ネットを見ると、法律に違反している外国人（つまり、不法滞在者）に在留許可を認めるのはおかしい、という意見が多く見られますが、それは、在留特別許可というのは不法滞在者の在留を認めるための制度であるという点を理解していない意見です。
つまり、完全に的外れです。
従って、不法滞在者が法務大臣に対して、在留特別許可を認めるように求めることもなんら不当ではありません。
求めるにあたって、自分や周囲の状況を説明することは当然のことです。
在留特別許可を求める外国人に支援者が生じることも問題にすべきことではありません。
在留特別許可を認めるかどうかは行政裁量の問題ですので、法務大臣の判断に世論が影響することも不当とは言えませんから、外国人本人またはその支援者がさらに多くの支援・支持を求めることも不当とは思えません。
多くの支援・支持を求めるにあたって演出が行われることも必然と思われます（選挙運動を考えれば明らか）。
演出の巧拙はあると思いますが。

マネハンかどうかは、そのハンドルの使用状況、文字の類似性や読み方などを総合的に考慮して判断しています。
入管法に「在留特別許可」という制度が規定されている事それ自体への批判の矛先が、そうした規定の適用を求める人々に向けられてるという側面があるかもしれないと感じます。
本来こうした「制度（法規定）の存在への批判＝法改正の要望」は、適切な相手に適切な手法で行われるなら問題はない筈で、規定の適用を求める当事者を責め立てても結局は何も変わらない筈なのですが。何故が適用を求める当事者に矛先が向けられてしまっているように感じています。
＃念のために付記いたしますが、私はこのエントリついては、モトケン先生の仰る事について同じように感じています。
正直言いまして、実際の犯罪者を多数直接的に知っている法律家（検事や刑事弁護士）の犯罪や犯罪者に対する理解と一般市民のそれとは、かなり大きなギャップがあるように思います。
先のエントリとこのエントリは、そのギャップを少しでも埋めてみたいという意図で書いています。

このエントリで話題の父母が、「強制送還」の処分を受けたとの書込が目に付きますが、法律上は「国外退去命令」に従って自らフィリピンに向けて出国（帰国）した形になっています。これは広義の「強制退去処分」の一形態ですが、法手続上は「強制送還」とは言いません。
入管が身柄拘束して収容し、有無を言わさずに強制的に飛行機に乗せて帰国（出国）させる場合、航空会社への支払いは日本政府が立替払いして、当該出国者に求償します。しかし、不法入国や不法残留者の多くは帰国旅費を賄える資力が無く、政府からの求償に応じることが出来ないので、結果的に帰国旅費の全額が日本の国費負担となってしまう者が大多数となります。
こうした日本政府の費用負担を減らす為に、国外退去命令を受け容れて自ずからの費用負担で出国を約束した者は、強制的な身柄拘束をせずに帰国させます。この場合は帰国の飛行機便の切符を買ったり、身辺を整理して荷造りしたりする為に必要と思料される日数の猶予が与えられ、それまでは身柄拘束されることなく、多少の制限はありますが、自分のアパートやホテルでの生活ができます。
今回のフィリピン人家族の場合、3月9日の入管出頭に際し、父親を一時的に身柄拘束しましたが、その日の内に解放されたのは、上記のように両親が自らの費用負担で自発的に出国することを約束したためです。その自費帰国の申し出が確実であると入管も認めたために父親の身柄を解放し、残る娘の生活基盤の確保と中学2年生としての新しい生活体制が確立出来るまでの時間の猶予を与えたために、4月13日の出国となったものです。
この4月13日の出国を「強制送還」と表現されると法律職の者としては少々違和感を感じます。「国外退去命令に従った自費帰国」と書いて頂いた方が、法律手順としては正しい表現だと思います。またこの両親は最後まで日本の国費に負担を掛けないよう、配慮して行動した善良性については認めて良いと思います。いや善良性をある程度認めたからこそ父親の身柄拘束を解き、4月までの時間猶予を入管（日本政府）が与えたと理解すべきでしょう。
モトケンさんのエントリ本旨や、投稿欄の議論の流れとはズレた話で大変失礼しました。法手続の一つの提示解説として受け流して下さい。

用語の正確な説明、ありがとうございます。
私も違和感を感じつつ「ま、いっか。」と法律家にあらざるルーズさで書いていましたが、用語の不正確さないし厳密さを欠いていることを自覚しつつも、わかりやすさ優先で不正確な言葉を使うこともあり、ジレンマを感じることが多いです。

