検事総長喚問を、民主・西岡氏 議運委理事会で主張（2009/03/10 17:24 【共同通信】 ウェブ魚拓）
西岡武夫参院議院運営委員長（民主党）は１０日の議運委理事会で、西松建設の巨額献金事件に関し、検察当局が世論操作をしているとして、検察トップの樋渡利秋検事総長の証人喚問を行うべきだと主張した。
これは漆間巌官房副長官のたわけ発言に匹敵するおバカ発言ですね。
西岡氏は理事会後、記者会見で「検察当局のリークは目に余るものがあり、世論操作が行われている」と指摘。同時に「あくまで自分の考えであり、実際に喚問するかは民主党執行部などとも十分に相談しないといけない。自分の一存でというわけには簡単にいかない」とも述べた。
何を言っているのでしょう。
上記引用で私が強調した部分は、いかにも西岡氏の個人的見解であるかのように言っていますが、国会法で定められた国会の常任委員会の一つである参議院議院運営委員会の委員長である西岡氏が議院運営委員会の理事会の場で発言したのであれば、それは公人が公の場で発言したと言わざるを得ないのであって、個人的発言で済ますわけにはいきません。
そして、この西岡氏の発言は、明白に検察に対する圧力、つまり、参院議院運営委員長として検察に対して何らかの影響力を行使しようとしたものです。
これほど露骨な検察に対する政治家からの干渉は、指揮権発動以来なかったのではないかと思われます。
民主党の中に、このような西岡氏の行動を容認する空気があるとすれば、民主党が政権を握った場合にはさらに強力な圧力を（当然民主党に有利なように）検察に加えてくることが予想されます。
というような予想は、少し考えれば誰でも持つだろうと思われます。
ほとんど独裁国家の感覚です。
そういう民主党を国民は支持するのでしょうか？
おバカ発言たる所以です。
せめて「抗議する」程度にとどめておけばよかったのに。
証人喚問は国会が持っている最強の直接的権力行使ですからね。
全容を解明するために、民主党は検事総長の証人喚問ではなく、小沢代表の証人喚問を要求するべきだと思います。
この事件自体は、今のところたいしたことではないのでしょうが、民主党の対処が稚拙きわまりなく、支持率が急落しているのも小沢代表に対する不信感よりは、民主党に対する不信感が高まっている現れだと思います。
「国策捜査！」の一点突破的な批判は、彼らが政権を握ったときに何を行うか、思惑が見え透いていると思うのですよね。

私、バラエティ好きの単なる主婦ですが、この記事を新聞社のＷＥＢで読んだとき、違和感を感じ、専門の方のご意見を聞きたくて別のエントリに質問コメントを書かせていただきました。
自党の議員関係者が逮捕されたからといって捜査の途中なのに検事総長を議会に呼び出すなんて、特権を利用したおおっぴらな圧力としか思えなくて。私達市民にはそんなことできませんものね。
検察の方もあの政治家さんの関係者を逮捕するからには時間をかけて慎重に捜査および逮捕の判断をされたと思っているので、私自身はまったく陰謀等とは考えていません。どちらかというと昨年西松の問題が明るみに出たときから政界の問題に着手される事に期待していたかもしれません。
でも本当に証人喚問をやってしまい、報道機関もそれが正義だと徹底的に報道したら多くの人は検事総長の証人喚問は正しいことだと考えるのかもしれません。私の友人の主婦達の中にはもうすでに陰謀説を信じている人も結構いますから。ＴＶの威力はすごい。
ところでモトケンさんにお聞きしたいのですが、報道されているようなリークとも取れる内容が検察の側からの情報の様に言われていますが、検察が捜査内容に関わることをリークすることなんてあるんでしょうか。別ルートから得た情報から推測した事を、あたかも検察からの情報であるかのごとく報道しているような気がするので。
検察の政治的中立や公正を前提にすればそういう反論になるのでしょうが､今回はそうは言えないわけですね。
もし、検察の行動に不正があった場合､行政機関である検察を国会において咎めるのはごくごく当然の事ですから。

この質問につきましては私の忌憚のない意見を書きたいところなんですが（実は草稿はすでに書きました）、最近のこのブログの周辺の状況を見てみますと、誤読曲解の嵐になりそうな予感というかほぼ確定的な予測が成立しますので、書きにくいです。
もう少し状況判断をしてから書くかどうか考えます。

