「自転車の男」目撃者が写真で特定...舞鶴高１殺害（2009年4月9日17時26分 読売新聞）
ぼろぼろ捜査情報を漏らす府警のバカさ加減は横に置きまして、今回は蘊蓄エントリです。
このニュースの中に捜査の鉄則の一つと言うべき大事なことが書かれているのですが、みなさんおわかりでしょうか？
捜査関係者によると、目撃者は、事件当夜の昨年５月７日午前１時過ぎ、府道を車で通りかかり、小杉さんと男を見かけ、２人の年齢差を不審に思って十数キロまで減速、間近で男の顔などを見ていた。
この目撃者が目撃した人物が被疑者なのかどうかが決定的に重要であることはおわかりだと思いますが、では同一人か否かをどうやって確認するのでしょうか？
ただ単に確認すればいいというだけでなく、同一人であるという証言が得られた場合に、その証言の信用性が最大限に確保される必要があるのです。
で、どうするかと言いますと、
事件後、府警が示した複数の顔写真から中容疑者を選び、目撃した男と証言したという。
このように、複数の写真を示してその中から選び出させることが大事になります。
最悪なのは、被疑者の写真だけを示して、「あなたが目撃したのはこの男ですか？」と聞くやり方です。
この方法は、誘導尋問になってしまうのです。
信用性に乏しいあいまいな記憶の場合でも、「はい」と言ってしまう可能性があります。
ということは、「はい」と言ったとしてもその答が信頼するに足る記憶に基づくものかどうかわからなくなってしまい、疑わしきは被疑者の利益にという原則が適用される結果、信頼するに足りない記憶に基づく答である可能性が払拭されないとして、結局、信用されなくなってしまうのです。
そして、目撃者に対して、一度、このような写真一枚の提示行為がなされてしまいますと、それによって目撃者の証言の信用性は永久に失われてしまいます。
写真を見せられたという体験により、その写真の顔が犯人の顔として記憶されてしまい、事件当時の記憶と写真の記憶の区別がつかなくなってしまうからです。
最近では、写真を一枚だけ示すようなバカな警察官はいないと思いますが、テレビドラマなどでは頻繁に見られます。
それが当たり前だと思っているマスコミ関係者も多いと思います。
こういう大事件が起こりますと、警察と並行してマスコミ関係者も目撃者捜しをしているだろうと思われます。
もし不幸にして警察よりマスコミが先に目撃者を見つけてしまった場合のことを考えるとぞっとします。
先ほど書いたように、ワイドショーのレポーターが被疑者の写真を一枚だけ目撃者に突きつけて、「犯人はこの男ですよね。」などとやってしまえば、貴重な目撃者の証言の信用性が失われてしまい、その結果事件がつぶれてしまうことも現実問題としてあり得ます。
捜査情報を秘密にしなければならない理由の一つはこういうところにもあります。

サツ回りしている社会部記者には常識だと思うんですが・・・・たまにクイズ番組で扱われてたりする話ですけど、ワイドショーのリポーターやディレクターにその知識を求めるのは酷かも知れないですね。もちろん、刑事ドラマで「知識」を得ている一般視聴者にも。
とは言え、聞き込みで写真を突きつけるほどではなくても、テレビのニュースやワイドショーなんか見てれば被疑者のガンクビ写真が、あたかも真犯人であるかのごとく放映されていますから「記憶の捏造」効果が生じてしまう虞はそこにもあると思われます。

＞ 最悪なのは、被疑者の写真だけを示して、「あなたが目撃したのはこの男ですか？」と聞くやり方です。
ご存知だとは思いますが、僭越ながら補足をさせてください。
複数の写真から選ばせるだけでは不足です。そこに複数のよく似た顔を持つ人物の写真も混ぜないとダメです。
確か、富山県氷見町の冤罪事件で被害者に見せた複数の写真が、全くの別人と冤罪被害者の方の写真だった。というお粗末な捜査だったように記憶しています。
あんまり詳しく書くのもなんだなと思って省略したところはあります。
企業秘密というほどのことではないんですが（＾＾；
この事件の容疑者が、なぜ逮捕に至ったか本当に不思議です。まあ、私が得られる情報は警察が発表（リーク？）する情報だけなので、何か他の重大な証拠があるのかもしれません。この目撃証言もちょっとなぁって感じます。年齢差ってそんなに不自然でしょうか？例えば、おじいちゃんが夜遅くなったから孫を送って行くことなんて珍しいことじゃないと思います。夜遅く若い女の子を見かけて、わざわざ車を減速させて近寄ってくる車の方こそ不審車ではないかと。「その後、女の子を車に乗せて立ち去って行った」と繋げても何の違和感もないです。逮捕に至る状況証拠が「コンビニの防犯カメラ画像」だとしても、あんな不鮮明な画像で何をどうしろと。逮捕に至る証拠が知りたいですね。
何事も疑いの目で見ることも必要だと思いますが、目撃者を変質者扱いするのはいかがなものかなと思います。

