再審無罪がほぼ確実な情勢にある足利事件においても、取調べにおいて受刑者（当時は被疑者）に暴行が加えられたことが主張されています。
取調べは密室で行われますから、取調べ担当者が否認すれば水掛け論です。
このような事態を避けるためには取調べの全面録画が有効かつ必要であるということは多言を要しないところです。
この全面録画に対しては、取調官と被疑者との信頼関係の構築の妨げになるというような反対論が主張されています。
しかし、この問題は克服不可能な問題ではないと思います。
それより問題なのは、録画された情報の情報管理の問題です。
情報管理が徹底していて、取調室で話したことが知られるのは限られた人（例えば、裁判官（裁判員）、検察官、弁護人）にだけだという信頼感があれば、取調官と被疑者との信頼関係の構築についての影響は最小限度にとどまると思われます。
取調官と被疑者との信頼関係の構築の問題は、副次的な問題です。
主要な問題は、やはり被疑者のプライバシーと取調官のプライバシーと事件関係者のプライバシーだと思います。
私は以前に「取調べの可視化の問題点」というエントリを書いています。
取調べ過程においては、本当に被疑者の命にかかわる話や、新たな紛争の火種になるような話、その他公にされることが適当でない話が出ることが珍しくありません。
そのような話は、調書に記載されないことが多いのです。
ところが、全面録画をしますと、被疑者が口にしたことは全て記録されます。
そのような情報が、取調べの可視化の目的を超えて流出しないようにきちんとした対策が取られる必要がある、というのが現時点の私の主張です。
小倉秀夫弁護士は、この問題について、「取調べを録画したビデオは一般公開されるわけではない。」において
だって，取調べの全面録音録画の義務化論者だって，録音録画したものを一般に（あるいはマスメディアに）公開することまでは主張していませんから。
と言ってプライバシー侵害の心配がないかのように主張しています。
たしかに手続上は、一般公開など予定されていません。
しかし、一般公開されていないはずの情報が一般（例えばマスコミ）に流出することなど珍しくもなんともありません。
全面録画した情報をどのようにして誰が用いるのかについても議論の余地があります。
弁護人に複製を渡すというのであれば、弁護士事務所の情報管理体制が問われます。
信頼できる弁護士ばかりとは限りません。
法廷で再生することも考えられますが、そうなると傍聴人に取調室のやりとりがわかる可能性が出てきます。
傍聴席に記者がいることは珍しくありません。
取調べの任意性が問題になった場合には、検察官や弁護人が取調べ時の発言内容に基づいて質問する場面も想定されます。
このように、調書にはなっていないが取調べのときに発言した内容が外部に漏れる事態は容易に想定されます。
いじめっ子ABC、いじめられっ子D Dは、ABCの命令で、万引きしました Dは、ビデオの前で、「ABCに命令されました」 言えるでしょうか？とのことですが，「ビデオの前だと」いえない理由は乏しいですね。ビデオがまわっていようといまいと，その後，ABCに捜査の手が及ぶことがあれば，Dが取調官に対して，「ABCに命令されました」といっていたことが普通にわかるわけですから。
秘密保持に対する絶対の信頼がない限り、ビデオカメラの前だと絶対言えない、という事柄はあります。
私が言いたいのは、だから可視化をやめろ、ということではありません。
そういう事態もあるということを織り込んで可視化の制度設計をするべきだ、ということです。
取調べの全面録画は、それが確実に実行されている限り、冤罪被疑者の虚偽自白や任意性のない自白を防止する最も強力な手段の一つですが、その反面として真犯人である被疑者の口を重くする要素になることも否定できないところです。
虚偽自白を防止しつつ、真実の供述を得るためには、全面録画を行いつつ情報管理の徹底を図ることが重要だと考えています。
追記
小倉秀夫弁護士が、「般公開されていないはずの捜査情報が流出する経路」（ママ）でずいぶん的外れな反論らしきものを述べています。
私は、