単純に今回の逮捕のタイミングが問題になるのだとすれば今回の証人喚問発言のタイミングも問題になるのではないかと思いました。
今回の件は昨年からの流れを考えると唐突とも思えないし、いつ行われるかわからない選挙に配慮して捜査を待つなんて変だと思うんです。与党の議員も調べられていますし、過去にも与党の有力議員に関する事件が取り扱われています。中には有罪になった方もありますよね。すべて証拠に基づくもので何もしていなければ悪い証拠もないでしょう。胸を張っていれば良いのであって、心配することはないはずです。これって理想論なのでしょうか。
今回野党だから捜査のタイミングが問題になるのであればそれこそ不公平なのでは？
今回の騒ぎを見ていると、日本の将来を左右する重要人物に関する問題であるにもかかわらず、推測だけで検察を叩く風潮があることに恐ろしさを感じてしまいます。

悪人を相手にしつつ、こちらは due process で緻密に追い詰めてゆく苦労は大変なものだと想像します。
しかも、俗に言う「政治的圧力」とか「世論」とかも読んだ上で、諸方面からの批判に耐えねばならないわけですし。
「巨悪を眠らせるな」かつ「権力は暴走させるな」。
う～～ん。「悪になめられない」かつ「誠実な検察」。

強大な脅威（と思っているだけの生物も含む）に恐怖を感じると窮鼠猫を噛むような反応を示すのは生物の防御反応（自己保存反応）として自然でしょう。恐怖驚愕は遮二無二相手を攻撃するように生物はプログラムされています。後ろ暗い弱点があれば、そしてバトルすれば負けて殺されると思う弱点があれば、特にそうです。
たとえば、昔、実家で飼っていた秋田犬は、チワワが執拗に吠えても、フンと鼻にもかけなかったですが、自分より大きな土佐犬を前にしたとき、傍目にかわいそうと思うほど腰が引けて足が震えていながら、土佐犬に吠え続けていました。
もちろん、土佐犬の方は、「またか」とでもいうような顔で全然相手にもしてなかったです。これから人間心理を推測するのは、憶測を超えた邪推になりそうなので、「個人的感想に過ぎない」として以下略とします。
モトケン先生にご質問されているところ、横から失礼します。
国民の知る権利や、報道の自由の観点から考えれば、特に国民の耳目を集めている捜査中の事件について、捜査機関側から、捜査や公判に支障を及ぼさない範囲内でマスコミに対して情報を提供することは、それほど問題があるとは言えないと思います。
なぜか日本のマスコミは、情報をシャットダウンすると、大手新聞社でもいきなり出所不明のトバシ記事を書くことがあり、誤情報による混乱や批判を避けるためにも正しい情報は重要です。
ただ、捜査機関側からの一方的な情報提供は、安易に被疑者／被告人を有罪と断定する世論を形成してしまったり、被疑者／被告人や関係者のプライバシーを侵害する可能性もあるため、十番な注意が必要です。
特に、警察捜査段階での捜査情報の広報が、そのような配慮に欠けた物になりがちです。
しかし、今回西岡議員や鳩山議員らが主張しているのは、「捜査途中の情報を検察がマスコミに提供するのは不適切である」ということではなく、「検察が政府与党の意を受けて民主党が不利になる世論形成を企図している（根拠なし）」との前提の元に、「検察は、民主党にとって不利益になる情報をマスコミに流すな」と主張しているわけです。
しかしながら、実際は二階経産相周辺に対する捜査の可能性や、自民党側に対する追求についても情報が漏れ出てきている現状では、説得力を欠きますし、むしろモトケン先生が言われるように、民主党は政治的圧力で司法に介入することを明言してしまったのだと感じられます。

民主党は「この大事な時期」に党の信用を失墜させた小沢代表を公の場で追及すべきです。できる限りの資料も公開して党としての自浄能力を示し、反論すればいい。
現状で｢検察批判｣をするのは「八つ当たり」にしか見えません。まず「李下に冠を正してしまったこと」を反省すべきでしょう。
今、検察と民主党のどちらを信用するか、と聞かれたら、私は当然「検察を信じます」と答えるでしょうね。
（というかこんな「八つ当たり」する政党が政権を取ったら「指揮権発動」するんじゃないか？って思いたくなります）

