貧困者を犯罪者とみなす刑罰国家の危険 - 憲法25条"生存権"軸の福祉国家へ（内橋克人×湯浅誠）（すくらむ）
流し読みした印象では面白かったので紹介します。
本質的には憲法論ではなくて刑事政策論だと思いますし、貧困と相関が高い犯罪と必ずしもそうでない犯罪があるように思いますのでどこまで一般化できるか検討の必要があると思いますが、一つの視点として興味深いです。

社会的弱者のセーフティネットが少ない日本なのに（その限りでは貧困が犯罪の一因であるジャンバルジャン犯罪や介護心中犯罪もあります）、その少ない社会保障給付ネットで詐欺を「働く」犯罪もあるので、担当者は歯がみしてます。障害者偽装・不正受給犯罪がそれです。o(；△；)o

貧困犯罪の多いアメリカでも社会保障の不正受給犯罪は多いです。
確かレーガン時代だったと思いますが、社会保障詐欺問題での公聴会に招かれた元詐欺犯が、いろいろな手口で70人以上もの実在の人間に成りすまし、自分の口座に社会保障給付を受給する不正を証言しました。また時の大統領（副だったか？）をホワイトハウスの住所で「無職無収入の哀れな老人」として、社会保障庁のコンピューターに登録して見せる実験すら行われました。
現在のアメリカでの社会保障カードシステムは、その後に大分強化されましたが、戸籍と住民登録制度による重複突合照会が整備されている日本の方が、まだ数段不正は少ないと言う社会保障専門家も多いです。
日本の戸籍＆住民台帳というシステムは、行政インフラとしては、個人特定や不正防止にもの凄い効果のある制度だと思います。まぁ、その個人特定効果の高い分、国家の国民管理に使われる道具だとの意見もありますが･･･。
エントリにてご紹介の記事は、そのような側面は確かにあると感じます。
憲法第２５条と第２７条は、一体不可分な概念として伝統的に取り扱われてきているとは雖も、「最大限勤労しても生存権が脅かされる状況」は看過して欲しくないですね、国会議員各位。
というか、最大限勤労に励んでも結婚・育児が望めない水準の所得しか得られない、そんな婚姻・出産適齢層が突出して増大する現状では、「日本国自体の生存権（持続可能性）の問題」という論点に、もう少し真剣に着目されてもいいのでわ？と思わなくも無いです。

もっとも、住民基本台帳の実態については、本来の立法主旨（第１条の目的規定）に照らせば、都市部を中心に結構お寒い現実がないでもなく。行政は住民票を基礎にして執行されるのだから、居所≠住民票の状態を”法定の届出義務に反して放置した結果”として生じた不都合を、行政機関の責めにしないで～。（除く、ＤＶ被害者等）
それと、特に永住者に関して、現行の外登簿の制度では・・・（自粛。

上記投稿中「日本国自体の生存権」という、必ずしも適正でない言い回しを使用しておりますが、意図としては「社会の持続可能性の問題」という事を表現したいのであって、それ以外の意図はありませんので、念のため付記いたします。
貧困者が犯罪者ではなく、貧困が犯罪（ケネディの言葉を借りれば、「人類共通の敵」）なのです。（この場合、「貧困を生む社会構造を放置すること」と言い換えてもよいと思います）
テロリストがテロを行うのも突き詰めれば経済格差であり、少なくとも実行犯たちの中には貧困状態で自棄になっている者も多いということは否定できないように思います。皮肉なことに、テロの原因の一つとされる経済格差は、テロの命令･指示を出す側と実行する（させられる）側の間にも存在しているようですが。

