「本を壊すな」図書館動く 切り抜き被害にマナー本配布（asahi.com 2009年4月26日8時13分）
全国一の貸出冊数をほこる大阪市立中央図書館（西区）で、年間２千冊近い本や雑誌が、借り主に切り抜かれたり破られたりして廃棄されている。ファッション雑誌の人気モデルの欄や韓流スターのページがまるごと切り取られるなど、えげつない。たまりかねた図書館は２５日、本を壊さないよう呼びかけるマナーブックの配布を始めた。
図書館の本の切り抜き行為は、立派な犯罪です。
器物損壊罪です。
読書の秘密を守るため貸し出し記録は返却時に消去するので、犯人の追跡もできない。
ばかですか。
東京都練馬区立図書館では０８年１月、貸し出し履歴を一定期間に限り参照できるシステムを導入している。
返却された本を点検し終えるまでが貸し出し管理だと考えれば、全件点検が可能かどうかにかかわらず、部分点検であれ点検に必要な期間は借出人情報を保存して、切り抜きが見つかれば片っ端から告訴するくらいのことはしないと状況の改善はできないと思います。
都市部を中心に汚破損本は増えているが、同図書館で窓口に立つ女性は「同じ俳優の写真が根こそぎなくなるなど、度の過ぎた被害はよそでは聞いたことがない」という。
大阪の悪名がまた一つ増えました。
でも大阪人は、あんまり恥ずかしいとは思っていないかも知れません。
最後の一文は少し悪戯ですね。
何か大阪に嫌な思い出でもあるのですか。
記事のような切り抜きの事例に対して、マナーブックの配布に効果があるとは全く思えません。形だけ対策をしましたという自己満足に過ぎないのではないでしょうか。
「切り抜きは犯罪です。返却時にチェックして見つけた場合には、弁償請求の他に刑事告訴することがあります。」ぐらいを書かないと効果は期待できないでしょうね。具体例（このような破損の場合はどの程度の刑罰）を書いておくともっと脅しがきくかもしれません。
ところで、毎回全ページチェックすることは作業量的に難しいと思いますが、切り抜きを発見して指摘したときに、「私が借りた時はもう破れていた」と言い逃れをされた場合、犯人を特定することは難しいのではないでしょうか。もしくは、自分で切り抜いておきながら、「私が借りたらもう切り抜かれていた」と告げながら返却して、前に借りた人に責任をおっ被せる場合なども考えられると思います。まぁこんな手は、同じ人が繰り返し行ったら、流石に怪しんで警戒するようになると思いますけどね。

だと思います。大体、言われないと気が付かない奴や確信犯などは、言われても行いを改めることができないアホな奴が多いです。きれいで、閲覧コーナーも広い図書館なのでよく利用します。ただ、本に書き込みがあったりすることも多く、腹が立つこともあります。どうしても欲しいものなら私は買いますが、公共の本でも切り取って良い、と思っているような人間には
私は、恥ずかしいと思っておりますが、実は私も（ここのブログで）ダメダメな大阪人の一人と思われているかも・・・(＾＾；
行政統計では、残念ながら図書館の文献毀損は都道府県では大阪府、市町村では大阪市がワーストのトップレベルです。ただし、これは統計をとっている一定規模以上の図書館に限られます。
ちなみに１０年平均統計を見るとお国柄が現れ、離婚率トップと喫煙率トップは北海道、交通三悪トップは愛知県、鉄道事故ゼロは沖縄県（当り前(^^ゞポリポリ）とさまざまです。
大阪だけが数値が悪いわけじゃないですよ。(＾▽＾)/