このように書いて調書化されない情報の漏洩について問題にしたのですが、小倉弁護士はなぜか調書の内容の流出について問題にしています。
あの人はどうして人の文章をまともに読めない（または読まない）のでしょうか？
全面録画でちょっと分からないところがあるので書きます。
これは全部強制でしょうか、それとも一部あるいは全部を拒否できるのでしょうか。
拒否できるとしたら、拒否する場面は録画するのでしょうか。それともその拒否の場面の録画も拒否できるのでしょうか。
逮捕勾留された人だけでしょうか、それとも逮捕勾留されていない場合も含むのでしょうか（鹿児島の選挙違反とか逮捕前に自白しているようですし）。
取調室以外で取り調べる場合もあるようですが、（例えば交通違反で車内で取り調べられるのも、取り調べですか？）、その場合も録画するのでしょうか。
録画しない取り調べは許されるのか許されないのかが分かりません。
外部流出の可能性の点は、複製を認めないようにすればいいかと思いますが、それでは弁護士さんは反対するでしょうね（どこかに行って見なければならなくなるから）。
法廷での上映は、傍聴席に見えるスクリーンには映さず、裁判官や裁判員のモニターだけにし、音声はイヤホンで聞くようにすればよいでしょうが、法廷がシーンとなって分からなくなり、マスコミが猛反対しそうですが、何かいい方法があるでしょうか。
ご指摘のような問題が当然出てくると思います。
録画拒否を認めるとなると、その拒否の任意性が問題になったりする恐れがありますので、拒否は認めるべきではないという考えもありますが、被疑者が明確に拒否した場合にその意思を無視していいのかという意見もありそうです。
弁護人の同意があれば録画しないという方法もありそうですが、そうすると弁護人に後日法廷で任意性を争えないという効果を付与しないといけないでしょう。
結局、録画の範囲を制限しようとすれば何らかの司法取引とリンクする必要があるのではないかと思われます。
ここで言う司法取引というのは、アメリカで行われている典型的な司法取引を意味しているのではなく、検察官と弁護人との合意になんらかの拘束力のある効果を与える制度を意味しています。
録画の対象範囲も悩ましいですね。
全面録画の考え方を徹底すれば、身柄拘束の有無を問わず、全ての取調べ全面録画が必要ということになりそうですが、これを制限しようとすれば、やはり司法取引の問題が生じそうです。
自白の任意性を争う事件はあらゆる場合に生じますから、軽罪だから、とか、最初から認めている、というような理由で必要がないとは言い切れません。
全ての事件について、同様に自供の任意性が確認される必要があると思います。
追記しました。
取り調べ全面録画について、即座に無条件で録画を開始すべきだと主張される方々の理屈は、次の通りかと思う。
◇被疑者弁護側は、全面録画により自白の任意性を争う有力な手段を獲得でき、検察主張に対する強力な防御権を入手出来る。これは現状では検察側の攻撃に対して一方的に弱い立場の被疑者弁護側には、非常に有力な防御力を付与することになる。
これに対してモトケンさんが仰る、司法取引制度の導入とのバランスの問題という主張は、次のように整理できると思う。
◇全面録画は導入すべきだが、被疑者弁護側が強力な防御権を入手する結果、現状の刑事司法制度での攻撃＆防御のバランスに大きく影響する。その傾いたバランスのカウンターとして、被疑者弁護側が犯罪事実を認めて争わない場合、検察捜査側の立証義務を軽減する「司法取引制度」を導入するなどし、捜査側の過度の負担を減らす制度新設とセットであるべきだ。
◇現状の検察捜査側に詳細な立証義務を課す刑事司法制度のままで、さらに被疑者弁護側に反証防御アイテムを付与すると、攻撃と防御が対等という司法制度の根源のバランスが崩れるおそれがある。
すなわち、前者の現状のままで即時無条件での全面録画導入派は、検察捜査側の攻撃力と被疑者弁護側の防御力のバランスが、被疑者弁護側が弱い非対称の状態にあるとの現状認識を前提にしての論理構築と思える。
翻ってモトケンさんは、検察捜査側と被疑者弁護側の攻撃と防御については対等となるように設計されており、現状も概ね対等のバランス状態であるとの認識を土台にして、全面録画導入と司法取引制度導入をセットにしてバランスを維持すべきだとの論理構成と思える。
要するに両者の立脚点の違いは、現状の刑事司法制度では対等でないアンバランスの状態なのか、或いは現状は完全な対等じゃないかもしれないが一応バランスは取れているとするのか、その認識の違いが本質じゃなかろうか？
ゼロから制度設計するという話になっているように見えますが、既に実施している国がたくさんあるんですから、95%パクリ…いや、参考にする前提でいいのではないでしょうか。
業界では「車輪の再発明」と言います。
私の考えはちょっと違います。
取調べの全面録画が必要だと考えると言うことは、制度改革の必要があるということであり、それは現状の制度のバランスが崩れているという認識が前提にあります。
天秤の例え話で説明します。
現在は天秤が右に傾いているとします。
全面録画を採用するということは、左側のお皿に全面録画というオモリを乗せることを意味します。
それでバランスが取れればいいのですが、私の認識では、それだけでは今度は左に傾きすぎてしまうのです。
そこで、なんらかの方策によって右側のお皿に少しオモリを乗せてバランスを取る必要がある。
というのが私が考えです。
左側のお皿に全面録画という重りを乗せればそれだけでバランスが取れるという考えの人がいるようですが、私はそうではないと思っています。
モトケンさん応答ありがとうございます。

