【舞鶴・少女殺害事件】殺害経緯、動機..."空白"をどう埋める？（産経ニュース 2009.4.7 21:34）
ちょっとこの記事に突っ込みを入れてみます。
殺害に直接結びつく物証がない中、今後は公判に向け「合理的な疑いがない」程度まで状況証拠を積み重ねることができるかが焦点となる。
一般に、身柄事件（被疑者が逮捕・勾留される事件）は、勾留期間内が勝負です。
そして、勾留期間は最大２０日間です。逮捕の４８時間を入れても２２日間です。
この記事は、この最大２２日間で今後さらに「状況証拠を積み重ねることができるかが焦点となる。」ｊと言っていますが、すでに被疑者の供述を得ることなく収集可能な状況証拠はすでに集めつくしていると見るべきです。
つまり、身柄拘束期間中の捜査の焦点は、「状況証拠を積み重ね」ではなく、「自白の獲得とその裏づけ」です。
となりますと、本件の捜査は、極論すれば、すでに自供なしでも起訴が可能な程度の状況証拠の収集が終わっているか、自供獲得に起訴の成否をかけたギャンブル捜査かのどちらかです。
異例の展開を続ける捜査の先行きはまだ見えない。
被疑者の逮捕をめぐる報道のあちこちで「異例」という言葉が目に付くのですが、どこが「異例」なんでしょう？
難事件ではありますが、特に「異例」だとは思えません。
それなりの状況証拠が収集されているのであれば、捜査の基本に従った展開だと思いますし、自白頼みのギャンブル捜査だとしても、警察の発想としてそれほど珍しいパターンではありません。
しかし、防犯カメラの映像が本人であったとしても、それは「２人が一緒にいた」ことを示すに過ぎず、その後の殺害に至る経緯や動機は明らかになっていない。
状況証拠による犯行認定の考え方の一つに「近接所持」という考え方があります。
窃盗の被害日時に近接する日時場所において盗品を所持している者は窃盗犯人である蓋然性が高い→有罪認定が可能、という考え方です。
これを本件に適用しますと、
（１）殺害被害の日時場所において被疑者が被害者に接触している。（２）被害者の死因は他殺である。（３）殺害被害の日時場所において被害者に接触していたのは被疑者だけであり、他の人物が接触していた蓋然性は極めて低い。
ということになりますと、被疑者が殺害犯人だという認定が可能になります。（可能というだけで認定が慎重であるべきなのは当然です）
また、状況証拠から犯行に至る経緯や動機まで認定できるとは限りません。
特に、真の動機などは被疑者の真摯な自白なくして解明困難です。
京都府警は「冤罪（えんざい）」との疑念を抱かせるような異例の捜査手法を取り続けた。
具体的にどのような捜査手法が、冤罪との疑念を抱かせているのでしょう？
決定的な物証がないという点でしょうか？
決定的な物証がない事件は逮捕すべきでないという国民的コンセンサスがあるのであれば、本件を「異例の捜査」と言ってもいいと思いますが、私にはそのようなコンセンサスがあるようには思えません。
（※以下の渡辺修先生に関する部分は、後に追記していますように撤回します。）
弁護士の渡辺修・甲南大法科大学院教授（刑事訴訟法）は「報道などで明らかになっている証拠だけでは、有罪認定するのは難しいのではないか」と指摘。
私も、「報道などで明らかになっている証拠だけでは、有罪認定するのは難しい」と思います。
しかし、全ての証拠が報道されているわけではありませんし、逮捕の段階で有罪認定するに足る証拠がそろっている必要はありません。
「（中容疑者は）窃盗罪で服役しており、逃亡の恐れはない。科学捜査や周辺捜査をもっと積み上げ、殺人容疑がさらに固まった段階で逮捕する、というのも選択肢の一つだったのでは」と話す。
記事中の捜査幹部のコメントでも言っていますが、警察としては「科学捜査や周辺捜査」はすでにやりつくしたということだと思います。
だからこそ京都地検もゴーサインを出したのだと思います。
なお、被疑者は服役中ですから逃走の恐れはないのですが、このような場合に被疑者を逮捕・勾留するというのは、敢えて時間制限を設定して短期決戦をするという捜査側の姿勢を示すものです。
もし、逮捕・勾留しないで取り調べに入った場合、服役を利用する不当な取調べという批判を受ける可能性が生じます。

元最高検検事の土本武司・白鴎大法科大学院長（刑事学）も「裁判員制度の実施を間近に控えたこの段階で、一般常識に照らして疑念を抱かせるような捜査はすべきではない」と批判。