と言う事で、まぁ、普通に(?)密入国したからと言って「在留特別許可」がポンポンでちゃう事はないので、今回の騒動も本来、行政裁量的には何の問題もないように思えます。
が、TVのニュースなどを拝見していると"支援者"側からの不満の声、たとえば、「親子が引き裂かれてかわいそう」「娘が友達と引き裂かれるのはかわいそう」「だから、日本で一緒に暮らさせろ」ばかり目立つのは、某デモの鏡像みたいに見えなくもない私はレイシストでしょうか？
第3者的にはそんなニュースバリューのある出来事には思えません。（国民としては本エントリーに述べられた制度で保障機能はそれなりに働いていると考えています。）この一家とは直接関係していないので、第3者的な見方しかできません。
ご本人達たちには不本意かもしれませんが、この騒動で神輿のてっぺんに担ぎ出された一家には支援の声援だけでなく誹謗中傷（含む陰謀論）も集まってきちゃうのは現実としてありえます。
個人の思惑は関係者が増えるに従い、正負問わず拡散してゆくので某デモが即、日本全体が外国人排斥に至る性質のモノではないように思えます。
人間の持つ陰湿な部分が今回の騒動で陽の当たる場所にまで足を伸ばしたとでも形容できましょうか。
そういった意味で、今回の騒動は自分の中の人の善い部分といやな部分を再認識させてくれるきっかけにはなったと思います。
本エントリの趣旨から離れすぎていたらの申し分けありません。

主張内容としては鏡像（または作用反作用の法則）と見る余地はあると思いますが、国に対して文句を言っているのと、一家の生活圏に踏み込んで拡声器で強制的に聞かせるように「犯罪者をたたき出せ」とか言うのは決定的に違うと思います。
この問題は、先のエントリ関係ですね。
私個人の意見とは切り離してお読みください。

つまり、法務大臣の裁量権の乱用かどうかを争うべきところを、法律知識の欠如が原因で書き方がおかしくなっているだけ、という可能性が高いと思います。
私を含め、このBlogのコメント欄への参加者は法曹関係者だけではなと思いますので、「完全に的外れ」と切り捨てるのでなく「間違いの指摘」「正しい論点への誘導」という方向でお願いします。
むしろ、こうした意見の方にこそ、一般大衆の世論に近い感覚が含まれていそうな気がします。
まだエントリへのコメントが始まったばかりなので、有益な方向で議論が進むことを期待します。
用語に関する投稿を拝読して、ふと思った事なのですが。
退去強制手続や出国命令の規定（入管法第５章及び第５章の２）は、強制とか収容とか厳しい用語の割には、関係行政機関に対して「できる」規定が多いですよね、「ならない」規定は少ない。行政の裁量権の発動余地が一定程度それなりに織り込まれて立法されているからかと思いますけど。
なんというか、「強制退去」という言葉に対して（おそらくは）多数の人が抱くイメージ（常識と言い換えるのがいいかな。以下同じ。）と、入管法規を流し読み程度に読んでわかる「退去強制手続」のイメージに、実は結構大きなギャップがあって、そうした齟齬が話をややこしくしている側面はあるかも知れないと思ったりします。加えて、執行の問題と制度の問題を切り分けない（或いは切り分けられない）ままの議論とかも、一つの原因かも知れないように思ったりします。
この点は、入管法の出自が所謂ポツダム政令に由来する事もあって、日本的感覚より欧米的な感覚に近い構成になっているからなのでしょうか？当該法の法令番号を眺めつつ、そんな事を連想しました。
そう言えば、先日入管の収容施設を取材した報道が流れていましたが、「本国への入国手続きがクリアされるまで、一定の場所に止まって貰うが、刑罰を科しているわけではない。」という事を担当官氏が仰ってました。
＃私も主張は胸像のように感じている一人ですが、一方で主張するための行動・手法については、異質な者があると感じ取れる者の一人です。
とりあえず1点だけ
不法滞在者だから（これが理由）、在留特別許可を認めるべきではない（これが結論）
という意見は、論理的に成立しません。
在留特別許可を認めるべきではないと主張するためには、別の理由が必要です。
在留特別許可はもともと例外的措置ですから、現実的には、在留特別許可を認めるべきであると主張する側の根拠・理由に対する反論ということになると思いますが。
私は詳しくないのですが、過去の事例で、どのような理由で在留特別許可が出るのでしょうか。
明確な基準はないのかもしれませんが、ぜひ、知りたいと思っております。
明確な基準は、法務大臣の裁量権としか。
以前にAの場合に出たじゃないか？。なぜ今回は？。Bの場合は出なかった。 などなど。A法務大臣の時と、C法務大臣の時とでは異なるかもしれません。広くケースバイケースとしか。近年は出やすく成って来ているかもしれません。