・その反対側への傾きは、従来の被疑者弁護側が少々不利の傾きよりは大きくなり過ぎ、刑事司法制度の公平のバランスが大きく崩れるので問題だ。
・故に全面録画導入での反対側への傾きモーメントを打ち消す適当な反対側の錘りが必要であり、そのバランス取りの錘りとして適当と思えるのが司法取引制度の導入である。
モトケンさんの№6を受けて修正すると、私にはこんな理解となりますが。
考え方としてはそんな感じです。
ただし、司法取引と言ってもいろいろな制度が考えられます。
ものによっては国民意識としてかなり抵抗がありそうなのもありますので、抵抗の少なそうなものから順次導入ということになるのではないかと思います。
全面録画の問題については、録画情報の目的外使用の規制をこれまでより強化するというのもオモリの一つだと思います。
柔軟な発想が必要なります。
私の修正理解が概ね妥当とのことで、少し自信がつきました。

これは私もその通りと思います。
ロッキード事件でのコーチャン証言の際には、コレコレを喋ればオマエは訴追しないという保証を出せ、出せば証言する。イヤそんな司法取引制度は日本の刑事訴訟法上認められていないから、事前に保証は出せない。という日米間の遣り取りが行き交った結果が「嘱託尋問調書」であり、その調書の証拠能力を否定した最高裁判決が思い出されます。
ただ日本の刑事司法制度の中に、司法取引的な考え方が全くないのかと問うならば、略式起訴の制度などはどうなんでしょうか？
略式起訴では、犯罪の事実を認めることを条件に、懲役や禁固などの身柄拘束を伴わない罰金刑を保証しています。しかも略式起訴に応じれば即決裁判となり、刑事被告人としての不安定な身分での社会的不利益からも速やかに解放されます。
この略式裁判の制度などは、まさしく司法取引の一形態だと思うのですが･･･。
＞略式起訴の制度などはどうなんでしょうか？
細かいことを言って恐縮ですが、「即決裁判手続」ですね。「略式」というと「略式請求」を指すのが一般的です。
第四章 即決裁判手続
第一節 即決裁判手続の申立て
第三百五十条の二 検察官は、公訴を提起しようとする事件について、事案が明白であり、かつ、軽微であること、証拠調べが速やかに終わると見込まれることその他の事情を考慮し、相当と認めるときは、公訴の提起と同時に、書面により即決裁判手続の申立てをすることができる。ただし、死刑又は無期若しくは短期一年以上の懲役若しくは禁錮に当たる事件については、この限りでない。
第四節 公判の裁判の特例
第三百五十条の十三 裁判所は、第三百五十条の八の決定があつた事件については、できる限り、即日判決の言渡しをしなければならない。
第三百五十条の十四 即決裁判手続において懲役又は禁錮の言渡しをする場合には、その刑の執行猶予の言渡しをしなければならない。
第六編 略式手続
第四百六十一条 簡易裁判所は、検察官の請求により、その管轄に属する事件について、公判前、略式命令で、百万円以下の罰金又は科料を科することができる。この場合には、刑の執行猶予をし、没収を科し、その他付随の処分をすることができる。
私は、「取調室で話した調書以外の内容が、被疑者本人の意志に反して外に漏れる事がない」という供述の秘密性が、よく捜査官が可視化に対する抗弁として口にする「被疑者との信頼感」の本質であると考えています。
つまり、いくら取調室内で、被害者や関係者に対して暴言を述べようが、ヤクザが親分の秘密や組の犯罪の情報を提供しようが、秘密にしている趣味の話をしようが、弁護士の悪口を言おうが、事件に関係ない自分のプライベートについて話そうが（全て私の経験です）、取調官は、供述調書以外の形でそれを外部に持ち出すことはないし、被疑者がそれを口にしたとも言わないから、そのような言動が自身の不利益にはならない安心感がある。
また、当初は体面や減刑を期待した否認から自白に転じても、「否認していた事」が調書化されていない限り、被疑者の不利益となる事もない。
まあ「取調官と被疑者は必ずしも対立している訳ではない」という事実が認識できない方には理解不能でしょうが。
勿論、取調室内でのやり取り全てを公開し、供述の任意性や自身の無実を争いたいという被疑者もいるでしょう。
また捜査機関側としても、被疑者の変心により、供述をひっくり返されたり、事実無根の暴行脅迫を主張される事を防止し、取調べの適正さと供述の任意性を担保するためには、全ての事件において、身柄拘束中の被疑者（任意被疑者も含む）に対する取調べの全過程を録画する必要性が認められます。
では、前述のような「取調べで話した内容全てが公開されては困る被疑者」の権利を保護するためには、どのような対策が必要か？
最も簡単な対策としては、被疑者本人（被疑者弁護人に非ず）に「録画記録の開示を拒む権利」を付与することが考えられます。
開示を拒否すると言うことは、調書の内容とその作成過程に異議を申し立てない、と言えますから、事実関係を争わず自己の罪を認めることになります。
この自白認容により刑罰を減じる事になれば、事実上の司法取引と言えるでしょうが、そこに至るまでにはまだ議論が必要でしょう。
また、取調べの可視化の実現には、流出への対策が必須であると言えますが、これは現在のところ、全記録の視聴権限を裁判官、検察官、弁護人に制限（個人的には裁判官のみに限定したいのですが、あまり現実的ではないので）する、閲覧場所を裁判所に限定する、故意、過失に関わらず記録を流出させた者には禁固を含む厳しい罰則と流出による被害を受けた者に対する損害賠償責任を負わせる、くらいの対策しか採れそうにありません。
流出を物理的に防止する方法があればいいのですが。
とりあえず関係者のプライバシーを保護しつつ、取調べの機能を大きく阻害しない範囲で簡単に考えてみました。