なぜ時事だけ「証人喚問」ではなく「参考人招致」なのかという疑問です。
両方言ったのかな？
証人喚問のハードルが高いが参考人招致ならよくある（だから「事情聴取」という表現か？）ので、記者が推測を交えて記事にしたかもしれないですね。それとも発言者が両方を言ったかもしれません。

確かにあくまで自分の考えというのは白々しいですね。
明らかに検察にケンカ売ってる発言です。
ただ、それはそれとして、捜査情報を漏らしているのは誰なのでしょう？ 検察か警察関係者か、どちらにしても公務員が刑法の守秘義務を違反して漏らしているのはほぼ確実なのではないですか？ それが今まで慣行として行われてきて特に問題視されていなかったのは承知しています。ただ、捜査情報漏えいは明らかに法令違反です。この件につき当該機関のトップに話を訊いてみたいと委員長が言うのはそれほど「おバカ」な発言なのでしょうか？ 行政の法令違反疑いに対し立法がチェックしているだけに見えます。捜査情報漏えいは長年の慣行でそれなりの社会正義を実現しているのだから不問にすべきだ、というのなら小沢さんの献金の件も長年の慣行なので不問にすべきだ、ということになります。

その質問から全て始まるわけです。
当然ながら、していません､と言う答えが返ってくるでしょうが､
あとでリークしていることが明らかになれば偽証罪に問われるわけです。
無意味と言うことは無いですよね。
この証人喚問が捜査に影響を及ぼすとしたら､検察がリークできなくなるくらいの事で､検察としては困ることは無い筈です。
民主党様も今回の事案という個別案件について、それなりの確信（確証）をもって一連の発言をなさるのなら、国家公務員法第１００条違反で捜査当局に告発すれば良いのであって、検事総長を証人喚問する必要は無いと思います。
あるいは今回の事案とは切り離して、一般論として公務員の報道機関への対応を問題視するなら、平時に国会に於いて十分に議論の上で必要なら立法措置を行うなどされれば宜しいのでしょうが、然りとて検察庁だけの問題でないので検事総長を証人喚問するのは筋が違うと思います。
もし検事総長を国会に呼んで、「すべてご指摘の事実はない」という答弁であったら、それ以上どうするおつもりなんでしょう＞民主党様。
仮に包括的な質問手法でなくて、個別具体的に根掘り葉掘り質問したりして、ある程度の答弁が為されたら、捜査の手の内を公然とさらけ出すことになりかねず、場合によっては（非公開の会議であったとしても）不都合なことになるようにも思うのですが。まだ捜査が現在進行形の事案なのですから。
ところで、自民党様も一部議員の方も捜査対象であるような報道が一部で為されてますけど、自民党様は対応が冷静なのか、報道が為されないだけなのか、、、うみゅう。
捜査機関側からマスコミに対し「～に対する捜査を行う」と漏らすことと、マスコミの「～に対する捜査は行うのか？」という質問に対し、捜査機関が可能性を示唆することは全く別でしょう。
前者は明らかに情報漏洩の疑いが認められますが、後者は報道の自由や国民の知る権利との関わりがあるため、同列に扱うことはできません。
むしろ、報道対応の範疇であり、問題とするならば、マスコミの取材姿勢が問題視されなければならないでしょう。
また、捜査機関が取材に答えること、捜査機関に取材することが問題ならば、事件報道は事実結果の大本営発表とソースがない憶測記事ばかりになってしまいますが、それは健全な報道といえるのでしょうか？
ところで、民主党はやたらと検察が情報をリークしていると非難していますが、自民党関係者が逮捕され、同様の報道が行われても、検察を非難するのでしょうか？
世論操作とかアホな事を言っているのを見る限り、単に自分達に都合が悪いので、口を塞ごうとしているようにしか見えませんね。

西岡氏の意図は「トップに話を訊いてみたい」というようなものではないでしょう。
明らかに圧力、控えめに言っても牽制球です。
検事総長の証人喚問をネタにして検察に圧力をかけようとすることが「おバカ」だというのです。
そんなことをしたらものの分かっている国民は西岡氏ひいては民主党のことをどう思うか、ということも分からないのか、という意味で「おバカ」なわけです。

