死刑という刑罰は、死をもたらす執行の瞬間よりも、いつ死がもたらされるのか執行に怯える期間が、本当の刑罰なのではないかと思う。
この被告人には、供述通りに死刑を与えたくない。
いや死刑を簡単に執行したくない。
死刑判決の後はすぐに執行せず、10年でも20年でも、そして無期懲役での仮釈放があり得る30年を過ぎても、なお確定死刑囚として、いつ突然の死が訪れるのか不安に怯える日々を、1日でも長く過ごして欲しい。
本日の計15本の産経記事を最後まで読んで、このように思った私は人非人だろうか。

昔、「欧米では無神論者は信用されない。」という話を聞いたことがありますが、私は納得できる話だと思っています。
失神したという事実は、これからの精神鑑定において重要な資料になるかも知れないと思っているのですが、専門家ではないので自信はありません。
私の当てにならない直感では、責任能力を認める方向に働く事実ではないかと思います。
人間らしい反応に思えるからです。
私も専門家ではないわけですが、被告人に関しては直感として同様な感想を持ちました。
他人にそういう信念を持ってもらうのを期待してもしょうがないわけで。
信仰を強制したりできないわけですから。
社会として出来るのは犯行にいたるまでの社会的な要因を見極めてそれをそれを取り除くくらいでしょうか。
秋葉原の事件では｢社会のせいにするな」みたいなコメントがありましたが､真逆ですね。

個人個人がどのような倫理観や死生観を持つかということは、根本的には個人の問題ですが、もし被告人のような考えを持ち、かつその考えに基づいて行動する人間が多くなってくるとしたら、社会は崩壊の危機に直面すると思いますよ。

「社会的な要因」の範囲をどのように考えるか、またはどのような具体的な事実を要因と考えるかによって賛否がわかれるでしょうね。
絶海の孤島で一人で生きているのでない限り、人の生き方はすべて社会に繋がっていますから。
その観点で言えば、子育てやしつけの問題も「社会的な要因」ということが可能だと思われます。
被告人は、ＲＰＧにのめり込んでいたという報道もあります。
それが要因なら、それを取り除くことを考えますか？
「社会的な要因」の犯人捜しをしたとしても、それが「犯行の要因」になるかならないかは、被告人の「個人的な要因」との関係が問題にならざるを得ないと思います。

ドラクエが医療の不確実性に対する理解不足をもたらしたという仮説がネタではあるものの、考察はごく真面目にされているように思います。ということは、ゲームと現実の区別をつけられない人が現実に存在すれば、ネタがネタで無くなってしまうことになります。そう考えてしまうと、単純に笑うことができなくなってしまうエントリなんですよね。

大江健三郎の人生で取り返しのつかない事はふたつしかない、誰かを殺す事と自分を殺す事だってのすごくしっくりします。
死刑になるからでも無く地獄に堕ちるからでもなく、失われた命は取り返せないから殺しちゃダメ。
同じように親子心中なんかもダメ。
誰かを殺して自分も死ぬってのもダメ。
とりかえしのつかないこと。
何をもっても償えないもの。

今まで何度も繰り返されてきた問いかけだと思いますが、「どうして他人の命を奪ったらいけないのか？」と問われたらどう答えますか？

ある意味でNATROM 先生のエイプリルフールとも関わるかと思いますが、たぶん多くの医療関係者がたいした信仰を持ってなくて（習慣としていろんな行事に関わってても本質的には無関心と言う意味で。）人の命は１回限りと思っていて一発勝負をやっているんじゃないかななどとも想像します。
敗者復活戦は無い。
宗教はすばらしいものと思います。
でもそれを信じるかどうかは全くの自由だと思うし、私は別に人を評価する尺度にはしていません。
個人的には信じられる宗教があったほうが生きやすいような気がするので、私にあった宗教がみつかるといいなとは思ってるんですけどね。（ボコノン教とか？

いろんな屁理屈が考えられます。
じゃあ、治療可能な怪我をさせるのならかまわないのか？
他人の生き死にがどうして自分に関係あるのか？
などなどです。
なぜ、こんなことを言うかと言いますと、犯罪者の特徴というか犯罪の本質というのは、自己中心性だと考えているからです。
考えているのは自分の損得だけ。
他人の痛みなんか知ったこっちゃない。
という自己中心性です。
自己中心性に対抗するにはどうすればいいか、ということが犯罪対策における根本的な問題であると思っているわけです。
そこで、一番分かりやすい論理は、「悪いことをしたら地獄に堕ちるぞ。」とか「悪いことをすると神様に罰せられるぞ。」不可避的応報論理だと考えています。
この論理は、自己中心性と矛盾しないというところが重要かつ効果的と思える所以です。
先ほどのコメントでも書きましたが、ここで問題にしているのは、犯罪抑止と信仰ないし宗教的信念との関係です。
刑事処罰と宗教的罰ないし裁きの違いはなんだと思いますか？
念のために申し添えますが、ここでは特定の宗教を念頭に置いているのではありません。

法律は無知ですが宗教も無知です。（もしかしたら法律以上に学校で教わらなかった気も。(;^_^A
日本人が神を信じていないのは、他国人に比して多いのでしょうか？
私はまだ宗教を持っていません。しかし、自分に恥じることがないように生きて生きたいと思います。神に監視されて生きていくような人生を送りたいとは思いません。しかし自分を恥じることが重なったとき、助けとしての神を必要とするかもしれません。
宗教についてあまりこの年になるまで考えたこともなく、知識もない私が変なことを書くとろくでもないことになりかねませんが、ある意味では日本は神を絶対的に必要な厳しい環境や社会を持たないのではないでしょうか。そこが、たとえば自殺の多い社会になることはないでしょうかね。
宗教を持たずに生きていけるためには、その代わりとしての何かがあるのかもしれません。今までの日本ではそれが、仕事や会社だったのでしょうか。
今一番、神の代わりとしての存在を失っているのは実は医者ではないんではなかろうかと思います。自分の絶対的な存在意義、人から必要とされているんだ。命を負かされているんだ、尊敬されて頼られているんだ。それらがこの数年で木っ端微塵に吹っ飛んだ結果として、医者の精神構造の変化が生まれ、迷える民が守るべき土地をすて流浪の旅にではじめてしまったんではないんでしょうか。ただの民が人の命という重いものを自らの精神のうらずけなしに扱っているのですから耐え切れなくなると思います。

「それは日本に古来から有る思想」との主張も視掛けますが、日本人の多くが特定の宗教に属さない、あるいは多神教の思想に繋がる、そう私は感覚的に納得しています。
尚、地獄に関しては、仏教の伝来後平安時代には御存知の「餓鬼草子」も作られて今や国法に。

私はカトリックの幼稚園に行き、お墓やお寺にお参りに行き、正月は神社参りをし、クリスマスはケーキを食べます。旅行中に岩や池にお金が落ちていれば何となく投げ入れ拝みます。

いまは，昔の「地獄」が，「死刑」と「マスコミバッシング」に代替してしまったような…（以下略）。
私は、｢附属池田小事件｣の時、同じように思いました。池田小の犯人に必要だったのは、刑の執行より、罪も無い子どもを殺したことに対する反省の（または刑務所で延々と刑の執行を待たせる「苦痛」の）時間、だったようにも思います。法律的には正しいこととはいえないかも知れませんが、恐怖の中で死んでいった子どもたちのことを思うと、犯人が「望みどおり」即死刑になったのには割り切れないものを感じます。