感熱紙さんのコメントで重要なところは「必ずしも」の部分です。
つまり、いろいろな場合があるということです。
それなのに、一つの場合だけ（例えば、取調官と被疑者が対立している場合だけ）を前提にして議論を始めると、現実の制度設計論としては使い物にならない議論にしかなりません。
もちろん、取調官と被疑者が対立していない場合だけを前提にして制度設計論を述べるのも大間違いです。
どちらも想定して、どちらの場合にもできるだけ適切妥当な結果が得られるような一つの制度を作ろうとしているからこそ悩みが深いわけです。
残念ながら、異なる二つの場合に適用される二つの制度を作って、二つの制度を使い分けて運用することはできません。
なぜなら、神ならぬ人間としては、二つの場合をいつも正しく区別することができないからです。
横レスになってしまいますが，
実のところ「略式で済ませてやるから」「即決にしてやるから」というようなことを言って約束し，そのうえで自白させれば，現行法の下では，ほぼ確実に自白調書の任意性が否定されるんじゃなかろうかと思います。
約束自白，ってやつですね。「起訴猶予にしてやるから」と言って自白させた事案で，任意性が否定された事例があります。
こういう判例がある以上，それらの制度が求めるのは，
必死で取調べして自白してもらって，それから調書に署名してもらって，それでやにわに，「こういう制度があるんだけど。」というものです。ここが司法取引と違うところです。
容疑者の心中では，こうすればこうなるかも，みたいな期待は常にあるでしょうが，捜査官の側から持ちかけたり匂わせたりしてはいけないのです。少なくとも建前上は。
そして，容疑者の方も，特に慣れている容疑者であれば，法制度化されていない以上，捜査官の約束をたやすくは信じないはずです。
ま，似てるんですけどね。ただ，捜査官の武器にはならない状況だ，というふうに思うのです。
弁護人の立場で言えば、次のような場合がとても多いのです。
接見してみると被疑者はこう言います。
それを聞いた弁護人は、事案から見て略式罰金で済むと思って主任検事に面談してこう言います。
すると、主任検事はこう言うのです。
その結果、最悪の場合は２０日間勾留されて略式罰金になるわけです。
被疑者に正式裁判を請求する意思など全く無い場合であっても。
そして、会社を首になってしまいます。
現場の感覚が分かるコメント、ありがとうございます。

暴力団や外国人犯罪組織などの捜査を考えると、弁護人には見せたく無いですね。
そう思う被疑者は多数いますからね。
とりあえず、リンク先の小倉先生の文章は、重要かつ正当なご指摘ですね。
取調べの可視化により被疑者等のプライバシーがマスコミ等に一般公開されるかのような誤解があるようですが、その辺は弁護人が責任をもって管理することになっており、記録媒体の目的外使用には罰則が置かれます。
少なくとも

と「＝」でくくられるのは明らかに誤解ですので、これを訂正されるのは正当です。
弁護人が、誤って又は犯罪的意図を持って取り調べ過程を外部に流出させる異常例外的な事態も全く考えられないことは無いでしょうが、まずは原則論で、野放図にプライバシーが侵害されるかのような誤解を解くことが先決だろうと思います。