法手続的には･･･以下のように理解しておかないと議論が擦れ違うばかりです。
誤った理解：不法滞在者だから、在留特別許可を認めるべきではない。
正しい理解：正規の滞在資格が無い者（不法滞在者）だからこそ、在留特別許可という法制度を設けてある。
不法滞在者だから在留特別許可を認めるべきではない、との主張は、在留特別許可の法制度そのものを認めるべきでなく廃止すべき、というロジックであるなら成立する。
だか、在留特別許可を不法滞在者には与えるべきでない、というロジックは論理的矛盾を内包している。
元々が不正規の滞在者を処遇するために、在留特別許可の法律制度が作られたことを理解して、前提に置かないとおかしな議論になってしまう。

在留特別許可は法務大臣の裁量による、例外的な制度というのはそのとおりです。
但し、今までの実務の積み重ねから、類型的にどのような場合に、どのような条件のもとで、特在許可が出るか、というようなある程度の基準はあるようです。
私自身は、このような事件を扱ったことが無いので、正確な知識ではありませんが、私の感覚では、今回のフィリピン人家族のケースは、従来の感覚では、娘を含めて特在許可が下りるかどうか、難しい事案と思っておりました。
そのため支援者も、必至になってがんばったのでしょう。
結果は、娘のみ特在許可、ということでしたが、それでも私の感覚では、「微妙な事案に関し、一定の条件の下で特在許可を認めた」事案という印象で、在留許可を求める人たちの立場からすると、「半歩前進」といったところと思っています。
逆に、外国人の日本滞在に関し、慎重・消極であるべし、と考える立場の人たちからは、本件で娘であっても特在許可が認められたことは、たいへん遺憾であるという感想を持つと思います。
それ故、本件は一つの先例として、今後参考になる事案となるでしょうし、また、本件を巡って、賛否が分かれるのもまた当然でしょう。
本件が法務大臣の裁量の範囲であることを前提としても、ニュースバリューはあると思います。

別エントリーでも書きましたが、正規のパスポート、正規の手続きで入国したのだが、その後母国が政変で政権が変わってしまった。
そのため、パスポート、ビザの更新が出来なくなり、さらに母国へ帰国すると政治思想の違いなどから投獄され、財産・生命の危険すらある。ようするに政治難民（実態は亡命なのですが。笑い）ですね。
というような場合には在留特別居が出ます。具体的にはミャンマーの政変、ちょっと古いのですが国民党っを支持し、日本に残留することを選択した中国人がこれに当たります。まぁ、後者は戦争責任の意味合いが強いのですけど。
また不法に入国したとしても、日本人と恋に落ち結婚状態になり子供までいる。というようなときにも出ることがあるのかもしれません。もちろん、偽装結婚の可能性など審査は厳重のようです。
そもそも国境だとか国だとか言うものは、人間の都合で存在するもので、日本人が思っている以上に流動的であり普遍的なものではありません。また個人の意思が及ばないものです。
そのためにも、このような特例を設けておかないと、非人道国家と諸外国から非難されることにもなりかねません。
もう一つ、皆様の参考に。
在留特別許可は有期限（最短の場合数日間、長くても３年程度、ケースバイケース）です。期限が来たら許可を更新してもらうか、国外退去しなければなりません。
在留特別許可は永住の許可ではありません。

この部分がスッキリしないというか。上記内容自体に異存はありません。正論だと思います。その上で、この一家があくまで私人かと言う所に違和感を覚えてしまうので

国(制度）に対してデモ（広義のデモンストレーション）を行う事に対する反作用の焦点としてこの運動の"象徴"たる一家に文句(某デモの場合は誹謗中傷の(言葉の暴力）レベルですけど、まだ実力行使にはいたっていませんよね。）の矛先が向けられる可能性は充分に予見できると思いました。
実際、支援団体とデモ側で一部衝突したらしき情報(映像など）からすると、これは一家がどうするこうするという問題ではなくなっちゃっている様に思えます。
とすると、今回の行為は、（仮定のハナシです。）支援者側が法務省の係官(それとも法務大臣か？）の自宅周辺でデモを行い「特別在留許可を出せ！」罵声を浴びせるのと同じくらいマズイことだなとも思います。
「なんでこんな騒ぎになっちゃんたんだろう？」と言うのが私個人の感想であるとともに、カルデロン一家もそう思ってるように想像してしまいます。(まことに勝手ではありますが、）
某デモ、やりすぎ、個人攻撃、私刑まがいの行為は悪質。
これはもう「考えナシ」「その場のノリ」みたいで、行動自体が破綻しているように思えます。
そして、このデモとは無関係に（結果として）一家は国(日本）の判断に従い帰国と言うように受け取りました。

私はよく理解できないままに「出国」と言っていましたが、結果として間違っていなかったようでホッとしました。
普通、強制送還って入管の施設に収容されて、飛行機にのせられる、という記憶があり、それとは違うなぁ、という漠然とした印象がありましたが、調べてみたらこんなのを見つけました。