この土本武司氏の批判も実はよく理解できません。
どこが一般常識に照らして疑念が生じるのか？
さらに言えば、捜査という優れて専門的な行動の当否を「一般常識」に照らして判断する必然性があるのか？
土本氏は、現時点の証拠関係を把握してものを言っているのか？
などなどの突っ込みが可能です。
土本教授は「今回の事件は有罪の可能性があるなら必ず起訴し、最終的な判断を裁判官に委ねる欧米の司法スタイルによく似ている。ただ裁判員制度が始まれば、量刑が死刑もあり得るこうした事件の判断を一般市民に委ねるのは酷ではないか」と懸念を示している。
起訴時点の証拠関係がわからない現時点で「欧米の司法スタイルによく似ている。」と評価するのは時期尚早ではないでしょうか。
「ただ裁判員制度が始まれば、量刑が死刑もあり得るこうした事件の判断を一般市民に委ねるのは酷ではないか」という点は、捜査批判なのか裁判員制度批判なのかよくわかりません。
なお、このエントリでは産経の記事に突っ込みを入れましたが、本件の捜査に問題がないといっているわけではありません。
被疑者が無実である可能性は現時点では決して小さくないでしょう。
しかし、もともと客観証拠（物証など）が少ない事件というのはあるのであって、そのような事件に対する捜査はどうあるべきか、という点については事実ないし実情に即した冷静な判断が必要だと思います。
そのような分析や検討をしないで「異例」という言葉一つで批判したり（捜査の基本を踏み外しているような印象を与えようとしているように読めます）、物証がないのに逮捕したことを短絡的に批判する考え方は問題なのではないかと思うのです。
国民の多くが、徹底的な捜索をしても決定的な物証が見つからなかったら、事件がお宮入りしても仕方がない、それは警察の責任ではない、という割り切った考え方をしているのであれば、警察もギャンブルをする必要はありませんし、ギャンブルをしてはいけないと思います。
そうすると、地域住民の不安は長期間解消しないわけですが。
要するに、相反する価値観が錯綜する中で制度は作られ運用されていますので、理想的な展開などあり得ないということは忘れてはいけないと思うわけです。

ご指摘感謝（＾＾； 法律上はそのとおりです。流れで考えていたら、送検のその日のうちに勾留請求するイメージでしたので、法律上と実際問題を混同してしまいました。

本文で指摘した（１）、（２）、（３）は、当然検察官が証明すべき事項です。つまり
（３）殺害被害の日時場所において被害者に接触していたのは被疑者だけであり、他の人物が接触していた蓋然性は極めて低い。
も検察官が証明すべき事項であって、「他の者がその時間以降に被害者に接触をしたこと」については被告人・弁護人が、その可能性を反証してグレーに持ち込めば検察官の立証は失敗します。
よって、「他の者がその時間以降に被害者に接触をしたことが立証されない限り，当該被疑者を殺人犯だと認定しても構わない」という考えは、刑事裁判の立証責任は検察官にあるという原則に反する考えであり、どこの法科大学院でも教えていないはずです。
当然私も教えません。
ただし、この考え方だけで被告人を有罪にできるのはかなり極端なレアケースの場合だけだと思います。
例えば、出入り口が一つしかいない部屋に被害者一人だけがいて、その部屋に被疑者が入っていくのが目撃されて、数分後に被疑者が出てくるのが目撃されて、その後にその部屋に誰も出入りしていないことが確認できる状況において、その部屋から自殺ではあり得ない死因の被害者の死体が発見された場合には、被疑者を殺人犯人と認めることができる、というような場合です。
現在報道されている範囲の証拠では、上記の極端例ほどの確実さで被疑者を犯人と認定できる、つまり有罪判決が書けるほどの証明はできないだろうと思いますが、このエントリで私が言いたいのは、有罪判決が書ける程度ではなくても、逮捕・勾留できる程度の嫌疑はあり得るということです。具体的な証拠は明らかにされていませんので、断言するわけではありませんが。
＞kenkido 国民コンセンサスと理想論とに挟み込んで、悪いことでないと示す論法。証拠が少ないときの捜査逮捕起訴に関する法律論よりして、法的正しさ、あるいは適法性を見出すのが、専門家ではないのかしらん。
ここで問題にしているのは法律論（法律解釈論）ではありません。
逮捕要件、勾留要件については通説判例的解釈を前提にしています。