ところが限定的（起訴されて自白の任意性を争う被告人）とはいえ、法廷で録音録画ＤＶＤを取り調べると傍聴人と傍聴したマスコミに漏れる点は頭が痛いので、そこは取調べ方法を原則的に考える必要があります。
なぜなら、証拠物は展示で（録音録画は再生というのが通説判例）法廷で取り調べるのが現行法の大原則だからです。これは憲法が保障する裁判の公開原則に由来するものなので、原則論の段階で憲法解釈の詰めも必要かと愚考します。
なぜ、罰則が置かれるようになったか考えましたか？
刑法１９９条があるからといって殺人事件はなくなりません。
誰が、取調べの可視化 ＝ 被疑者のプライバシーの侵害と「＝」でくくっていますか？
その異常例外的な事態が生じた場合に深刻な結果が生じる恐れがあるので、その恐れに対して何も対策を講じないわけにはいかないだろうと言ってるんです。
調書の内容が目的外使用されるのも異常例外的な事態ですが、そのような異常例外的な事態の発生の可能性が看過できない状況が生じたから、記録媒体の目的外使用には罰則が置かれたんです。
そしてそのような法改正に日弁連は抵抗し切れなかったばかりか、「開示証拠の複製等の交付等に関する規程」を定めなければならなくなったんです。
取調べに対する供述内容というのは、本来的に高度のプライバシーを含むものであるというのが原則論であると考えます。
その内容の公開が正当化されるのは、適正は刑事司法の実現と被疑者・被告人の利益のためという理由があるからであり、その場合でも被疑者・被告人以外の者のプライバシーに対する配慮は必要だと思います。
う～ん、これまでは物理的にあり得なかった、「取調べの過程における、調書にはなっていない会話内容が意図しない形で外に漏れる」という事態が、取調べの可視化によって現実に発生しうる状態となったのですから、それがまるで発生し得ないかのような（あるいはその可能性が誤解に基づく杞憂であるかのような）説明は不適当ではありませんか？
原則論で言うなら、被疑者や関係者、取調官のプライバシーや生命・身体・名誉を害する可能性のある情報が、意図しない形で外部に流出する可能性が僅かであれ（個人的にはかなり高いと思いますが）存在するのであれば、それが防止できる制度を提示する方が優先されるべきでしょう。
ついでに、モトケン先生が本エントリで防止策を検討する必要性について述べた事に対する小倉弁護士の反応は、「調書の内容は法廷で公開されるじゃないか。調書の内容をマスコミに流している捜査機関が悪い。そっちの方が問題だ。」という完全に的はずれな反応です。
私は組織犯罪対策部門が長い（というか捜査はそれしか経験したことがない）せいで、どうしても「弁護人の行為が必ずしも被疑者の意志を反映しているとは言えない場合がある」ことを想定してしまいます。

まあ、正直に言うなら、「ＫＴ先生説明不足ですよ」ですがね。
取り調べ全面録画は望ましい制度だと思うんですが、この制度が施行された場合、弁護士は、取り調べの模様を最初から最後まで見るという事になるんでしょうか。
例えば、取り調べの速記録を作り、警察の調書と付き合わせて矛盾点を付くとか、「違法取り調べ」というものの客観的な評価基準を作るとか。
制度が出来たは良いけど、出来た後の弁護士の方が苦労しそうですね。ツールは増えたけど、使いこなすことが難しいのかという印象です。
「取調べの過程における、調書にはなっていない会話内容が意図しない形で外に漏れる」という事態は、「少なくとも物理的には」あり得たでしょう。捜査機関側から調書に記載されていない事項が漏洩する可能性は否定できないはずです。
物理的にはともかく、現実的にどうだったかというと、よくわからないのですが、どうなんでしょうか。
捜査機関が裁判以外の場で情報を公開する場合、記者クラブへの発表（記者会見、FAX等）といった正式なものと、いわゆるリークがあるのだと理解しています。
リークの場合に、捜査機関は、調書に載っている情報しかリークしないように気をつけるものなのでしょうか。
正確な検証は不可能と思いますが、率直に実態をうかがえませんでしょうか？（「リークなどない」ということでも結構です。）