ジェフリー・アーチャーの「ロスノフスキ家の娘」に似たようなエピソードがありましたが、これって実話ベースのエピソードだったんですか…。

失意のフロレンティナ・ケイン上院議員が、この社会保障詐欺糾弾の政治的リーダーで復活するエピソードのシーンですね。
ハイ、実話ベースと私は聞いてます。
なおこの先はトピズレですが、蘊蓄を少々垂れさせてください。
アメリカは1970年代（ジョンソン大統領の時代）に、大幅な福祉増強政策を取り、当時大量に出現したベトナム復員兵や、ドルの威信低下による経済低迷で増加した貧困層などへ、福祉給付の予算を大幅に（約２倍規模に）増やしました。しかしそうした「大きな政府」がもたらした財政赤字と、製造業の競争力低下によるアメリカ経済の莫大な貿易赤字という、いわゆる「双子の赤字」でのスタグフレーションにあえぐ結果となりました。
この閉塞状態を打破する政策を引っ提げて登場したのがレーガン大統領です。彼は福祉など国家予算の急拡大による財政赤字が増税をもたらし、その増税が勤労意欲を喪失させて経済活動が低迷する、当時のアメリカの悪循環状態を断ち切る目的で、通称「レーガノミックス」と呼ばれる一連の改革政策を断行しました。その中で社会福祉制度については予算総額を削減して減税を実現しながら、本当に福祉を必要とする貧困層へダメージは与えないという、一挙両得の政策を模索しました。
その政策実現の柱が、社会保障給付の不正受給や重複支給などのムダの排除と、働けば受給が減らされて不利になる「受給安住指向の制度」から、受給しつつ働いて稼いだ方がより有利になる「自発的な脱受給指向の制度」への転換です。そうした社会保障制度の検証や新政策のために、1982年～1983年頃は多くの公聴会や政策提言のシンクタンクが、ホワイトハウスや上下両院議会に設けられました。ジェフリーアーチャーが「ケインとアベル」で使ったエピソードは、この時の上院公聴会での実話だったハズ（スミマセン記憶だけで明示するソース資料がありません）です。
なお、今医療界から不倶戴天の敵の如く攻撃糾弾される、故吉村仁厚生事務次官が『医療費亡国論』の論文を発したのは1983年（昭和58年）のことであって、ちょうどこのレーガン時代のアメリカ社会福祉制度見直しと同時期のことです。吉村氏の論文も基本線は、社会福祉行政のムダと受給者の福祉安住化を防ぐ改革を他方の政策的柱とし、もう片方で社会福祉予算＝国民負担のいたずらな増大拡大により、将来の日本経済が疲弊しては福祉財源の供給すらままならなくなることを憂いた論文で、まさしくレーガノミックスと瓜二つの発想です。
吉村氏は決して福祉そのものを縮小せよと説いたのではなく、金をばらまくしか発想し得ない日本の社会福祉行政を厳しく批判したもので私は高く評価します。ただ、時の日医会長である武見太郎氏が吉村氏を「赤色官僚」とまで厳しく評し、ことごとくこの論文に反発した為か、医療界の人々がこの論文を敵対視するのは残念に思います。

なお、先ほど引用した読売新聞の記事で肝心な部分（見出し）が抜けておりましたので、念のため（他の方々のために）書き添えます。

不正受給（需給詐欺）のおかげで正直者がバカを見る、というのは腹立たしいかぎりです（この場合の正直者というのは、真に救済が必要な方だけでなく、窓口で親身になって相談にのったり給付事務をされている公務員の方、そして一般納税者のことです。）
雇用保険もそうですが、不正がばれたときの返還の厳格化や、（懲罰的）追徴・刑罰などを重くする、などの方法しかないのかも知れませんね。
何かあったら、「行政は何をしている？」と批判して、結果として新しい法規制（制度運用の強化）の導入の糸口を創り出す。で、法規制が強化されれば、「面倒な世の中だ！」とか「無意味に複雑な規制をして官僚の権限を温存している」と批判する。或いは「厳しすぎて意味をなさない」という批判も亦同じ。
諸々の行政分野で普通に在ると思しき遣り取りですが、これって自分で自分の首を絞めるというか、二律背反で矛盾した要求だと思うんですけど、私は。行政活動や立法活動は、一般的包括的な基準を作らなければならないのですから、「自分に類害が及ぶときは規制なり対処なりして欲しいが、そうでないときは規制はない方がよい。厳しく対処して欲しいが、面倒な手続きは嫌だ。」というような、勝手な話はあり得ないんですがねぇ。
私見としてホンネを申し上げると、No.12 ハスカップ様のご心情と同じです。
ところでレーガン路線は、時期的にはクリントン政権下で花を開くです。が、これはクリントン氏がレーガン路線を若干軌道修正した結果、２１世紀初頭の繁栄に繋がったという話が無いわけでもないとか。（真偽は不明ですが。