問題になるのは現時点における証拠全体の証明力が逮捕要件、勾留要件の程度に達しているかどうかです。
マスコミやコメンテイターの論調が、証明力の検討を無視して捜査を批判しているようですので、証拠如何によって批判が当たらない場合がありますよ、ということを指摘しているわけです。
＞ssuguru Law 近接所持の理論になぞらえるなら、被疑者が法益侵害の結果である遺体を持ち運んでいる状況を想定すべきではないでしょうか。
すでに述べたとおりです。
近接所持の理論で問題になるのは、「所持」ではありません。
「近接」のほうです。
A事実とB事実が近接して生じた場合に、A事実とＢ事実は関連性がある、という経験則的推論です。
さらに追記
状況証拠による認定を考える場合には、どのような状況があれば何が認定可能か？という考え方のパターンの問題（近接所持の考え方はその一つ）と、現実の事件においてそのパターンが適用できる程度に状況事実が立証できているのか？という問題は完全に別問題です。
ここでいう立証は、有無だけでなく程度も問題になります。
もう一つ留意すべきは、犯罪事実そのものを直接的に立証する場合も、犯罪事実を推認させる間接事実を立証する場合もその立証の程度は同じだということです。
状況証拠だから立証の程度は軽くていい、とか、状況証拠は立証の程度が軽くていい証拠だ、というような理解は大間違いです。
さらに言えば、間接事実から犯罪事実を推認する過程についても、立証と同程度、つまり合理的な疑いを超える程度の必然性をもって推定されなければならないと考えられます。
つまり状況証拠のよる立証というのは簡単ではないんです。
もう一つ補足すると、状況証拠による立証は一つのパターンだけでするとは限りません。というか多角的な立証が必要です。
私は近接所持の考え方を紹介しましたが、それは被疑者の嫌疑を認定する一つの考え方に過ぎないのであって、近接所持の考え方だけでは不十分な場合は他の証拠もあわせ考慮して嫌疑の濃さを考えるというのは普通のことです。
つまり、証拠の全体像を見ないと嫌疑の濃さの程度はわからないということです。
追記（小倉弁護士の批判に対する反論）
小倉秀夫弁護士が、このエントリに対して批判を述べていますので反論しておきます。
あまり建設的な議論ではないことをあらかじめお断りしておきます。
この近接所持の理論は，（ａ）窃盗犯が盗品を犯行直後に全くの第三者に売りさばくことは困難であるという経験則と，（ｂ）盗品を所持しているということは，自らが窃盗犯であるか，または窃盗犯から（直接に又は第三者を経由して）盗品の譲渡を受けたかの２通りしかなく，後者であれば盗品の所持者はその間の事情を把握しているということに支えられています。
私は窃盗罪における近接所持の理論というのは、被疑者・被告人が窃盗犯人であるという認定を導く状況証拠による認定理論だと理解しているのですが、小倉弁護士の理解は違うのかも知れません。
「（ａ）窃盗犯が盗品を犯行直後に全くの第三者に売りさばくことは困難であるという経験則」の部分ですが、被害品を第三者に売りさばくことが困難であるという認定は、所持者が窃盗犯人であるという結論を導きません。
窃盗の被害発生直後（具体的な時間は状況による）に被害品を所持している者は、被害現場以外から入手できた現実的可能性がないから窃盗犯人である、という経験則を指摘すべきでしょう。
窃盗罪における近接所持の理論は、窃盗を基礎付けるためにあるのであって、盗品譲渡行為を否定するためにあるのではありません。
占有喪失を問題にするのであれば、第三者への売りさばきだけでなく、被疑者自身による放棄も問題になります。そして被疑者自身による放棄の可能性は近接と言える時間内でもさほど困難ではありません。
被害品の占有を喪失する機会の不存在ではなく、近接している状況で現に所持しているという事実が問題になるわけです。
「（ｂ）盗品を所持しているということは，自らが窃盗犯であるか，または窃盗犯から（直接に又は第三者を経由して）盗品の譲渡を受けたかの２通りしかなく，後者であれば盗品の所持者はその間の事情を把握しているということに支えられています。 」の部分ですが、前半は概ねそのとおりでいいと思います。実際の弁解の中には、「道で拾った。」というのもありますけど。
しかし、後半つまり「後者であれば盗品の所持者はその間の事情を把握しているということに支えられています。」については、趣旨が不明です。