捜査機関から、捜査の進行状況や事件に関し判明した事実（と主張する事象）がマスコミに広報される（いわゆるリークされる）ことがあるのは事実です。
しかし、その内容は小倉弁護士が述べるように、「事件に関連し、一般公開されていなくても、いずれ公判で明らかとなるもの」です。
ミラーマン氏の自宅から捜索の結果痴漢もののＡＶが多数見つかった、とか、某氏の疑惑に関する現時点での裏付け情報などはその典型です。
勿論捜査機関による、捜査情報の事前リークの是非については議論があるでしょうが、それと取調べ可視化で発生し得る問題とは直接関係しません。
モトケン先生や私が問題視しているのは、被疑者（や取調官）が口にしているが調書化されていない、あるいは公判で明らかとなることはない情報が映像という事実の裏付けと共に公開される危険性です。
調書化されていない、ということは、現状は公開を望まないということです。
簡単に言うのなら、黙秘被疑者の取調べについて、「取調べには応じないが、雑談には応じている」の「雑談」の内容の部分です。
ちなみに、捜査機関のリークは基本的に「捜査機関が事実だと主張するもの」ですが、取調べの映像で明らかとなるのは「被疑者がそう言ったという厳然たる事実」です。
違いがおわかりになりましたか？
某著名証券トレーダが、記者会見でＴＶカメラの前でインサイダ取引を認めてしまい、後に捜査や公判で否認するのに苦労したのは記憶に新しいかと思います。ＴＶなどのＤＶＤ映像で明らかとなるのは「◎◎◎がそう言ったという厳然たる事実」です。想定した可能性ではないですよ。
私が No.19 で記載しているのは、
「小倉先生のコメントは「赤いスペード・黒のハート」さんの記事に対する言及として書かれているので、当然その言及先との相関関係で評価されるべきである。」
ということです。
可視化によって野放図に被疑者のプライバシーが一般公開されると考えている方に、「そのような野放図な公開ではない制度が志向されているんですよ。」ということを指摘すること自体は必要かと思います。
「小倉先生の指摘はとりあえずごもっともであるが、一歩先に進んだ話としてこういう問題点がある」という趣旨で議論が進んでいるのであれば、大変結構です。

が、どうも私のコメントを誤読なさっているようで、かみあってません。
公判前の情報開示を、私は二つに分けて理解しています（前のコメントで申し上げました。）。正式な広報活動と、リークです。
私はリークについて聞きたかったのですが、感熱紙さんは正式な広報活動についてコメントされているように思います。
正式な広報活動は、たとえば東京地検の次席検事が記者会見で捜査情報を発表したりする場合とか、警察から「こういう事件が発生しました」というFAXがなんたら記者クラブに流れてくる場合を想定して言っています。こういう場合は、責任の所在がはっきりしていますから（だから「リーク」という言葉は不適当だと、私は思います。）、調書になっていない（後でひっくり返りかねない）情報を避けるのだろういうことは分かります（感熱紙さんのコメントはそういう趣旨と理解しました。）。
「公開を望まない」のは誰でしょうか？
取調官と被疑者のどちらかだと思いますが、いずれにしても意味が取れません。
取調官だとすると、取調官は「現状は公開を望まない」情報を調書に書かず、そうでないものは調書化する、ということなのでしょうか。そんなヘンテコな基準で調書を作っている取調官は、あんまりいないと思います。
被疑者だとすると、被疑者が公開を望まない事項が調書化されることはいくらでもあるでしょうし、調書に書いてない「雑談」の中に公開しても差し支えないことが含まれていることもあるでしょう。
それは結構ですが、私がお尋ねしているのは、現行制度下における実態です。
なぜそれを聞くのかというと、捜査機関がどのような情報をリークするのかということがわかれば、将来の制度設計の参考になると思うからです。
はい。
ですから、リークの際に、感熱紙さんのいう「雑談」部分はリークの範囲から除外するという実務慣行があるのか、その点を教えていただきたかったのです。
残念ながら、感熱紙さんのコメントに、私にとって新しい情報は何も含まれていませんでした。
ところで、「これまでは物理的にあり得なかった、「取調べの過程における、調書にはなっていない会話内容が意図しない形で外に漏れる」という事態」という感熱紙さんの表現は、間違っていると思うのですが、その点について異論はございますでしょうか。
コメントをいただけるのであれば、その際には、公判前の捜査情報の公開すべてを指して「リーク」というのか、それとも、記者会見等の正式な広報活動以外のものをリークというのか（これは私の用語法です。）、明示していただくようにお願いいたします。私のいうリークと正式な広報活動は区別できない、というお立場なのであれば、それはそれで結構です。