で、釣りついでにもう一言書きましょうか。
「名前（必須。ハンドル可）」というローカルルールを無視して、ステハンも使わないあなたは、ばれなきゃいいや、と思って雑誌に切り抜きする大阪人さんですか？
まず第一歩としては
しか無いように思います。
まさか、全ページラミネート加工、なんて出来ませんし、マナーブックの配布なんて、現状ではお金（税金）をドブに捨てるようなものです。
最も恥ずかしがるべき人達は、大阪市長及び大阪市職員だと思いました。
刑事告訴、民事訴訟を行ってでも、守るべきもの（物体としての本のみならなず、維持すべき社会ルールも含め）は、守るべきと思います。
職員として働いていて楽なのは、「自分の担当中に、問題化となることを避ける。自ら、問題を作り出すようなバカな行為はしない。」であります。その典型を実行し、結果が表面化しただけの話。それでもなお、刑事告訴、民事訴訟ではなく、マナーブックの配布なんて、事なかれ主義で対応しようとしているように思えます。
大阪市には、地方交付税を公布しないで欲しいとさえ思います。ごく一部の人が、どうしようもないだけなのに、効果ある対策を講じないことは、怠慢としか思えません。結果として、No.3 通行人１（被医療者） さん のような方々にも迷惑が行くし、大阪マナーが日本中に広がっては、悲しいことです。
対策案として、レンタカー借用前後にやるキズ等有無の確認はどうかなと思いました。
いい加減な儀式にも見えますが、そこそこのプレッシャーにはなると思います。危なそうな本だけでもいいかも知れません。
納税者の一人です。 涙出てきます。
仰るとおりです。 恥だと思うなら出来ません。
後世の研究者の資料的価値も有ります。納税者の財産でもありますし、そしてその資料を必要とする者の財産でもあります。図書館は１個人の利益のために存在するわけでも有りません。
オ・マ・エ・は・ア・ホ・か。 で済ませられる事柄では、有りません。
の処置が出てきても、反論を出来る事は出来ないでしょう。

公共の財産である本を切り抜く（私は昔、自分の絵本を切り抜いたときにも親からひどく叱られました）行為はモトケン先生の仰るですから、切り抜いた本に残っている指紋から、犯人を特定するための捜査ができそうにも思います。
、性善説を信じる段階はとうに過ぎていますよ、図書館職員の皆様。図書館も「読書の秘密」なんて寝ぼけたことを言わずに、告訴したり損害を弁償させることは検討、否 実行して欲しいと思います。

マナーとかモラルの問題にすると、「借りた本を切り抜く事を何とも思わない人」に対処できないのですよね。「マナーは人によって考え方が異なる」という事を理解した方がいいと思います。
ただ、貸出禁止というのもどれだけ効果があるのか疑問な所はあります。館内で切り抜いている人もいると思います。
同様の例は諸外国でも問題になっていると思いますが、どのような対処を行っているのでしょうね。
私の母校（大学）の図書館では、解剖学の本の「女性生殖器」のページが破りとられていたものですよ。（ずいぶん昔の話ですが・・・）