「後者」つまり所持者が「窃盗犯から（直接に又は第三者を経由して）盗品の譲渡を受けた」を前提にされていますので、盗品所持者を窃盗犯人と推認する根拠に関する記述ではないと読めます。
となると「支えられています。」というのは、何が何を支えているのでしょうか？
後の記述に影響するようですのでさらに付言しますと、「後者であれば盗品の所持者はその間の事情を把握している」に言うところの「その間の事情」というのはどういう事情のことなのでしょうか？
そのような所持者が把握できる事情というのは、自分が他人から盗品たる物品を譲り受けた際の事情に過ぎず、その他人がその物品をどのようにして入手したか（例えば、その他人が盗んだのか、その他人もさらに別人から入手したのか）まで把握できるという経験則はありません。
窃盗罪における近接所持の理論が適用できる場合には、窃盗の行為とともに故意も認定可能ですが、窃盗罪が認定できない場合には、盗品等譲り受け罪等の成立を認定することはできません。
次に
しかし，「被疑者が被害者と殺害行為に近接した日時場所で接触した」という事実からは上記（ａ）に相当する経験則を見出すことはできません。
についてですが、私は、本件つまり殺人罪を念頭において議論していますが、上記（ａ）は窃盗罪についての記述です。
となると、「上記（ａ）に相当する経験則」というのがどういう内容の経験則であるかが明確にされない以上、上記引用は趣旨不明としか言えません。
強いて読み替えをしますと、「被疑者が被害者と殺害行為に近接した日時場所で接触していれば，被疑者が殺人犯である」という経験則を見出すことはできません、と主張されているようですが、私もそんな経験則は見出せません。
私が、エントリを読めば分かるように、近接接触を含む（１）、（２）、（３）の３条件が全てそろった場合（and条件）における犯人性認定の可能性を述べているのです。
次にいきます。
また，「被疑者が被害者と接触した」ということからは，そのときに被疑者が被害者を殺害したか，その後に第三者が被害者を殺害したのかの２通りしかないと一応いいうるのですが，仮に後者だった場合に，「被害者と殺害行為に近接した日時場所で接触した」被疑者は，その後被害者がいつどこで誰にあったかを把握しておらず，この点について合理的な弁解を行うことはできません。
まず「その後被害者がいつどこで誰にあったかを把握しておらず，この点について合理的な弁解を行うことはできません。」の部分についてですが、そもそも犯人性を否認（犯行現場にはいなかったという否認）している被疑者について、自分がいない場面における被害者の行動についての弁解を求めることは論理的に無意味です。
もし弁解できたら弁解自体が矛盾になってしまいます。
その後被害者がいつどこで誰にあったか、について合理的な弁解を行うことができないのではなく、弁解の内容になりえないのです。
ですから、犯人性を否認している被疑者が死亡直前の被害者の行動を語れないということは、被疑者にとって有利でも不利でもない当たり前のことに過ぎません。
犯人性を否認する被疑者の弁解は、被害者の行動に関する供述ではなく、自らのアリバイの主張がメインになるはずです。
したがって，（ｂ）に相当する，合理的な弁解がないことを犯人性の補強資料とする事項がこの場合には存在していません。
もともとの（ｂ）に関する記述が趣旨不明ですから反論が難しいです。
（ｂ）というのは、合理的な弁解についての記述だったのでしょうか？
そうすると、ますます意味不明です。
「合理的な弁解がないことを犯人性の補強資料」の「補強資料」というのを「犯人性認定のための積極証拠」という意味で理解するならば、もともと、状況証拠による事実認定は（というか全ての事実認定についてですが）、「合理的な弁解がないことを犯人性の補強資料」になどしません。というかできません。小倉弁護士は黙秘権の意味をどう理解しているのでしょうか？
判決で、「被告人は合理的な弁解をしないので、被告人が犯人であると認められる。」なんて書いたら一発で破棄ですよ。黙秘権を否定することになってしまいます。
次にいきます。
「殺害被害の日時場所において被害者に接触していたのは被疑者だけ」だということが証明されれば被疑者以外の人間が殺害したことはあり得ない→被疑者が殺害したと認定できるではないかという意見もあるかもしれませんが，