取り調べ中の暴行を防ぐという意味では、とりあえず音声無し、画像のみ録画で始めてみたら良いのではないかと思うのですが、如何でしょうか。
それはなかなかよいアイデアかも知れないと思いますが、暴行の有無だけの判断ならいいのですが、それを超えて顔の表情などといった極めて曖昧な情報が任意性判断のために用いられることになりますと、判断を誤るおそれもあるような気がしますので、立証趣旨を暴行の有無に限定する必要がありそうです。
任意性に疑いを生じさせる原因は、カメラに写る客観的な暴力より、言葉の暴力のほうが多いように思います。
音声なし録画は、しないよりはましだとは思いますが、費用対効果的に見るとどうかな、というのが正直なところです。
その昔、取調室で暴れて逃走を図り、窓から逃げようとして陰部を窓の留め金に引っかけて重傷を負い動けなくなり逮捕された米国ＸＸＸ州の犯人の防犯カメラの映像が、世界の◎◎という特番で放映されていました。
防犯カメラなので音声がなく、公判では、犯人と警察官がどのような暴言や苦悶の声を口にしたかが法廷で争われたとナレーションに出てました。
類似事案のご参考まで。m(_ _)m
横合いからですが、その事象を「取材する側」の視点から考察してみると多少違った姿が見えてくるかもしれないと思います。
同時に、警察機関も官公庁のひとつですから、他の行政官庁に関わる「リーク」・・・つまり公報が行われる前にマスコミが報じる各種ニュースと対比してみることも一興かと思います。
さまざまの人事案件や日銀の金融政策や米価等々「それ」が公報以前に世間公知となることは多かれ少なかれ関係方面に影響を及ぼします。
何が言いたいかというと警察“リーク”だけをことさらに「問題視」するのは、正しくないのではないかとの論点提起です。
録画時に音声無しにするのではなく、
公判時に音声のオンオフをすればいいんじゃないでしょうか。
必要なところをオンにして、プライバシー上問題がある時はオフにするとか。

いいえ、私はリークも含めた捜査機関によるマスコミに対する情報提供活動全般に関して述べています。確かに噛み合っていませんね。
どうも私の文章が宜しくないようで・・・
捜査機関の広報活動に関しては、「正式な広報活動」と「リーク」を分ける基準が明確でないのです。
少なくとも最近の警察においては、個別の事件に関してマスコミの取材に応じることができる職員は次席級幹部と許可を得た捜査幹部（警察署刑事課長等）のみと規定で定められており、それ以外の職員が事件に関して許可無く取材に応えることは禁じられています。
間違っても取調官が、自身の取調べについてその内容を自らマスコミに語ると言うことはありえません。
要するに、新聞などに載る「ある捜査幹部によると～」などという記事は、記者会見などをしていないだけで、普通に広報担当者に取材した結果を書いているに過ぎないのです。
これは、被疑者にとって好ましくない内容が調書に含まれている、ということではなく、被疑者が自身の供述であっても、それを調書化する（公開される情報となる）ことを容認していない状態のことを指しています。
簡単に言えば、被疑事実を認めているけどそれを調書にする事に躊躇しているような場合で、暴力団事件や薬物関連の事件では、メンツや組織の都合で頻繁に発生する状況です。
捜査機関がリークする情報は、取調べにおける「事件に関する」（取調官から報告されている限りの）供述内容の要旨、捜査の結果判明している事実（と主張する事項）に限られています。
むしろ、事件に関係のないプライバシーなどをリークしているという事実を地蔵さんがご存じならば御呈示願います。
何処が間違っているのでしょうか？
是非間違っている点をご指摘下さい。
これまで、マスコミ等が入手できる取調べの内容は、事実の認否であっても「被疑者がそう言っていると（取調官から）聞いている」という伝聞であり、言い換えれば捜査機関側の主張でしかありません。
そして、マスコミに流すことが可能な情報は、事件に関して捜査幹部に報告することができる程度にまとめられた、取調べに関して言うなら調書化されている情報がほとんどです。
しかし、可視化された映像が流出すると、映像という物理的な根拠を持って、事件に関係あろうが無かろうが、被疑者が望もうが望むまいが「被疑者がこう言っているという事実」が明らかとなります。
この違いはかなり大きいと思うのですがいかがでしょう。
まあ、地蔵さんがすべてご存じの情報ならこれ以上のベル必要はないでしょうが。
あ、言い忘れましたが、私は、捜査機関による捜査情報のリークについて、問題がないというつもりも、正当化するつもりもありません。
ただ、捜査機関のリークと取調べの可視化により発生し得る流出被害を比較して、「リークの方が問題だから～（流出被害の対策を論じる必要はない）」というような主張を認めることはできないと言いたいだけです。
取調べ全面録画にしろ、取調べ全時間立会にしろ、ＤＶＤを全部見る時間も、立会全時間も、国選弁護費用にタイムチャージ方式で加算するのが当然だと思います。そうでないと制度が画餅に帰してしまいます。
もちろん弁護人がどちらからで知りえた秘密や個人情報は、開示記録と同じで、弁護人は守秘義務を負うはずですから、信頼できる普通の弁護士先生ならリークは問題にならないと思います。
万が一リークがあったら「ヨコベン調書写しマスコミ売却事件」のように、弁護士会が除名を含めた厳しい懲戒処分を下すはずですし。