そうです。そういう形で本文あるいはコメントの初期段階で論点を整理しておかないと、法曹関係者以外の一般人は誤った理解に基づいて議論を展開してしまいます。
他の方も、裁量権の事例などのデータベースを示していただき有り難うございます。
仕事中なんで、ご紹介いただいたデータベースもまだ見てませんし、今もってきちんと考えたわけではないのですが、一応何も事前勉強していない一般人の感覚の一例としてコメントしておきます。
在留特別許可に限らず、法令運用の基準には一貫性が必要だと思います（誤りの修正すら認めない前例至上主義は困りますが）。また、情緒に流されない運用を望みたいところです。
その意味では、今回の「娘さんだけ特別在留許可」という運用は、あまり良い結果ではなかったのでははないかと思います。
確か、前エントリーのコメントの中に「法務大臣が両親の再入国について配慮する」とコメントしたとかいうのを見かけた気がしますが、「不法入国してとにかく子供を作る→子供がある程度大きくなるまでバレなければ、子供だけ特別在留許可→両親の再入国に配慮してもらえる」と取られかねない前例を作ることになってしまう気がします。
せめて、一家揃っていったん国外強制退去処分とし、その後改めて一家揃っての適法に再入国していただいた方が、流れとしては「マシ」だったような気がするのですが。
ところで、一家揃って国外強制退去処分になっていたとしたら、再入国の際の審査は通常よりも厳しくなるのでしょうか。
事実誤認等ありましたらご指摘ください。
例えて言えばこんな感じです。
今回の「特別在留許可」、用語通りの意味でなく、情緒に流された「特別特別在留許可」になってしまっていませんか？
という淡い疑問を抱いている、というところです。
法務大臣の両親の再入国について配慮するというコメントは
「ご両親も本来なら（退去強制処分で）５年間は再入国できないが、柔軟に、１年ぐらい、それを待たずしても一時的な上陸特別許可を出すこともやぶさかではない」
といったものだったはずです。あくまでも一時的な上陸許可であり、就労ビザが発行されるわけではありません。配慮の法的根拠はよくわかりませんが、それぐらいなら認めてもいいのではないかと思います。
まぁ、親が日本に会いに来る特別許可を出さなくても、子供がフィリピンに会いに行くことはできるんじゃないか？とも思わなくもないのですが。
○両親の一時的な入国の許可については、今回両親が送還ではなくて帰国に応じたという形で決着した事で、入管法第５条第１項第９号ニの規定を適用する事になると予想します。何の保障もありませんが。
○子供さんが親御さんに会いに行くなら、出国前に入管法の規定による再入国の許可を受けておけば、在留特別許可によって認められた在留資格の範囲内において再び入国する事は何の問題ありません。
○なお、再入国の許可手続きは、特別在留許可とは別の問題として、全ての在留外国人に対する一般的・原則的な手続きです。

以下は報道記事やネットで得た情報から推測した経緯で、
正確な証拠や資料に基づいて解説しているのでは無く、
私の憶測を交えての解説であることをお断りしておきます。

最初はフローチャート図の最上部にある「入国警備官の違反調査」のところです。
まずここで、右端の「容疑あり」→「収容」から出発です。（H18年）この収容に対して「仮放免」の申立がされ認められましたが、同同年11月には右端の「強制退去令書発布」、すなわち強制退去処分が下っています。その行政処分に対して取り消しを求めて裁判などを行い、その裁判の進行中は仮放免が延長される形で、この春まで２年余りの期間、埼玉県で家族3人で普通に社会生活が出来たのです。
最終的に裁判では負けが決まり、延長に延長を重ねていた仮放免状態のままで今年の3月9日の出頭日（仮放免の期限日）を迎え、父親が収容拘束されました。ただし退去強制命令を受け容れての自費帰国の意向を申し出たため、父親の拘束をその日の内に解く再度の仮放免となりました。その翌週の3月16日に法務大臣は、中学生の娘は右から2番目の「在留特別許可」を正式に決定し、同時に両親には出国期限日を1改めた「退去強制令書発布」となりました。すなわち右端の２つの結論です。
ただしこの両親に発布された「退去強制令書」では、出国期限日を発布日の１月後（4月16日までの出国＝実際の出国日は4月13日）としており、同時にその期限内は仮放免が認められ、日本に残る娘と一緒に生活することが許されたのです。これが私が№５で「国外退去命令に従った自費帰国」と持って回った書き方をした所以です。