上記の室内での殺人事件の例のように、論理的にはあり得る推論です。
被疑者が被害者の元を去る場面が目撃され，まさにその秒単位という意味での「直後に」被害者が殺害されていたという特殊なケースならともかく，被害者が被疑者と接触していたことが明らかにわかっている日時と殺害行為との間に分単位での間隔がある場合に，「殺害被害の日時場所において被害者に接触していたのは被疑者だけ」という立証が出来ることというのは通常考えがたいです。
これは立証の難易度の問題です。
すでに指摘していますが、近接所持の理論の適用だけで犯人性を立証するのは極めて困難で、多くの場合は不可能だろうと思います。
ただし、立証できた範囲で嫌疑が濃くなるということは言えます。
したがって，（１）殺害被害の日時場所において被疑者が被害者に接触している。（２）被害者の死因は他殺である。（３）殺害被害の日時場所において被害者に接触していたのが被疑者以外には把握されていない，との点から，被疑者を殺害犯人と認定するのは無茶苦茶であるといえるように思います。
無茶苦茶かどうかは、理論ないし考え方の問題ではなくて、現実的な立証の問題です。
防犯カメラが普及してきた現在では、近接所持の考え方だけで殺人や傷害致死を立証できる場合が現実的に想定可能です。
本件では無理だとおもいますが。
繰り返しになりますが、多くの場合は、殺人罪において近接所持の理論の適用だけで有罪判決を言い渡せる程度に証明することは不可能だろうと思われますので、結論的には同意しますが、小倉弁護士のエントリの論理についてはかなり問題があるように思われます。
この追記をアップ直前に向こうにも追記がアップされました。
矢部教授は上記のような極端事例以外でも、具体的にいえば、「本件」のような場合であっても、近接所持の理論を適用して、主観的立証責任を被疑者側に転換できると考えていたのではないかと合理的に推測できます
なぜ「合理的に推測」できるのかという理由や根拠について何も書かれていませんね。
私の明言に反して、そのように推測する根拠をお書きいただきたいと思います。

しかし、私としては「読者からの批判にたじたじ」という自覚はありません。
団藤保晴氏は、どの部分が「たじたじ」なのか具体的には何も示していません。
実名が明らかになっている弁護士のブログに対して、このような根拠のない主観的批判を加えるというのは、新聞記者としていかがなものかという気がします。
僕からみても、こういう時に出てくる専門家のコメントは、モトケンさんが言われる様に突っ込みどころ満載です。

逃げないのだから、逮捕する必要はないと思った小生はシロートです(^^;)
供述が取れなくて最終的に起訴できなかったとしても、まだ調べられるから検察には有利ですよね。 でも起訴猶予にして捜査継続とか再逮捕ってやってもいいんですか。捜査段階では一事不再理と言うことはないですよね。

被疑者が任意に取り調べに応じれば適法だとは言い得るんですけど、受刑中の被疑者を勾留して取り調べて、勾留期間経過後もさらに取り調べたということになりますと、直ちに厳格な勾留期間の定めを潜脱する違法な脱法取調べという批判を招き、それだけで任意性に疑いが生じかねません。
勾留期間経過後の取調べは、困難だと思います。
つまり、受刑中の被疑者をあえて勾留するというのは、受刑状態を利用しているという批判を回避するという意味もあります。
照らすのであれば刑事訴訟法に照らすべきであって、常識に照らすべきではないと思うのですが……。
白鴎大の法科大学院では、法律より常識を優先しろと教えているのでしょうか。恐ろしい話です。
刑事訴訟法に従って捜査を行うことは最低限必要な条件ですから、それを前提とした上で、「一般常識に照らして疑念を抱かせるような捜査はすべきではない」ということであればもっともな意見だと思います。
一般人である裁判員がかかわる裁判を考えると、法律より常識を優先しろ、ではなく法律を守った上で常識にも照らす必要があるのではないでしょうか。
刑事訴訟法及びその精神（真相の解明と被疑者・被告人の人権保障の両面が含まれます）に照らして、適法または正当な（または不当でない）捜査であるにもかかわらず、そのようなことを知らない、または理解していない「一般常識」が適法性、正当性、不当性に疑念を抱いたのであれば、その疑念は必ずしも正しくない、という指摘をすることも必要なのではないかと思います。