確かに、国立国会図書館の蔵書のある書籍の一部分が切り取られていましたので、０には出来ません。 が、貸出禁止にすれば、抑止には成ります。 安気な気持ちではしづらいですから。 費用対効果も参考にしなければ成りません、限りなく０に近づけるための予算、労力より、その予算で蔵書を増やしていただきたいです。 盗難なんてもっと防止しづらいですし。 民営化されても良いのですか？、利用コストは格段に上がると思われます。
わりをくうのは、共有制を遵守している側では、ありますが。 ですので、余計に腹立ちます。
器物破損の現状は何とかしないといけないのですが、
公共の図書館でファッション雑誌が必要なんでしょうか？ しかも貸し出しまで。
酷いなあ大阪・・・「は」ではまずいですが、いきなり余談でごめんなさい。
素人ながらに、ファッション雑誌も或いはその方面の資料として有用かも。
ならば、肝心のデザインが写った部分を切り取った行為は
窃盗罪（懲役10年）が適用できそうな？
雑誌は館内閲覧のみというのは確かに効果があるでしょう。
もう一つ、被害を受け易い雑誌（写真雑誌が多いかと思いますが）、返却時にサーッと破損チェックをする”ふりをする”だけでも効果があると思われます。
あるいは、被害を受け易い雑誌を名指しし、以上の雑誌の貸し出しの際には破損チェックを行います、と掲示する。
手間になりますが、雑誌書籍に破損等が見つかった場合は申告してくださいとお願いし、統計を取ると要注意人物（この人が借りた後は高確率で破損があるようだ）がある程度絞れてくるでしょう。
は全く無意味ですね。公共物を傷つけることをなんとも思わないからこそ切り抜きやページの破り取りをするんです。
まあ、何かしら手は打ってますよというポーズを取らないとマズイのでしょうが、精神文化の異なる相手と向き合うというのは性悪説に立たないと上手く行かないものです。
一番良いのはデジタル化して、PCの画面上で閲覧するようにすることでしょうね。
今、著作権がらみで問題になっている「Google図書館」のスタイルならば、切り取りようがありません。
返却時チェックは効果がありそうですが、返却者の目の前で行うのはあまりに露骨なので、後ろ暗いところがある人ほど、「利用者を犯罪者扱いするのか！」「名誉毀損だ！」とか逆ギレしそうな気がします。公設の図書館ではこの手の反論に弱いため及び腰になってしまい、実際に行うのは難しいのではないでしょうか。露骨だからこそ効果的ではあるんですけどね。

しょうもないことですが・・・。
ダックスフントの本が犬に噛まれてるというのに苦笑してしまいました。
他と違いこのケースはわざとではないと思いますけれども、本来は返却時に申し出て弁償するべきなんでしょうね。
実は故意による図書破損事故や関連トラブルは、その発生率こそ地域差がありますが、内容は驚くほど共通です。
閲覧室で堂々と写真部位を切りぬいたり破り取ったりする人に見かねた職員が注意したところ、逆に暴力を受けて脅迫されたり、長期間にわたり転勤先の職場や自宅まで押し掛けられて嫌がらせを受けたりする例が報告されています（確認がとれただけで全国で数名がＰＴＳＤ等により退職に追い込まれてます。）。これも一種の行政暴力事案でしょう（泣。
実際には、閉架図書でもない限り、「私が借りた時にはもう切り抜かれていた」とでも言われれば、館内でやられたことの否定は難しいでしょうから、それ以上の法的追及は困難かと思います。
そういうシステムを導入しましたよと広報すれば一時的には威嚇効果はあるでしょうが、高価な図書でもない限り、ごまかしきれず、最終的にバレても「弁償すればいいんでしょ！」で済まされそうです。
