窃盗罪で留置中に同室者の命救う でも感謝状は出ず（asahi.com 2009年3月16日8時11分）
兵庫県警伊丹署の留置場で１月、勾留（こうりゅう）中の男がぬれたちり紙を口に詰め込んで自殺を図ったが、同室の男が懸命に手当てをしたため、一命を取り留めた。救命した男の弁護人は「善行」を表彰できないか問い合わせたが、県警は感謝状を出さなかった。
人の命を助けたのなら感謝状を出してあげればいいのにと思います。
この男性の今回の裁判の量刑云々だけではなくて、男性の今後の更生にとても役立ちそうに思えるからです。
更生に役立つとは再犯の防止であり、新たな被害者の発生防止であり、警察の仕事の軽減でもあります。
この男性がどうかはよくわかりませんが、多くの犯罪者は、他人のためになる良いことをしてそれが他人に評価されて褒められる、という経験に乏しいです。
その結果として、思いやりの欠如や自己中心性が強まって犯罪に及ぶというパターンがあるように思います。
そういう意味で、今回、この男性の行為をきちんと評価してあげれば、今後の生き方が変わるきっかけになるかも知れないなと思うのですが、兵庫県警伊丹署はそうは思わないようです。
そういえばボクも何人か救命したのに感謝状もらってないやｗ
モトケンさんの意見に賛成。 過去の罪は消えないと言うのは当然ですが、この行為は表彰に値すると思います。
信賞必罰の励行が法治国家にとって一番大事な事ではないでしょうか。
人を育てるためには、叱ることも褒めることも大事です。

いまさらながら、ビクトル・ユーゴーの”レ・ミレザブル”を読んでいるのですが、テーマは例え前科があっても人は、良い行いに接することにより変わることが出来る。です（まぁ、変われないアホウも登場するわけですけど。汗）。まさしく今回のエピソードに通じる話。
本当に懲役刑が、受刑者の更正を目的とするのなら感謝状の一枚二枚ですむのなら安いものじゃないかと....
第一、刑務所にいる人間とそうでない人間とを区別しているようで、これもちょっと気分が悪いです。

受刑者では、拘留中（字はこれでいいのでしたっけ？）の容疑者でしたね。（自分に対してトホホ）
あのー、エントリ本分にも「勾留」としっかりかかれていますし、検索結果のページを見るだけでも正解が分かるのですから、「（字はこれでいいのでしたっけ？）」と１６文字も入力する暇があったら別ウィンドウでググって下さい（涙）
あ～、これ表彰規定について新聞社にちゃんと説明していないか、新聞社があえて説明を省いているかのどちらかでしょうね。
警察表彰規定は各都道府県それぞれに存在しますが、概ね内容は似通っています。
で、規定上では、警察職員以外で人命救助や犯人検挙等に顕著な功績があった場合には、表彰を行う事になっています。
しかし、表彰対象者が表彰前に刑事事件により起訴された場合には、「表彰を行わないことがある」とされており、今回はこの規定に沿った決定を行ったのでしょう。
ただ、そこはある程度裁量の余地があるわけで、署長感謝状くらいは検討しても問題はなかったのではないかな？とも思います。
補足説明ありがとうございます。
本件で男性が救命行為をしなかったことから自殺者が死亡したということになっていたら、警察としては思いっきりまずいことになっていたはずですよね。
それに、起訴された後というのは反省のプロセスに入ったと見ることもできるのですから、その過程でこのような善行を行ったのなら、最大限評価してあげることに何の問題があるのか、と思います。

それは何故この規定があるのか？ ということです。この規定によって国民は何か利益があるのでしょうか？
いろいろ考えてみましたがどうも思いつきません。
また日本では、裁判で有罪が確定するまでは無罪のはずです。起訴された段階でいくつかの人権が制限されますが、かといって感謝状について制限を受けるのはどうなのよ？ とも思います。

の精神から表彰してあげればよいのに、と思うのですが、モトケン先生やaquila さまの書き込みを読んで、彼を表彰すると警察の責任問題も出てくるのかな、と思い、ふと「洞爺丸はなぜ沈んだか」の最後の部分を思い出しました。
函館から出港しようとした洞爺丸は沈みましたが、青森側にいた連絡船は出港を見合わせ（そのときは乗客から非難されたそうですが）結果として難を逃れました。そして、難を逃れた船長に当時の国鉄のトップ（確か総裁？）が、「君を表彰すれば、洞爺丸の船長を非難することになる。だから、国鉄としては君を表彰できない。すまん」と言うくだりが出てきます。
誰かを表彰する、ということが誰かを非難することになる、という事ならば、ゼロサムゲームとか質量不変の法則みたいでイヤですね。
男性を表彰すれば警察の留置管理の責任を問うことになる、という感覚があったのかもわかりません。
しかしここは、素直に男性に感謝すべきではないかと思います。
男性がいなければもっと厳しく責任を問われたかも知れないのですから。

法律解釈を度外しても、感謝状を贈るのは警察業務を援助したからで、贈る理由は広く国民の警察に対する理解と今後の協力を得やすくするため。という考えが根底にあるのではないでしょうか？ とすると恣意的な業務とはちょっといえないように思います。、

役所の行う「表彰（それに類するものを含む）」という行為は、善行や功労、公益増進への協力等々を表に彰（あらわ）し褒め称えることで、その行いに報いるとともに、他の模範として、今後の同種の行為の励行、さらなる公益増進に資する事を目的とするものであろうと思います。
つまり警察による外部への感謝状贈呈は、人命救助などの善行や警察活動への協力に対する褒美であるとともに、他の模範として善行や警察活動への協力等を奨励するものです。
もちろん、警察からの表彰は「警察の義務」とか「国民の権利」というべきものではないのですが、人命救助や防犯、警察協力に関する啓発業務とはいえますので、警察の本来業務の一環と評価でき、「恣意的業務」ていうのはちょっと評価を下げすぎではないかと。
確かに、本件では警察署側とすれば、監察から糾弾されてる立場なので、前例にない勾留中の被疑者への感謝状発行に腰が引けてしまった可能性はあるかもしれませんね。
弁護人の言う、感謝状があれば刑の軽減があるかもってのは良く分かりませんが、一生懸命人命救助をしたのは事実なんですから、起訴された場合、感謝状がなくても裁判で被告人の更生可能性の材料として堂々と主張すればいいように思います。