このように「退去強制命令での自費帰国」ですので、両親の日本への再入国は、法律上は原則として5年間許可になりません。ですが法相は3月6日の記者会見で、『1年程度経過すれば、娘に会う目的での両親の日本への再入国申請を認めるのも吝かではない』と発言しております。この法相発言の1年経過というのは、チャート図の左端の「出国命令書交付」での帰国の場合、法令上は再入国の禁止期間が1年間であることを念頭に置いた発言と思われます。
また私の解説中に何度も出て来る「仮放免」という措置は、刑期満了前の仮釈放や、拘置所からの保釈などと同じように、守るべき条件が付されています。それに違反した場合（例えば許可された居所から勝手に引っ越した場合など）には、仮放免が取り消され、チャート図の「収容」の流れに戻ってしまいます。
以上のように法実務の面では、法務省は不法入国の両親は強制退去（退去強制令書発布）の原則を守りつつ、裁判などが確定するまでの期間は仮放免とし、最終的に日本生まれの娘にだけは在留特別許可を出した形です。
今回の娘は両親が監護養育しておりましたが、不法入国者の男女間に生まれた日本国籍を持たない子で、両親ともに逃亡出国してしまい、日本国内に捨て置かれる誠に不幸な子も相当数居ります。当然この子らは日本の施設に保護されて養育せざるを得ず、法務大臣より在留特別許可を得ることになります。そうした事例とのバランスも考えると、娘に在留特別許可を与えることは公平の原則の範囲内にあると思えます。
いろいろな意味で、今回は法務省と法務大臣、帰国する両親と日本に残る娘、そして手続を行った弁護士など、それぞれが知恵と涙を絞って導き出した結論だと感じます。
これだけ複雑な案件を処理した関係者の努力と苦悩と決断に、法律の実務家の端くれとして敬意を表します。
そうなのですよね、No.27 の第一段落であの様に書いたものの、No.28 で法務業の末席様の仰る経過を辿ったのも事実なんですよね。
入国拒否は「入国拒否できる」規定でなくて、「入国できない」規定なので、実際親御さんが訪日の意向を示された場合に、法令上どう扱われるのかは第三者としては気にはなります。
おそらく、特別上陸許可の審査に要する期間として、仮上陸の許可でしか方法が無いと思いますが。

さて、それはどうでしょうか。
もし№28の論理的な説明が無かったとしたら、「一家支援派」の世論と「強制退去処分強硬派（原理主義者？）」の世論の中間を取った玉虫色の決着かもしれない、という疑念は晴れなかったかもしれません。
それとは別に、両親の再入国に関する法相の発言に関する解説について確認ですが、途中ルートに関わりなく、チャート図左端の「出国命令書交付」による再入国禁止期間は1年間なのですね？
それだと特段の「配慮」は不要ですね。とりあえず再入国に関する法相発言についても、「期間」に関してはとりあえず問題ないですね。保証金の問題（№30）があるそうですが、それは法相発言とは関係なさそうだし。
ああ、あと№31のomizoさんによれば、今回の特別在留許可は期間1年ということですが、つまり1年ごとに延長ということですか。確か、今回の娘さんの特別在留許可の際に「13歳の中学生である」ということが相当クローズアップされていましたが、16歳の節目を迎える前に中学校卒業ということで、その時点で何か取り扱いが変わったりしますかね。関係ないかな…？

そうすると、このような「配慮」が「法相の裁量権の乱用」にあたるかどうか、

私の感覚も、№25無印粗品さんの「あくまでも一時的な上陸許可であり、就労ビザが発行されるわけではありません。…それぐらいなら認めてもいいのではないか」と同じくらいの感じなんですが、「他の退去強制令を受けた人との整合性・一貫性はどうするんだ」と言われると返す言葉が無いな。大丈夫ですかね。
それから、特別在留許可の期限（1年後）にちゃんと更新できるのかどうか、1年後はまだ14歳中学2年生だから更新できそうな気がするけど中学卒業を迎える2年後はどうなのか、さらにその先は…？
母国語が話せないのが本当かどうか知りませんが、少なくとも母国を見たことがないのは間違いないわけです。いくら両親の母国とはいえ、まったく知らない国なのだから、帰国に対しては「恐怖感」を感じるでしょう。ただ、いずれ本国に帰らねばならないのだとしたら、少しでも早めの方が良かったんじゃないか、という気がしないでもないです。