不正の発覚時に詐欺師は、不正受給分を費消し切って返還も追徴も事実上不可能です。詐欺師は働かないで犯罪収益で生活してますので、稼働による返還もこれまた画餅です。そもそもそういう人しか「詐欺師」という「職業」を選ばないからでしょう。
そして、バレたら刑務所に入ることを厭わないプロ中のプロすらいます。古い改正刑法草案には「常習詐欺」という犯罪類型すら設けられたくらいです（遠い目。嗚呼！
＞厳しく対処して欲しいが、面倒な手続きは嫌だ。」というような、勝手な話はあり得ないんですがねぇ。
御理解いただけて感謝です。m(_ _)m 行政窓口で一般市民の方と接する部門、特に市民課はそうです。それも善良純朴な方ほど身分証明書類の提示を求められると激怒されまして（昭和年間はよかった～。

支給の窓口論としては仰るとおりです。ただ日本の公的社会保障制度の行政運用は、年度ごとの新規支給件数や支給額の増減という、行政執行や予算の単年度主義の悪弊が顕著です。障害者への生活支援や生活保護支給は、給付の支給決定基準よりも、その後の対象者の生活をどれくらいこまめにフォローアップ出来るかが、本来は福祉政策の本質の筈と思います。
しかるに日本では福祉とは社会的弱酸に金を恵んでやること、金を支給することが福祉だ、金額の多寡が福祉の質を左右すると、国民も福祉に携わる人も、そして行政も政治も、バラマキに意識が傾斜しすぎていると感じる。窓口で支給決定した後に、対象者を毎月訪問して生活の程度を確認したり、支給されたお金をより効果的に使って生活を向上させる手助けをする、「アフターケア」や「フォローアップ」の思想が決定的に欠けているのが、日本の社会保障制度の実態ではないでしょうか。
窓口では不正支給のリスクを多少抱えても緩い運用で支給決定し、支給し始めた受給者の生活の立て直しを継続的にフォローし、ケアする体制と仕組みがあれば、窓口での緩めの運用による過剰な支給や不正受給には早めに手を打つことが可能です。このようにお金の支給と、継続的なフォロー＆ケアの両輪建ての福祉システムにしないと、単に不正を恐れて窓口での運用基準を細かく定めたり、厳格な運用を求めるだけでは上手く行かないのは確かでしょう。
社会保障＝金をばらまくこと。この発想しか日本国民が持てないのであれば、福祉の充実度を金額ベースでしか量れない「日本型高福祉の錯覚」から、いつまで経っても脱却出来ないのではないでしょうか。私はそんな懸念を最近は持つに至りました。
以下は、No.15 ハスカップ様の仰る実効性という側面を無視して、非常に汎化した行政全般の話として呟くのですが。
一般論として、事前規制型行政よりも、事後規制型行政の方が、必要な政府職員数や予算が増えるです。例えば社会保障給付に関しても、入り口厳しい型より、入り口緩く出口厳しい型（入り口を緩く、後から不正を厳しく取り締まる路線）の方が、必要な政府職員数や予算が増えるです。
例として、自由と規制緩和の筆頭格・アメリカ合衆国に於いては、日本と比して事後規制型行政組織ですが、連邦政府職員数（国家公務員のみ）は約３４０万人らしく、日本の国家公務員数とは比較になりません。人口辺りの公務員数も日本の約２倍ですし。
で、今の日本の行政組織は基本的に事前規制型・入り口厳しい型を前提として、組織が構成され人員と予算が手当てされている側面があります。そうして、そこから更に人員を減らすという方針なのはご案内の通りです。
要するに、事後規制型・入り口緩く出口厳しい型の行政運営を望むなら、国会議員の（有権者にとって苦みのある）決断が必要かと思います。この点だけは、行政職員の力では無理ですから。私が先刻の投稿で国会議員各位と書いたのは、その辺の事情も踏まえての話ですのん。
＞支給されたお金をより効果的に使って生活を向上させる手助けをする、「アフターケア」や「フォローアップ」の思想が決定的に欠けているのが、日本の社会保障制度の実態
単純に人手がない（人員配置と人件費）に尽きると思います。そして、社会的弱者という極少数者への行政サービスは費用対効果で真っ先に人手（前同）が削減される傾向にあります。