本日はモトケンさんが表で孤軍奮闘状態なので、助太刀させて頂きます。以下は先ほど私が裏の場外乱闘板に投稿したコメより、一部抜粋コピぺです。

西岡氏にしろ民主党にしろ、普通の主婦様のようにオカシイと気付く人は結構巷間に居るのであって、余り有権者をナメタ言動を重ねていると、何時か足元をひっくり返されると思うがなぁ。

司法に対する政治介入がどれ程の政治混乱を引き起こすのかは、イニシエの犬養法相指揮権発動事件での日本中大騒ぎを勉強すべきでしょうね。
この1954年4月下旬の一大政局の結果、年末には吉田内閣総辞職、そして翌年の保守合同（民主党と自由党が合体して自由民主党が出来た）の結果、鳩山一郎や岸信介（いずれも旧民主党）などの「逆コース」政治の復活に繋がったとも言われます。
ちなみに安倍晋三元首相の母方の祖父が岸信介であり、大叔父が指揮権発動で逮捕を免れた佐藤栄作、そして現首相の麻生太郎の祖父が吉田茂で、鳩山一郎の孫は片方が民主党の鳩山由紀夫、もう片方の孫が郵政イジメの鳩山邦夫現総務大臣。そして佐藤栄作が首相のときに自民党幹事長として金集めに辣腕を振るったのが、民主党の小沢一郎の師である田中角栄。
イヤハヤこの２年ほどの政変ドタバタ劇のキャストが全部出て来ます。この1954年4月20日の「指揮権発動」の怨念抗争が、今やっている「国策捜査」の騒動とも言えます。どうなることやら･･･

今回の犬のニュアンスは、比ゆ的にいえば、法務業の末席さん指摘の血統書を見るといいかもしれません。いずれにしろ外野は無責任なようで、実はしっかりしているかもしれません。衆参問わず法務委員会所属議員の大半は弁護士先生です。

thx-1138さんのコメントで、検事総長を証人喚問しなくても捜査当局に告発すればいい、ということは分かりました。告発という手段をとらなくても民主党は法務委員会で法務省刑事局長に対して質疑するということもできるでしょうし、証人喚問という手段が不適切なのは理解しました。刑法ではなくて国家公務員法だというのも理解しました。
そういう法律上の知識をある程度もっている国民を「ものの分かっている国民」とおっしゃっているのであれば、確かに西岡氏の発言はその意味において「おバカ」ですね。

今朝のニュースで特捜部が東北の談合組織の解明に乗り出したというニュースが報じられましたが、違法献金の虚偽記載を談合組織運営の一環として見た場合、見方によっては「何の社会正義も実現していません。」とは言えない可能性もあります。
談合の必要性を認める見解もありますから。
「社会的正義」というのは言い過ぎかも知れませんが「社会的ニーズ」くらいはあると見る余地があります。
もちろん、このような見解は、政治資金規正法の規制は不合理または不当で改正されるべきだ、という主張に発展すると思いますが。

そういう御仁が、へんに肩書きと職位を得ているのが問題ではあるのですが・・・。

新聞記者にとっては本件は取材源との関係を問い直されるような利害にからむ課題なので、本件を否定的な価値判断で新聞記者が報道したとしても、新聞記者の報道を根拠として本件が利害のからめるまでもない常識の問題といえるかどうかは疑問の余地があります。
ただ、民主党の国対委員長が「本件を検討した過去はなく、検討する予定もない」と一蹴したことから、本件が少なくとも政界では非常識であることが示唆されます。
検事総長の証人喚問が不適切な手段であることは本エントリのコメントで理解しました。ただ、捜査機関の情報漏えいに民主党が異議申し立てする手段は残されるべき、とも思います。
モトケンさんに二つだけお聞きしたい事があります。まず過去、現在に東京地検とアメリカ政府機関との接点が有りますか？有ると思いますか？教えて下さい。もう一つ、アメリカが小沢を政界から排除したいと謀略を考えた時に他国でどんな方法があると思いますか？
一般に知られている以上のことは知りません。