出国命令制度
出国命令制度とは
（１）不法残留（オーバーステイ）等をしている外国人は，入国管理局に身柄を収容の上，手続がとられ，日本から強制送還されることになっています。また，強制送還後，５年間5年間、事情によっては１０年間(過去に、強制送還、出国命令等を受けたことが無い場合)は日本に入国することはできません。
（２）しかし，不法残留している外国人が，帰国を希望して自ら入国管理局に出頭した場合は，下記２の要件を満たす条件に，出国命令という制度により，入国管理局に収容されることなく出国することができます。出国命令により出国したときは，日本に入国できない期間も１年間となります。
出国命令の条件
① 出国の意思をもって自ら入国管理官署に出頭したものであること
② 不法残留以外の退去強制事由に該当しないこと
③ 窃盗罪等の一定の罪により懲役又は禁錮に処せられたものでないこと
④ 過去に退去強制されたこと又は出国命令を受けて出国したことがないこと
⑤ 速やかに本邦から出国することが確実と見込まれること
、①については、出国の意思があったとしても警察や入管などに逮捕又は摘発されて退去強制となった場合には、自らの意思ではないので適用されません。また、②の不法残留とは、正規の在留資格を持っていた外国人が在留期限後も更新の手続きなどをすることなく、日本に滞在し続けることを言います。そのため、偽造のパスポートで入国した場合などには不法入国（不法在留罪）となり、出国命令制度の対象とはなりません（不法在留罪も不法残留罪も刑罰は同じ）。
自費で出国が出きる事、不法残留である事、証明書類が整っている事。 摘発された場合でない事、積極的に証明できる事。

「在留資格認定証明書」とは何ですか。
外国人が日本に上陸する時は，到着した空港等で上陸許可の申請を行ない，入国審査官の審査を受けて上陸許可を受けなければなりません。
この申請では
ア 旅券や査証が有効であること
イ 日本で行おうとする活動が虚偽のものでなく，かつ，在留資格に該当すること。また，在留資格により上陸許可基準が設けられている場合にはこの基準にも適合していること

エ 上陸拒否事由に該当していないこと
を自ら立証することとされています。
「在留資格認定証明書」とは，日本に上陸希望する外国人について，申請に基づき，法務大臣が上陸のための条件のうちイについて，適合していることを証明するもので，この証明書を上陸申請の際に提出することで上陸審査がスム－ズに行われることになります。
この証明書の交付は，就職予定先の雇用主や日本人配偶者など，日本にいる関係者が最寄りの地方入国管理局などで，本人に代って申請することができます。
なお，在留資格「短期滞在」については，この制度の対象とはなっていません。
お嬢さんの 在留資格の期間が1年ですので、更新いたします。いつまで更新可能かは、不明です。

断定なさっている訳ではないと思いますが、私の個人的な考えとしては、そのようなお考えには賛同できません。
娘さんは日本国籍は有してはいませんが、ご両親のどのような事情・思惑であれ、日本の地で生を授かり、日本人と同じ教育を受けてきたわけです。（このような日本のシステムにも賛否両論あるかもしれません。そのことは置いときまして）
娘さんの立場に立って考えた時、「母国へ帰る」という心境にはとてもならないんじゃないでしょうか。
娘さんの母国は日本ではないでしょうか。ただ単に国籍が違うというだけの話です。
娘さんの在留特別許可の今後を政府がどのように判断していくのか分りませんが、人道的にも娘さんご本人が望む限りは、更新を繰り返して貰いたいと思います。
（何処かに娘さんは帰化したい希望があるようなコメントを見かけた気がしたような、違ったかな・・。）

ただ、彼女の特別在留許可がいつまで更新できる性質のものなのか。「いずれ本国に帰らねばならないのだとしたら」、例えば中学卒業時には更新できなくなりますよ～、という性質のものなのだとしたら、むしろ少しでも早い方が良かったのでは、ということです。
私には答えが分からないのですが、法務省の役人さんたちには答えが分かっているんじゃないかな、と思ったのです。
本人や両親は、私と同じで答えが分からないのですから、「更新できる」ことを信じて日本に残る選択をしたのでしょう。
私の場合は「生まれたときから」でも「母国語が話せなかった」わけでもありませんが、小学校の頃に数年間海外に住んだだけで、帰国後苦労しました。彼女の場合はもっと順応に苦労する条件なわけで、いずれ帰らねばならないのなら、順応性の高い少しでも若いうちの方が良いです。帰らずにすむなら、それに越したことはないですが…。

で、当該仮上陸の許可の規定によれば、保証金は「本邦通貨又は外国通貨で納付」とあり、金額は「○○万円以下」ですし、更に「できる」規定ですから、法務大臣の裁量の余地がありそうですし。何とかなるかも知れないですね。