私は入口緩くまでは同意ですが、出口を厳しく（罰則規定などでの厳しい運用）よりも、受給者から脱出させるお手伝いを如何にして細かくフォローするか、そちらに人員と予算を増やしてもらいたい。
一度受給したら一生受給が続く人々が多いのは致し方ないことですが、少しでも被受給者から非受給者に移行し、更に非受給者から支給する財源負担する者に移行できるよう、システム的な道筋が欲しい。
支給決定＝行政窓口での仕事は終わり、とか支給後は奉仕活動の人々が何とかしてよ、というゼニカネだけ恵むしか能が無い福祉行政を何とかして欲しい。いや何とかしなければならないと思う。
＞単純に人手がない（人員配置と人件費）に尽きる
その通りです。
しかし、先ず先に所用の人員配置と人件費に予算を付ける。この予算増加は現行の福祉予算の財源をも圧迫するでしょう。でも増強されたケア＆フォローによって、被受給者が非受給者に、更に財源負担者に移行できる者が、例え数％でも増加すれば数千億円の単位で福祉財政が好転すると思う。
民間企業で言う「先行投資」の思想や、「損して得とれ」の商人感覚が公務員や行政の世界には欠けていると思う。
（以上はハスカップ様のような意識の高い公務員でも能力的に不満であるという意ではありません。為念）

現場でホントに痛感してます。皆様もご記憶に新しい耐震偽装～食品偽装の一連の騒ぎを見るにつけ。事後調査の素人公務員が、質量ともに人手不足と予算不足で七転八倒をしている姿を想像すると…。
ただ、多少のリスクを覚悟で規制撤廃事後審査型を導入すると、新たなビジネスチャンスを生み起業が増えた面もあるので（単純に税収が増えました）、一概に否定するのが難しいかもしれません。無論、無防備な社会的弱者が自由競争の波に翻弄され、ワーキングプアなどの新貧困層も生み出していることも、為政者の方には軽視して欲しくないです。
日本では珍しい事後規制型で組織された警察は、人員と予算削減の一番大きな影響を受け、統計上も犯罪認知件数の増加に対応できずに検挙率の低下が顕著となりました。その替わり、民間活力が参入する（警備会社が格安で一般民家の機械的警備を請け負う）ビジネスモデルが発展したという事態ではないかと愚考してます。
＞でも増強されたケア＆フォローによって、被受給者が非受給者に、更に財源負担者に移行できる者が、例え数％でも増加すれば数千億円の単位で福祉財政が好転すると思う。
保健婦さんの巡回訪問による公衆衛生の推進という予防医学を拡充させて、疾病率の低下と医療保険財政の改善に向かった自治体もございます。これは医療関係者の方が詳しいかと思います。m(_ _)m

ご指摘の点は、ごもっともなお話だと思っています。先刻の投稿では、如何にも片手落ちでありました。
話の流れから、不正への対応を強調すべく事後規制型と書きましたが、事後関与型と言い換えても良いのかも知れません。
脱法行為・不法行為については、文字通りの事後規制型行政が必要と思う一方、社会保障分野ではご指摘のようなアプローチが有用だろうと思っています。フォローアップ型というか、（本当の意味での）支援型行政・助太刀型行政と申しますか、硬軟織り交ぜた機能するアプローチの類型が必要だろうと思います。
しかしながら、そうしたアプローチは、人員と予算が必要である一方、直ちに目に見える経済指標の動向に寄与しがたい部分があることが、問題への手当を難しくしている側面があると思っています。

