重にも重なっていないと、こういう発言はなしえないからです。さらに、そもそも冗談だったとしても、冗談を発するのが適切な状況下であったかについても疑問です。ですから、これを県民への権利侵害だととらえた議員が議会で質問することも、それが報道されることも適切であると思います。

２人乗りを注意したのですから、怪しい（と思われる）黒覆面についてもついでに問いただされるのは仕方がないことだと思います。警官の「お前はタリバーンか。自転車はだれのものか」からすると、自転車窃盗の疑いも持っていたようなので、黒覆面も悪ふざけか犯罪をする際に顔を隠すためにやっていると思ったのかもしれません。少年が病気であることを知らなかったのであれば、軽口が出るのも仕方のない状況ではないでしょうか。
知らぬとはいえ病気のため仕方なくしている服装を揶揄してしまったのですから、謝罪はするべきだと思いますが、謝罪して警察内で周知徹底することで済んだ話でしょう。（２度抗議に行っているということなので、１度目は警察の対応に至らない点があったのかもしれませんが）
何故最近になって県議会で改めて取り上げられたのかは記事からは分かりませんが、形式的な県警本部長の謝罪が重要なのではなく、世間に広く知らしめて（警察に限らず）同じ間違いを繰り返さない事でしょう。
この記事だけでは、警察をつるし上げるためだけに議会で取り上げたように見えるので、取り上げる必要があるのか？という疑問は感じます。もしそうであるなら議員何やってんだという話ですし、今後の対応策まで考えたのなら、そこまで書かないこの記事は何なんだ？という話になると思います。
この件、病気に関する知識だとか、タリバーンの表現とかの問題以前に、職務質問の方法としては落第ものですね。
職務質問は地域警察官の職務遂行に際しての強力な武器ですが、だからこそ、その行使に関しては十分な注意を払う必要があります。
具体的に言うなら、アグレッシブかつジェントリィ。