貴方は、今回のフィリピン家族のニュース報道を、少なくとも法相談話があった3月6日頃からキチンと辿って居られるのでしょうか。このモトケンブログを含むネットで話題が盛り上がってきてから、ウロ覚えのご自分の記憶と、投稿欄で飛び交っている怪しげな話に頼ってコメントしていませんか？
まず3月6日の法相のコメントの報道記事を、ググッていくつかお読みになると良いと思います。法相の言う「両親の入国」とは、日本に数年間居住できる在留の許可を含む入国ではなく、あくまでも未成年の親として娘と再会し、将来の進路などの相談や学校の手続、特別在留許可の更新手続の手助けなど、必要最小限の入国は考慮せざるを得ない、というニュアンスです。
私なりに憶測を入れて解説すれば、他の方も解説していますが、娘への今回の在留特別許可の期間は1年間です。中学卒業まで残り2年ですので、少なくとも1年後には改めて入管（法務省）に特別許可の更新を申請することになると思います。この1年後の段階で、やはり親子離ればなれに暮らすのは辛いし、言語や風習などの問題もあるが娘をフィリピンに引き取るかどうか、親として、家族として話し合う機会が必要になるかもしれません。
しかも日本に残る娘は14歳の未成年なんですから、学校の手続にしろ銀行口座の開設にしろ、原則として親権者と連名でなければ法的な手続は出来ません。しかし両親は、退去強制令を受けていますので5年間は入国できません。また娘の方は、一時的にフィリピンに行って親と相談しようにも、日本の再入国許可の問題（№31参照）があります。
そこで残る方法は何か、と法務省＆法相サイドが苦悩して見つけ出した方策が、№30で私が披瀝した手法ではなかろうかと推測、いや勝手に想像しています。
この特別上陸許可の審査に要する期間としての仮上陸というのは、例えば某国に行く為に飛行機の乗り継ぎの必要で日本の空港に降り立ったが、何らかの事情で乗り継ぎが不可能になって目的の某国にも行けず、かといって別の事情で母国に戻ることも出来なくなり（例えば母国で戦争が勃発したなど）、日本の空港で立ち往生した場合などに使われます。つまり立ち往生した外国人は、乗り継ぎ便が再開されるか母国に帰国できるまで日本のホテルなどで過ごしたくても、日本の入国滞在の資格許可を得ていない（イミグレーションを通らない空港内での乗り継ぎ＝トランジットは日本への入国となりません）のでイミグレーションを通れません。すなわち入国できません。
だけど飛行機便の再開がいつになるか目処が立たないとか、数ヶ月以上も掛かるのが明白のような場合、空港内のトランジット待合室（ここは日本の空港内であっても「国外」という扱いになります）のベンチで生活しつづける訳にもいきません（最近そんな空港生活を題材にした映画も作られましたが･･･）。そこで日本に入国出来るように法務省（入管）に特別上陸の許可を申請をすることになりますが、この特別入国許可の審査にまた日数が必要です。その審査期間の間、日本人の身元保証や保証金を差し出すことを条件に、臨時の仮上陸が許されることがあります。
この仮上陸の許可は沢山の制限条件、例えば指定されたホテルと大使館や入管など以外立ち回ることは禁止とか、或いは数日ごとに入管に出頭して現状報告しろとか、非常に細々とかつ厳しい条件が付くのが普通です。この条件に違反した場合は直ちに身柄拘束されての退去強制手続きに移行し、保証金からその出国の飛行機代などの費用に使われます。
また数日から十数日の仮上陸が許されたからといって、必ず数ヶ月とか１年以上の在留資格を認める特別上陸許可が約束される訳でもありません。仮上陸は、あくまでも審査に要する期間を、日本国内のホテルや保証人の家などで人間らしく過ごせるように配慮する、人道的な目的での制度です。特別上陸許可の可否について審査するのは法務省の役目ですし、審査を土日返上の突貫徹夜作業で一両日で済まして2日目に国外退去とするか、それとも丁寧に時間を掛けて1ヵ月かけての審査となって、結果的に1ヵ月間日本の国内に居られるか、それは法務省しだいで、しかもケースバイケースです。
決して法相は「１年後には両親とも親子３人で暮らせるように特別計らいします」と明確には言っておりません。ここは皆様もよく確かめた上でコメントされるよう希望します。
なお、言うまでも無いことですが、上記の仮上陸の手法を使いかもしれないとの解説コメントは、私の勝手な憶測であって、完全に的外れの可能性も多分にあります。また私自身も入管実務や在留許可の申請などは直接仕事として扱ったことがありません。今回の解説も外国人登録業務を行っている行政書士の知人に教えて貰ったことに、自分なりに法律職としての経験から憶測を足して解説しています。
そして解説はしますが、今回の措置について法律職の端くれとして、また子を持つ親の一人として、良いとも悪いとも評価したくありません。ただ非常に関係者が苦悩した結果、4月13日の成田空港での涙の別離となったものと、この家族の悲哀に同情を禁じ得ないことは確かです。ただ外から見るだけの者として、軽々に感情に任せた発言は控えようと思っています。こうした私のスタンスには、改めて皆様よりご理解を頂きたく思います。