最近ポリグラフという言葉をほとんど耳にしなくなりました。
このような被疑者が否認しているような事件でも、最近はポリグラフって使わないのでしょうか？
それこそ警察・検察はすこしでも多くの補強証拠を集めたいはずだと思うのですけど（?_?)
ポリグラフの結果というのは有罪立証のための証拠にはならないんです。
プラスにもマイナスにもなり得ますから、使う場面を選ぶのではないでしょうか。
エントリで引用されている記事の、
という部分ですが、率直な感想として、「ああ、この目撃者とされる人物の調書がそういう内容になっているんだろうな」と思いました。
本件の被疑者は起訴されることが濃厚だと思いますが、「深夜に車を運転中に見かけたカップルについて、年齢差があることに気づき、そして、たかだか年齢が離れている（ように見える）ということを不審に思い、わざわざ車を十数キロまで減速してまで、わざわざ男のほうの顔を確認した」というこの証言が、弁護人の反対尋問に耐えうるかというと、かなり微妙な気がしますね。
というか、検察はこんな証言を法廷に出してくるのかな？ ということから気になりますが。
私CSIというアメリカの鑑識官を主役に据えたドラマが好きなんですが､さすがにあっちはその辺ちゃんとやってますね。
面通しも仰るような複数人の中から一人を選ばせるという方法でやってます。
一応、前の方々のコメントは一通り確認してからコメントしたつもりでしたが、私の№の８のコメントは、№４キックさんのコメントと内容がかぶっていたことに気づきました。失礼しました。

№４キックさんのコメントですが、キックさんは別に目撃者の方を変質者扱いされたわけでなく、この目撃者の方が法廷に出てきたら、弁護人の反対尋問で指摘されそうなことを述べられただけのように私は読みました。
ポリグラフはあくまでも相手の協力がないとできないと思います。たしかどんな質問に対しても同じ答えをさせる（してもらう）はずです。バラエティー番組でもそんな方法だったと思います。そうだとすると装置を取り付けても答えてくれなければ手も足も出ないでしょう。

＞率直な感想として、「ああ、この目撃者とされる人物の調書がそういう内容になっているんだろうな」と思いました。
こんなシンプルな内容ではありえません。
前後の状況やなぜ同一人と判断できるのかという具体的な根拠などが詳細に聞かれているはずです。
捜査について批判的な意見を述べる人の多くは報道に表れた事情だけに基づいて批判を述べているように思われます。
匿名のコメンテイター、有名な評論家を問わずです。