それでも弁償を認めず「訴えればいいじゃない」という声も聞こえてきそうですが、同じ役所でも警察系取り締まりセクションと異なり、サービスセクションでそうした強硬姿勢を貫くことは困難です。もちろん、常習者はそこに付け込んでいるのでしょう。
人手に余裕があるのなら、貸し出す際に丁寧に全ページチェックし、汚破損がないことを借り手と相互確認すれば、切抜きをするような不届者は無くなると思います。しかし、人員削減が役所の至上命題になっている昨今、日本一の貸し出し量を誇る巨大図書館でそうした対応は困難な気もします。
モトケン先生はもちろんご存知でしょうが、図書館の貸し出し利用記録は市民の思想に関する情報（センシティブ情報）に当たります。通常の個人情報保護条例では、センシティブ情報の取扱いは厳しい制約を受けます。ましてやそのデータベース化は・・・。
東京のように予算・人員に余裕があれば、事前に丁寧にチェックし、厳しく破損に対応できるので、センシティブ情報のデータベース化も可能なのかもしれません。
しかし、東京のようにはできないのなら、事実上威嚇効果に過ぎない目的の為には、リスキーなセンシティブ情報のデータベース化を行わない（行えない）という選択肢を取ったとしても、「ばかですか。」とまで罵られることもないと思うのですが・・・。
マナー本も、破損の中心となっている常習者や、図書館の本を破損してはいけないという常識すら持ち合わせていない人には何の効果も無いでしょうが、そこまでいかないいわゆる「軽い気持ち」の予備軍への牽制や、一般の利用者、（マスコミ報道を通じて）市民に対して破損問題を知らしめるには効果が無いわけではない（実際に新聞に載ってここでも取り上げられた）と思います。
最後に、私は大阪市の図書館職員じゃないことを申し添えておきます、為念（＾＾；
「ばかですか」と書いたのは、このエントリでは本文で書いた私だけだと思いますが、じじいさんはエントリ本文をきちんと読んでますか？
私は、貸し出し管理に必要な限度での情報保存を主張しているだけですよ。
不正行為（万引き，館内暴力，備品破壊行為，窓口行政暴力，書籍破損行為）への威嚇的対処なら、既に防犯カメラが普及を始めています。「防犯カメラ作動中」と表示している図書館もあります。「もはやそこまで来たか」と◎◎全国協議会の会場でため息がもれましたが。
はじめまして
この話が出るまでは、切りぬき問題には気付きませんでした。
というのは、私が利用している公立図書館では、本の返却時に、必ず館員の方がページをザーッと流してチェックしているからです。
確かに、こんな簡単なチェックだと「書き込み」「アンダーライン」程度だと見逃されてしまいますが、さすがに、切りぬかれている本にはお目にかかったことはないです。
そのくらいの簡単なチェックも大阪市はしていなかったのか、その点に私は驚いています。
私は、どのような本を読んでいるかは自分の頭の中を覗かれるようなものだと思っています。ですから、モトケンさんのおっしゃるような情報管理の強化には（お気持ちはわかるのですが）抵抗があります。
まず簡単でも返却時にチェックをする、館内閲覧のみにする、それでも駄目で特定分野の雑誌に問題が多いならその購入をやめる、
私はそちらの方がありがたいです。
貸し出し期間中であれば、図書館の職員が、どの本がどこの誰に貸し出されているのか確認可能になっているはずです。
その情報を、返却時点で抹消せずに、点検に必要な期間（せいぜい数日間だと思いますが）抹消せずにおくというのが不相当だとは思えません。
もちろん、返却時点で点検が可能ならば、その時点で抹消すればいいことです。
事務量が多くて、返却時点で逐一点検するのが困難な場合の方法として提案したものです。