これを見て初めて気付いたのですが、もともとご両親のパスポートは他人名義だったのですよね。いくら本邦の法相が配慮しても、その前にまず本国できちんとパスポートを取得していただく必要がある、ということなのですね。

初めまして。
一般予防の見地からは、今回のケースで在留特別許可を下すことに問題は生じるでしょうか。
私は、長期・平穏・未成年の子供の存在、といった要件のもとで許可を広く認めるべきだと考えています。
他方、入管行政は今後も退去強制を原則とする運用でよいと考えています。
すると、長年暮らすまでも無く退去に至るリスクの方がよほど高いわけで、不法入国をそこまで助長することにはならないと考えています。
私は入管行政に関与したことがないので不法入国者のメンタリティがよくわからないのですが、
許可要件が多少緩くなったぐらいで不法入国への動機付けが相当強まるものなのでしょうか。
また、今後増えたところで、入管行政に破綻をきたすほどの量になってしまうのでしょうか。
不法入国と言っても、色々方法が有りますので、なんとも。メンタリティも色々で。
多くは、正規の旅券で、短期滞在資格（観光資格）で、入国される方の方が多いとおもわれます。 これですと、期間が過ぎますと不法残留に成る事に。
在留特別許可を申請するのに、事務的手続きをされる方の人数も（申請書面も膨大に必要ですから）、それほど多くなく2年近く掛かる様に成っているようです。 その間は。拘束になったりしておりますから、あまりわりに合わないかもしれません。 ポンポン出るわけでも無いですし、本当にまれなケースと言えます。 ケースバイケースで、同じケースと言うのは無いのですよね。 今回のケースで、法務大臣の裁決で在留資格が出たと言って、同じケースが無い以上、よく似たケースで出される保障など無いのですよね。
この辺を、誤解なき様に正確に伝える必要は有りますね。
犯罪目的で入国してくる不良外国人は別として、日本に不法滞在覚悟で出稼ぎに来る人の多くは好きこのんで言葉が通じない日本に来ているのではないと思います。
不法滞在の動機付けに最も影響するのは、不法滞在者の本国と日本の経済情勢ではないかと思います。
この点については研究があると思いますが、探すヒマがありません。
移民、移住、出稼ぎ に関連する経済状況でしたら、1886年から1978年ごろまでの日本の状況をお調べになられると、概要的な事には成るとも思われます。 ハワイ経由での米国本国への移動など。中南米、南米への移動も参考になると思われます。

当エントリのハテナブックマークにおいて、入管実務に練達されておられる弁護士のisikeriasobi先生より、下記のようなお叱りのコメントを頂戴致しました。
これは私の当エントリ投稿№5における『法手続上は「強制送還」とは言いません』を指して、専門家として苦言を呈されたものと拝察致します。私としては今回の帰国騒動が、法的な『国外退去令を受けての自費帰国』であって、手錠姿の不法入国者が官警によって力づくで帰国の飛行機便に乗せられる、映画やTVドラマなどでの所謂「強制送還」のシーンを連想される方が居るようだが、それはイメージとしてちょと違うということを指摘したかった為です。また「強制送還」という漢字４文字の用語は、正しい用語ではないことを強調する意味もあって、『法手続上は「強制送還」とは言いません』との表現をいたしました。
こうした私のコメントが、入管手続や在留許可手続などを多数手掛けられておられる弁護士の方々に、誤った法知識を振り回して世間に要らざる誤解を蔓延させることで、好ましいことではないとの懸念を与えたとしたら、自らの不勉強と言葉の至らなさをお詫びするばかりです。加えて、今回のフィリピン人家族の帰国騒動について、私を含めて皆様に正しい法手続について解説を賜れば、このモトケンブログでの議論の混乱整理することに繋がり、また正しい入管法制度の知識の世間への啓蒙にも役立ち、大変有意義なことではなかろうかと思う次第です。
取り敢えず、私のこのエントリにおける解説コメントが、知人の行政書士に聞いて教えて貰った内容に、私自身の不確かな知識と憶測を重ねたものであって、入管手続や在留資格などでご高名の弁護士の方より不正確であるとのご指摘を頂いたことは皆様に明示し、当エントリならびにモトケンブログにお立ち寄りの皆様が誤読や誤解をなされぬよう、ご注意喚起とお詫びを申し上げます。

と読めてしまうのですよね。で、それはそうと決まった話でもないんじゃないの？ と、ナイーブな土星人は思う訳です。土星人といえども予言者ではありませんので未来のことはわかりませんがね。
謝罪しまくりの者が言うのもなんですが、ここで、かくかたのご意見が終わってしまうのも、もったいないような感を受けます。