私が、昨今感じているこの国の不幸の一つは、「改革」という言葉に、「公的関与の縮小・政府規模の縮小・国民拠出率の縮減と等値である」という、必ずしも正しくない定義が与えられている事だと思っています。
本来「改革」とは、より良い方向に向かうように物事を改めていくことであると。より良い方向に向かうために公的関与の拡大・政府規模の拡大・国民の拠出率（連帯率）の増加が不可欠な分野があれば、そうすることもまた「改革」であるにも拘わらず、「小さくする方向でなければ改革にあらず」みたいな風潮がある。その上に、そうした錯誤に世論の体勢は気づいていないと思しき状況に、非常に深い危惧を感じます。
各種統計によれば、欧米並みの水準を求めるのなら、今とは逆の方向に改革しなければならない。今の方向で改革を続ける限り状況が改善することはあり得ないのですが、「状況が良くならないのは（状況を悪くする方向の）改革の不徹底にある」という論調が支配的な現状では、非常に厳しいと思います。
人員の質の問題を考えるなら、より一層の経費と時間が必要なんですよね、単純に人員の量（マンパワー）を問題視する以上に。能力と経験を兼ね備えたスタッフは、天から降っては来ませんから。
外部から既に一定のレベルに到達した人員を調達するには、外部との人材獲得競争が生じますし、内部で育成するには時間とお金と経験を身に付ける機会が必要になる。この点は、例えば医療の分野とか介護の分野とか、そうした明らかに専門技能を要求される職業のみでなくて、行政組織にも言える事かと思います。
法令を施行してしまえば、その日の執務開始時刻から直ちに質量伴に十分に兼ね備えたスタッフが、無条件に突然窓口に現れるなんてのは幻想ですから。
貧困と犯罪、セイフティネットの網目の裂け目、体感治安の悪化、偽装天国と調査能力ゴタゴタ、規制緩和と事後審査型社会が生んだ新ビジネスモデルと新貧困層、人手不足と予算不足、事後是正より事前予防が合理的……。これらに共通する課題は、ヒト・モノ・カネ・情報の乏しい「リソースの適正配分」が、今こそ一番求められているような気がします。
この国において、長期的視野に則った、効果が現れるのに数年の単位の時間の経過が必要な改革が、必要とされているにも拘わらず、実現されていない理由は。。。と問うたときにその答えとして。
＃「悪いことは、水に流して、明日になれば全て解決」的な、短期且つ急速且つ目に見えて著しい変化が生じないとガマンできない国民性にある。つまり、長期的な視点に則り、効果が現れるまでに数年の単位が必要とされる施策は、その効果が現れてくるまでの数年間を耐えることが出来ない国民性を持つこの国では、実行不可能である。
という見解を、目にしたことがあります。真偽の程は解りませんし、賛否の価値判断は私如きには俄には難しいのですが、こういう見解も世の中にはあるのだという事で、お願いします。m(__)m
政治を大衆による「参加の幻想」の産物とみるか、選良のフィードバックを主権者国民が負担するとみるか、それとも（以下略。
政府の役割、政府の責任を主張する人は数多くいるのですが、そのために必要なコストというものがある事を忘れている人が多いように思います。
医療費に例えれば、「医療費を増やす」事にはみんなが賛成すると思いますが、「医療費を増やすために税金を上げる」事にはみんなが反対するのが日本の現状だと思うのですね。
多くの日本人は、「政府が医療費を増やそうと思えば、医療費は増えるもの。そうしないのは政府が悪い。お金は天から降ってくる」と思っている方が多そうな気がするのです。なお、医療は、教育とか社会福祉、介護に読み替えてもらっても構いません。
名古屋市長選で、住民税を減額することを主張した候補が当選したことに対し、暗澹たる思いを抱いてしまいました。

The new Zune browser is surprisingly good, but not as good as the iPod's. It works well, but isn't as fast as Safari, and has a clunkier interface.