オーウェルの｢1984」とか、ブラッドベリ「華氏451度」のような社会ならいざ知らず、私は図書館で本を借りたり閲覧するときに、職員がどう思うかはあまり気にしません。
自分で「コンナ ホン ヲ ヨンデ ワラワレハシナイダロウカ」なんて本は借りません（例えばこの齢で「愛読書は“はらぺこあおむし”なんて言ったら恥ずかしいでしょう？ブッシュ前大統領！）。それに、図書館にある本には（思想や品性を疑われるような）変な本は無いはずですし、あったとしてもそれはその本を買った図書館の責任（？）です。もっとも「若い」頃には、本屋でエッチな本をマジメな本の間に挟んでレジに出した、なんて姑息なこともしましたが・・・と( -_-)；遠い目

本の貸出記録に個人情報保護の問題がそこまでのしかかっている、とは思いませんでした。
であるなら、公共の財産である書籍の適切な状態を維持（つまり、切り抜きがない状態を維持）するためにも本の無事を確認するために一定期間の保管は許されるように思います。しかし、
民間の場合（例えば、レンタカーやレンタルビデオ）は返却後もしばらく保管しているように思います。車などは最低でも駐車違反やスピード違反の有無が判明するまで記録は保管しているはずでしょう？

犯罪と行政暴力は、ざっくり１０年平均でみると居住人口数に比例します。都道府県別で見ても、人口１０万人当たりの発生比率は実は大差ありません（統計上の有意差が認め難い）。ご安心ください。であるからして、「発生件数」だけ見たら、犯罪も行政暴力も東京都がダントツ抜きんでてトップです（全国の人口の１割が集中しているから当然(^^ゞポリポリ）。
一九八四年五月二五日社団法人日本図書館協会総会議決を読みました。
驚きました。任意加盟の社団法人の総会決議ではあるが、どこまで、錬られて作成されたのだろうかと。一番は、理解・支持します。
しかし、四は、一ができないから、やむを得ず、このようにしましょうと解釈すべきなのでしょうか？
大阪市立図書館以外にも、無責任な行為・言動があることを知りました。
う～ん、何度となく読み返してみると、確かにモトケン先生がエントリ本文で仰ることもご尤もで納得できるのです。一方、モトケン先生の仰る「○○ですか」の部分については、No.24 じじい様ご投稿・中でも「モトケン先生はもちろんご存知でしょうが、」以下の部分と、全く同様の事を思いついてしまうのですよね。これは、私の読解力の問題か？如何なる視点をより重要視するのか？という価値観の違いなのか。（悩）
私は日本図書館協会様のご見解に共鳴する立場ですので、やはり「貸出先の記録の用途は返却延滞時の督促のみで、返却時点で即日記録廃棄」を支持するんですけど、そうした前提に立って図書館の置かれている予算や人員の現状を考えると、私の中ではどうしても前の文に記述した考え方に行き着いてしまうんでしょうね。
貸し出し記録は、個々人の思想・信条の自由や出版の自由への不当な権力の介入の端緒と成りかねないという、戦前の反省にたった強烈な危機感が根底にあると図書館職員氏から聞いたことがありますから。日本図書館協会を結成しているのも、権力の監督を直接受ける事を極力避けることによって、戦前の図書を巡る過ちを避けたいとの意思の表れだとか。だから、貸し出し時記録は、あくまでも折々の時点で収蔵資料が館内外のいずこに存在するのか？を把握するための措置だと聞きました。
＃話は変わりますが、一時期該当地域に居住していた者の感想として、摂津國と河内國の域内の方は発生件数の多寡ではなくて、事案の質の問題として行政に対する姿勢について非常にaggressiveな印象があるなぁ。。。確かに。（汗）
最近、自宅近くの公立図書館を利用する機会があったのですが、まず書架エリアにカバン持ち込みOKなことに驚きました。実は海外（米国）の大学図書館を利用したことがあるのですが、そこでは入館時に持ち物はすべてロッカーに預けて、手ぶらで入館する決まりになっていたものですから。（同じ米国でも図書館によって違うのかもしれませんが）
切り抜きや破損もさることながら、まるごと持ち去り被害というのも結構あるんじゃないかと邪推してしまいました。

多分図書館の中の人は、（過去への反省にたった真摯且つ強力な）理念・理想やそれに対する使命感と、諸々の現実（公共財への価値観の変化、財政状況による運営経費全般の削減、人員配置の縮減など）との間で、大きく葛藤されてるんじゃないでしょうか。
だから現実を前にして、何とか理念や理想・現行の対権力・対私人の運営方針を損なわない範囲で今後も運営したいという思いが、今回のような見る人によっては手ぬるいと感じる対応に繋がったのだろう。と言うように、私は受け止めています。
とは言いながら、利用者の公共財に対する道徳観とか倫理観とかの現状が現状であるだけに、折り合いを付けて現実的な対応を採用することも必要だろうとも、思います。無茶な利用の仕方をする利用者に対して憤りを感じますし。