なお、これまでの報道を見る限り、被疑者の逮捕は違法または不当である、ということを示す積極的な理由は見当たらないように思います。
不当かも知れないという可能性はありますが、報道を見る限り、具体的な根拠が見当たらないということです。
強いて言えば、マスコミは物証がないことを強調していますが、だからといって他にそれなりの状況証拠があれば、逮捕（ないし勾留）が違法または不当になるとは限りません。
問題は、これからの取調べの状況だろうと思います。
だから本件での全面録画をお勧めしてるんですけど。
私の記憶がたしかなら、京都府警はたしか、大がかりな家宅捜索を２回やってますよね。
そして、たしかその２回目の捜索のときには、弁護士さんが「先日、大がかりな家宅捜索をしたのに、また家宅捜索するとは不自然だ。私を捜索に立ち会わせろ」と声を上げ、実際に裁判所の命令によって京都府警は弁護士さんを捜索に立ち会わせなければならなくなったはずです。
この私の記憶がたしかなら、弁護士さんや裁判官にも、京都府警の捜査が「異例の捜査」と感じられたということだと思います。
ちなみに私も、そのニュースを聞いたときには「異例の捜査では？」と感じましたし、冤罪臭さも感じてしまいました。
「決定的な物証がない事件は逮捕すべきではない」とは思いませんが。
それにしても土本教授、最近、論調が変わりましたね。以前ならこういう時、「捜査には何も問題ない」と断定的に言い切っていたのではないかと思いますが。

裁判所の命令ではなく、弁護士さんと警察が協議の末に、弁護士さんが家宅捜索に立ち会うことになったというのが正解でした。
弁護人が立会いを求めたときは、「ああ、この弁護士さん、警察による証拠の捏造を疑っているかも知れないな。」と思ったことはあります。
弁護士さんが疑っているということであって、警察の捏造を疑ったのではありません。
もしそんなことをしてそれが発覚したら、京都府警のみならず全国の警察の捜査が裁判官から決定的な不信の目で見られることになります。
言い換えれば警察組織が崩壊します。
警察がそんなリスクを犯すと考えることは非現実的です。
家宅捜索をあれだけやったのは｢異例｣という印象ですね。
でもそれ以外は特になんとも思わなかった・・・というか情報がなさ過ぎてよく分かりません。

「一般常識に照らして疑念を抱かせるような捜査」かどうかを意識する必要はあるが、「疑念を抱かせるような捜査をしない」のではなく、「説明により疑念を払拭する」でなければならないということですね。
「一般常識に照らして」が必要か不要かという点に拘りすぎて、「疑念を抱かせるような捜査をしない」の部分を軽視してしまいまったようです。
あの家宅捜索に関し、証拠の捏造が行われる可能性を感じることが「非現実的」とは私は思いませんが、警察が最初から「組織ぐるみ」で証拠を捏造することを目的に、世間の耳目を集めるような大がかりな家宅捜索をするというのは、さすがに考えにくいように私も思います。
ただ、あの大がかりな家宅捜索が第三者に疑問を抱かせてしまうのは、証拠の捏造の可能性を感じさせるかどうか以前の問題として、「警察がこの男性が犯人であることをかなり強く確信しているらしいこと」と「そのわりには、まだめぼしい証拠が見つかっていないっぽいこと」を同時に感じさせるからではないでしょうか？
たしかにあの家宅捜索からは、客観証拠をなんとしても見つけたいという警察の強い意欲は感じ取れますが、それは裏返せば、あの大がかりな家宅捜索に踏み切った時点では警察はまだめぼしい客観証拠を収集できていなかったわけで、一体何を根拠に警察はこの男性が犯人であることをそこまで強く確信したのだろうか？ という方向に私の思考は流れてしまいます。
根本的な勘違いがあるのかも知れませんが、捜索というのは、ある程度の嫌疑の存在（必ずしも「確信」のレベルに達している必要はない）を前提にして、まだ見つかっていない証拠を探すために行うものです。
ただし、家宅捜索というのは、住人の意思に反してでも家の中に入り込んで強制的に捜索を行うものですから、裁判官が捜索の必要性を認めるに足る程度の嫌疑の存在を示す証拠がすでにあることが必要です。
同じ場所を２回捜索するならば、２回目の捜索の必要性を裁判官に認めて貰う程度の証拠が必要です。
２回目の捜索が行われたということは、２回目の捜索を許可する令状を裁判官が発付したということです。