なんだか精神分析と同じような感じですね。結果を判断する人間によって、わりと異なる結果が出やすいという点で。
さて今回の捜査ですが、モトケンさんがおっしゃるとおりかなり捜査は尽くされているだろうと私も思います。
その収拾された証拠では、限りなく被疑者が犯人であることを示しているのだろうが、まだなお被疑者が犯人であることに疑いをさしはさむ余地があり、犯人ではない可能性を完全に排除できない。だから逮捕して詳細な事情聴取をする。ということだろうと思います。特に目撃証言（しかも１０ヶ月以上前の事件の。さらに犯行現場を目撃したわけではない）がその証拠も中心だとすると、記憶があいまいになるなど、信憑性が問題になるでしょうし、より慎重になっているという感じを受けます。
ただ、このような精密な捜査していなかったり、無理な事情聴取をしたのちに起訴し、検察側がスッコロ負けした裁判も決して少なくないわけで、”またやらかしていないだろうな？” という疑惑を払拭できないでいます（汗）。
すべては今後の経過でそれが明らかになってくるでしょう。ようは色々な可能性がある。ということは考えておくのが良いかと思います。
まぁ、このような警察・検察に対する疑惑の声が上がるのも、過去無理な取調べや捏造を強く疑われる証拠をもとにして有罪、その後再審で無罪などの事例がが結構あり、そしてそれに対して警察・検察（さらには裁判所）が十分に反省してこなかった（ように国民には見える）ところに根本の原因があるようにも思えます。
私もそう思いますよ。
とくに検察官の調書はそうだろうと思います。
私やキックさんが指摘したようなことは、弁護人に反対尋問で突かれることは本件の検察官もわからないわけがないですから、実際の調書は、前後の状況やなぜ同一人と判断できるのかという具体的な根拠がもっと詳細に書かれているのだろうと思います。
そういう部分の供述が具体的であればあるほど、詳細であればあるほど、信用性が高いと言えるかは私にはわかりませんが。
それと、繰り返しますが、私は別に捜査を批判していませんよ。
「続・マッハの恐怖」で
「報道後に寄せられた目撃情報などあてにならない！」
という専門家がいた、という記述があり、著者の柳田氏も批判的に取り上げられていた記憶があるのですが、モトケン先生のお書きになった内容を読んで、その専門家の真意がやっとわかりました。
尤も、上記の話は函館付近の山にぶつかったＹＳ－１１が函館上空を通ったという複数の目撃証言（時間や高度などの客観的な裏付けがある証言）と、レーダー上の航跡が合わない、という流れの中での発言なので、私もちょっと乱暴な発言だとは思います。

も、怖いですよ、そりゃ。それにキックさんのコメントを「変質者扱い」とするのは、言い過ぎです。
えーと、でも仮に目撃者が変質者であったとしても、目撃証言の信頼性とは関係ないのではないですか？ 前科や日常の奇行が特定の犯罪の証拠にはならないようにね。
この問題は一般論ではありません。
特定の目撃者（まだ明らかではありませんが、起訴になればいずれ法廷で明らかになる人物です。）の名誉にかかわることです。
具体的根拠もなく「不審車」といい「その後、女の子を車に乗せて立ち去って行った」と繋げても何の違和感もないです、などと書き込むのは極めて不適切です。
＞えーと、でも仮に目撃者が変質者であったとしても、目撃証言の信頼性とは関係ないのではないですか？
そうであるならば、キックさんのコメントは本件に関して言及する必要がまったくないものです。
仮に変質者であるとするならば（そのように憶測するならば、という意味）、「その後、女の子を車に乗せて立ち去って行った」と繋げるキックさんのコメントはその目撃者こそが真犯人なのではないかという憶測を呼びかねないものですよ。
目撃者自身が被害者に対して下心があったのではないかと指摘することがどれほど目撃者の名誉を傷つけかねないものであるかについてお考えいただきたいと思います。

というモトケンさんのご指摘は了解しました。しかし、No. 5のコメントの段階でそうはっきり書いていただければベターだったと思います。そこまで説明していただかないとよく分からない私のような読者もおりますので。
それでもモトケンさんがNo.4 キックさんのコメントを「目撃者を変質者扱いするもの」と捉えられているのは、行き過ぎと感じます。恐らく「変質者」の定義が私とモトケンさんとではずれているからだと思いますが。何と言うか、若くて健康な男性だったら、若い女性に下心を抱くことがあっても（実行するかどうかはまた別ですよ！）ある意味自然でしょう…って、私、ナイーブに過ぎますか？

私は別に目撃者を犯人だとも思っていません。また、ご指摘の発言部分で目撃者が犯人だと憶測を呼ぶとも思えません。同時に、逮捕された方も犯人だとも思っていません。前半部分の

時系列として殺人事件が起きていないので、上記記述で目撃者が犯人ということではなく、一般論として述べました。
後半部分の

これは私個人が違和感を感じないというだけで、証言者＝犯人という憶測を呼ぶとも思えません。あくまで仮定の話として、もし車に乗せて連れて行ったとしても、「一緒にいた」＝「犯人」という図式も成り立たないと思います。
さらに、「そんな目撃者、本当にいたの？」という疑問もあったので、上記発言となりました。この記事は警察の正式発表ではなく、信じるに値するのかなぁ？ってことです。