本題から離れそうなので、これまでとさせていただきます。

実は、一昨日東京に行っておりました。
雨の銀座・日本橋・新宿辺りをさまよっていたのですが、（よく言われる電車だけでなく）東京の人のマナーは大阪に比べると格段にすばらしいです。
例えば車。歩行者が（信号の無い）横断歩道に立つと大抵減速（停止）してくれますし、首都高を走っていても、こちらがウィンカーを出したらまず間違いなく（割り込みの）スペースを作ってくれるし・・・。大阪の車もあれぐらいマナーがよければ、１ｋｍ足らずの間に右から左に４車線変更しなければならない恐怖の阪神高速道路環状線も落ち着いて走ることが出来るでしょう。
犯罪派生件数の人口比は同じぐらいでも、中途半端に大勢の人間がいて、昔からの住民（含：親・祖父母の世代からの住民）が多い大阪には、良く言えば「人情や仲間内の気がおけない間柄」、悪く言えば「なぁなぁ精神」が充満しているような気がします。ですから、少々「グレーゾーン」を超えてしまっていても「大目に見てもらえる」という甘えがあるようにも思います。
（とは言うものの、一方で都会型の無関心化も急速に進んでおります。西淀川の女児（虐待）死体遺棄事件も「人情味あふれる近所付き合い」があれば防ぐことが出来たのに・・・。トピズレすみません）
＞誰とはなしに
利用者の借出情報の秘匿がそれほど重要なら、貸出管理そのものをやめてしまえばいいと思います。
そうなると、借りた本を返すも返さないも借りた人の自由です。
借りた本から好き放題切り抜きをして返すのも自由になります。
この二つに本質的な差があるとは思えません。
延滞管理のための情報管理はいいが、破損の責任追及のための情報管理はいけないという主張は、私には理解困難です。
皮肉でも何でもなく、そのような抵抗感をお持ちの方は、ネットサーフィンなどは避けるべきと思います。
まして、コメントを残したりすることは、「頭の中を覗いてください」と世界に発信する行為です。
図書館職員に見られるどころの話ではありません。
公な機関では個人情報にかなりの神経を使わなければならない事も理解はできるのですが、
モトケン先生のお考えには同意できます。
しかし今回のエントリではじめて知ったのですが、破損管理等の為にも数ヶ月或いは２～３年位は個人情報が当然の如く管理されているだろうと思っていたのですが、違っていたのには驚きました。（私も簡単な貸出しカードも作りましたし）
ちょっと乱暴に考えてしまえば、「管理されたくなければ、ほしい本は自分で買えばいいのではないのかな」と思ったりもします。（廃版で買えない場合もあるかもしれませんし、そういう場合が多いかもしれませんけれども）

で、個人情報保護と公共の利益のお話についてですが、勘ぐれば、最近は企業でも役所でも仕事の量を減らすために個人情報保護を「だしに使っている」ように思えることがあります。
（今回ここで初めて知った）図書館協会がそうだとは言いませんが、例えば、相手が自分のどんな情報を持っているかを知りたくても、個人情報保護という理由で教えてもらえない。そのくせ、とんでもないところからＤＭが送られて来たり、例えばクレジットカードの事故履歴は金融機関が共有していたりする。
個人が知られたくないことを他人に知らせない、というのが大原則だとは思います。しかし、大金持ちの個人が趣味で「貸本」をしているのならともかく、税金やみんなの金（私立大学でも学費や補助金が原資ですよね）で買った財産を毀損する行為を調べようともしない人たちに公共の財産の管理をして欲しくはないな、というのが正直な気持ちです。
ちなみに、大阪市立図書館は貸し出しカウンターで機械にかけない本を持ち出したらゲートのところで警報が鳴るようになっています。万引防止のゲートと同じような感じです。詳しい仕掛けは知りませんが、あれがなかったら、一日で図書館中の本が無くなったりして・・・・（と、りんご事件を思い出してしました(泣）