以上の説明でおわかりだと思いますが、容疑者が犯人であるという「確信」がなくても、一定の容疑の濃さがあれば捜索はなされますし、捜索することが必要だと思います。
一定の濃さの嫌疑があれば、「まだめぼしい証拠が見つかっていないっぽいこと」は捜索の必要性を感じさせる事情ではあっても、捜索を批判する理由にはなりません。
大筋、その通りだと私も思います。私の書き方が悪かったからのように思いますが、別に私は、捜査を批判などしていないんですよ。
捜索に関する報道をうけ、私が抱いた疑問（批判ではなく、あくまで疑問）は、何を根拠に警察はこの男性に執着しているのかな？ ということです。
大がかりな捜索が１回だけなら、私も別に何も疑問など抱かなかったと思います。おそらく私だけでなく、誰もがそうでしょう。しかし、２回目の捜索は一体なんだろうか？ という疑問はやはり抱いてしまいますよね。１回目の捜索では、大勢の捜査員がたかだか一軒の民家を何日もかけて調べながら、何もめぼしい証拠は出てこなかったのだろう、と普通は感じると思います。
１回調べただけでは出てこないものが２回目の捜索で出てくる（かもしれない？）と警察が考える根拠は何なのか？ そう考えるなら、１回目の捜索は一体何だったのか？ １回目の捜索ではちゃんと調べ尽くしてなかったのか？ と、？が色々浮かんできますよね。
私はただ、そういうことを言っているだけで、別に捜査を批判などしていませんが、捜査を批判しているような印象を与えてしまっているとしたら、私の書き方が悪かったということだと思います。実際、自分でコメントを読み返してみても、捜査を批判しているように受け取れるかなあ…と感じなくもないですしね。

証拠に対するさまざまな情報が有ったとしても、見解に左右されない事実であれば公表しても構わないですが、人により評価が分かれる情報は、現状のマスコミの能力を考えますと、あまり公開して欲しいとは思えません。
極端に言ってしまえば、もし起訴されたとして説明責任を果たすべきは、裁判官であると思います。
否認の被疑者の取調べをこれから開始しようという段階で、「説明責任」などと言っている方は、まぎれもなく「評論家」なんだなと思います。
もちろん、皮肉です。
この件で「警察の説明責任」を問題視する報道に接して素人ながらに疑問を感じていましたが、NO.19と20のやりとりを拝見してスッキリ腑に落ちました。
ふと思ったことを雑駁に。
１．マスコミが言う「異例」の本質は、捜査のプロセスではなく「当局がマスコミの取材に対し頑として口を開かないこと」をして“異例”と言わしめているのではないだろうか。
２．とかく「警察・検察のリーク」を問題視し、会見などで“公式に”開示される情報以外はマスコミは一切報じない方が望ましいと考える人たちがいます。
その方々は、本件のように「いったいどないなっとんじゃ？」という事件で警察が口をつぐんでしまい、あるいは捜査上「都合のいい話」だけを選りすぐって“公式に”情報を流通させることをも『望ましい事態』として賛同なさるおつもりなのか。
３．メディアを通じて流れてくる情報に関して、最終的には「その情報を受け取る側の（知的）成熟度」であるにも拘らず、「現状のマスコミの能力」などとして問題点を”他人由来”にし”善良にして無知なる大衆”の無謬を未だに護持しようとようとする御仁がおられることへの失望。
裁判員制度が否応なく始まるんですから、そういう無責任な“他人のせい”発想は一掃されないと困りますね。

弁解いたしますと、ついこうした物言いになってしまいますのは、学生時代に専門ゼミ（政治学）で投票行動などのフィールドワークをした頃より延々抱き続けている“一般人”たる“有権者・国民”の意識についての苛立ちが、私の意識の中に深く根を下ろしているからです。
なにかにつけ『政治家が悪い』『官僚が悪い』『マスコミが悪い』云々と、問題の根源を安易に外部に求めてが「悪いことを正すのはその当事者だけがやればいいこと」的に“評論”や“判定”を下して満足してしまう。いや、不満を述べるだけで終わってしまう。
そういうのが、私はとてもイヤなんです。単にラベル/レッテルを貼っておしまいにしている『思考停止』の一種に見えますから。
「どこが、どうして悪いのか」「どんなプロセスを経てその悪いことが生じるのか」「その悪いことは、どうすれば是正可能なのか」というような事も（可能な限り事実と実態に即して）考察の射程に入れておきたいのであります。