古本屋さんを丹念に探せばありますよ。古本屋めぐりもオツなモンです。それに、今はネットで探せば結構いろんな絶版本が出てきます。もちろん、ネットの場合は「匿名性」は損なわれますから、貸し出し記録保存に反対される方はちょっと遠慮されるかも知れませんが。
しかし、貸し出し記録（一定期間）保管に反対する方々の根拠はやはりよく理解できません。徹底的な個人情報保護を言い出したら、クレジットカードやマイレージカードも使えなくなるようにも思えますし、通話記録が残る携帯電話も使えないように思えます。もしかして、いつもニコニコ現金払い、電話発信は常に公衆電話を使っているとか。
図書館協会の理念を踏みにじり、知の財産の一つで有る書物の保管庫である図書館から財産を盗み取られるよな場所に、図書館なんか必要でないでしょね。 そんな場所の図書館なんか閉めてしまえば良いのですよ。
過去から未来へつながる知の財産と思えるなそんな事が出来るわけがないのですから。セキュリティーに予算をつぎ込むだけ無駄です。閉館してしまえば、そんな予算も必要ないのですから。
図書館協会も守ってきた利用者の一部から、理念を踏みにじられたのですから、とっと方針転換すればいいのです。選択を迫られてきています。
図書館に記録が残るのが嫌なら、図書館なんか利用しなければ良いだけです。
私も履歴残す派の皆様の仰ることが解らない訳ではないし、現状ではそうした方針転換はやむを得ないと思っています。
日本図書館協会様には申し訳ないのですが、協会様の理念を貫くには、それが許されるだけの利用者の民度が、色々な意味で必要でしょう。
令状無き場合には捜査機関からの照会にも応じない等の伝統を維持されてきた事等については、純粋に日本図書館協会様に敬意を表したいのですが、残念ながら今後も現状のレベルで理念を貫いていくことは、却って公共の福祉に資さないおそれがある事態に立ち至ったと思います。
したがって、この問題は日本図書館協会様の判断に委ねられていると考えています。先人の努力を踏みにじる結果になっているような気がして、心苦しくもあるのですが、この状況では仕方がないでしょう。

先人たちが築き上げて来たものでも、一瞬で崩壊してしまう恐ろしさ。
ゲートシステムは持ち出しの防止用ですからね。 本体への損傷へは無力。
昔、漫画の貸本では回収率が良かったと聞いたのですが、子供相手ですから、傷みは仕方ないとしても、次に読む人のため読めなく成る様な故意に損傷さすことは無かったと聞いております。
貸出記録の収集自体は「思想・信条の自由」の自由とは関係ないと思うのですが。要は目的をはっきりさせ、目的外使用を規制すれば良いのであって、「記録を収集するから思想・信条の自由が侵害される」と言うのはいささか飛躍があるように思います。
もっとも、貸出記録を取られたくないと言う考えを持っている人もいるでしょう。一つの案として、個々の利用者に対して「貸出記録を保管する」と言う同意を取ることでしょうね。同意がとれた人に対しては貸し出し手続きを簡単に、不同意な人に対しては貸し出し手続きを煩雑にするという手はあると思います。
「誰とはなし」が誰に向けられているかは存じませんが、私は最初から東京都の手法は否定はしていないのですが・・・。（否定している箇所があれば誤りですのでご教示ください）

自治体が取り扱うセンシティブ情報として代表的なのは、公立病院の診療情報（カルテ）だと思います。しかし、寡聞にして「診療が終わった後にカルテを裁断している自治体病院」や「カルテをデータベース化する事が個人情報保護の観点から問題視されている自治体病院」を聞いたことがありません。
個人的には、貸出記録より病院の診療情報を慎重に取り扱う必要があると思います。慎重に扱わなければならない診療情報でさえ保存されているのに、貸出記録が保存されないのは違和感を覚えます。
自分でデータを消去しておきながら、「犯人の追跡もできない。」と愚痴っているところが馬鹿だと言ったのです。
追跡手段を講じるか、講じないなら追跡をあきらめるか、じじいさんが言うように貸し出しを廃止するというのならまだ分かるんですけどね。

カルテは法定保存年限が罰則付きで義務付けられているので、比較対象にしない方がよろしいかと思います。m(_ _)m その保存義務の沿革は、疫病や死因の統計分析対策から始まり、治療と公衆衛生の貴重な生きたデータとして扱われることが期待されてきたようです。
ただ、その趣旨を援用すれば（実際にされていると思います）、どんな文献雑誌のどんな部分が、切り取られているか破り取られているか、書き込みやアンダーライン汚損されているかを分析して統計をとれば、最小限の対策は出てくるでしょう。
ムック本や雑誌それに画集や写真集は、貸出禁止な上に開架閲覧コーナで職員の目の届くところでしか閲覧できない図書館が、そのひとつかと思います。

正直、しま様が何を仰りたいのか全く分かりません。
大阪市立中央図書館において「センシティブ情報の取り扱いには厳しい制約がある事」が、貸出記録を保存しない理由として正当かどうかと言う問いかけです。
中央図書館が「（本当は）貸出記録を保存したいが、個人情報保護のため貸出記録を消去しなければならない。そのために、追跡ができない」と考えている事が前提条件です。

私も（何も悪いことをしていないのに）自分の持っている本を警察などに捜査されたくありません。が、本の管理を（市民から）任されている図書館が、切り取られた本を誰が借りていたかを調べるのに、貸し出し記録を半年位保管するのは仕方ない（当たり前）だと思います。もう一ついえば、戦前の｢思想・政治犯」と公共の財産を傷つける「器物損壊犯（？）」は明らかに違うでしょ？

本日仕事の帰りに市立中央図書館に寄ってきました。
正直、唖然としました。休日だったからかもしれませんが、貸出し利用者が長蛇の列を成していました。
貸し出しも返却も並んでおり、スーパーのレジ打ちよろしく、バーコード管理で手早く処理はしていましたが、いっぱいカウンターがあるにもかかわらず、列は閉館まで途絶えません。カウンターの職員と話でもしようと思って行ったのですが、とてもそんな状況ではありませんでした。
返却された図書も、すぐに返却本のコーナーに置かれ、またそれを別の人たちが待ち構えてて閲覧したり、貸し出しに持っていく。人気の本にはいくつも予約が入っており、次々に回さねばならない。正直開館日にはチェックしてる余裕はないでしょうね。閉館日にでもしてるのでしょうか。（閉館日も今月から月１回だけですが）
カウンター前が始終ごった返す図書館というのを初めて見ました。「国内一」というのも十分頷けます。昔は府立図書館が市内にあったので、それほどでもなかったのでしょうが、府立図書館は市外に移転したので、便利で蔵書が多く、施設も広くてキレイな市立中央図書館に利用者が集中したのかもしれません。
この状況で責任追及をしようと思ったら、利用者の個人情報を保存してないと絶対に無理ですし、チェックだけでも膨大な作業量になりますので大変だとは思います。それでもやるべきというのは正論ですが、私としては雑誌を置くのを止める方向で進めるべきで、そうでないと持たないと思います。
私が個人情報の話をしたので議論が混乱したのは認めますし、現場を見て自分の認識が甘かったのも実感しました。私としては本件に関してはここで撤退したいと思います。ご不快な思いをされた皆さんすみませんでした。

厳密な法律論となれば自信はないのですが、私見の範囲で申し上げるとするのなら、地方公共団体（通称地方自治体）立の図書館に限定すると、その建造物・収蔵図書類すべて公有財産（＝地方公共団体の財産）となりますので、地方公共団体として公有財産である収蔵図書類について管理義務・管理責任は生じると思われます。
なお、昨今制度化された「指定管理者」制度の適用が、地方公共団体立の図書館にも及ぶのですから、当該制度の「管理者」を指定するという主旨に鑑みても、運営に責任を負うべき主体には「管理する責任」は生じると思われます。
しかしながら、「管理義務や管理責任の及ぶ範囲がどこまでなのか？」という点について、公有財産管理の法令に疎い私にはお答えすることが難しい命題であります。つまり、（広義での）地方自治法制上「ここで言われているような管理しない」という選択が可能なのか？は私には解らないと言うことです。無責任且つ中途半端な投稿で申し訳ありません。m(__)m