空気が読めなくてすみませんが、録画したものは毎回裁判で見る必要があるのでしょうか？
調書がまずあるわけですから、通常は調書のみで進めて、被疑者がその調書に異議を申し立てたとき、被疑者の同意の上で公開でいいような気がしますが？（警察側の要請では公開不可）
あと、録画に関しては、警察および被疑者又は弁護側の人間が署名による封印を行えばリーク問題も減るとおもいます。
取調べＤＶＤ録音録画は、弁護人の取調べ立会に代わるものですから、原則として、弁護人は（証拠開示と同様で）全部見て違法な取調べがないかどうかチェックする権限があると思います。違法捜査を見逃したら、弁護過誤で被告人に訴えられるリスクもあると思います（米国では公設弁護人が取調べ立会中に違法な取調べを見逃したとして弁護過誤で元被告人から訴えられることもあります）。
コストアップついでなら、裁判官に対する接見の可視化も裁判の正確さや冤罪防止に効果有りですね。
でも裁判員には秘密保持の観点から、やはり見せられ（見たくも）ないと思います。

「公開」というのは問題がありますが、基本的には被疑者がその調書に異議を申し立てたときに録画を見ればいいかな、と思います。
しかし、富山の冤罪強姦事件のような場合（公判でも自白を維持した）もありますので、異議の有無（本当にないのか）について、事件全体の証拠関係によっては慎重な検討が必要になる場合があると思われます。
被疑者・被告人の言葉を鵜呑みにできない場合があるということです。
私も悩みは同じで、富山法廷自白一審確定再審無罪事件まで射程に収めると、その制度設計では弁護人の負担が課題となり、著しいコストアップになるのが悩みの種です。しかし富山冤罪事件こそ、取調べ全面録音録画ＤＶＤや弁護人全部立会だったら防げたはずで防がなくてはいけないし……。
私も似たようなことを考えていました。
本人が自白の任意性に異議を申し立てたときだけ、録画の確認をすれば良いだろうと。
そのときも、検察・弁護側がそれぞれ事前に確認し、任意性、あるいは誘導や拷問（言葉によるものも含む）を問題にする部分だけを抜き出して、検察側・弁護側がそれぞれ主張すれば少しはましかなと、あるいは”ピー”を入れるとか（笑い）。そうすれば時間短縮にもなるし...
全面録画は必要でも、全部法廷で明らかにする必要もないし。
そもそも取調官も全面録画されていて、それで任意性を争う可能性があるとなれば、それだけで大きな違法取締りの抑止効果になるでしょう。また被疑者側も任意性を争う確かな証拠があるわけですから、富山県氷見町冤罪事件のようなケースも防げるのでは。それでもその確立はゼロにはなりませんが、モトケンさんの台詞じゃないですが、完璧な制度設計は無理なのだし。

録音録画ＤＶＤを法廷で全部取調べろという意見は藁人形を除き誰も主張していません。しかし、弁護人は開示証拠の熟読同様に、上記ＤＶＤを全部チェックしないと違法捜査を見過ごす危険があります（弁護過誤の芽）。つまり弁護人の負担は増えますが、違法捜査や取調べの任意性が争点とならない限り、公判への影響（長期化）はありません。もちろんＤＶＤが一般に公開されることもありません。
「証拠開示」と「法廷での証拠の取調べ」を混同される方の見解は、学部レベルの刑事訴訟手続きの基本をおさらいするとよろしいかと思います

前面録画されたDVDにも、目次がついており、何月何日何時というのが、簡単に再生できると思います。だから、弁護人も重大な争いがあれば別ですが、そうでなければ、要点を比較的短時間にチェックできると思います。

なぜ取調べの全面録画が必要かと言いますと、ある時点の供述はそれ以前の取調べの影響を受けている、からなんです。
また、ある時点で供述した内容をその後変更したのに取調官が聞き入れなかったという場合もあり得ます。
となると、取調べの最初から確認する必要が生じますし、最後まで確認しないと安心できません。
そして、自白の任意性が問題になるのは、何も無罪を主張する場合だけとは限りません。
重罪が予想される事件（究極の場合として死刑か無期かが問題になる事案、実刑か執行猶予がつくかが微妙な事案など）では、情状面に関する自供（計画性の有無や首謀者は誰かなど）の任意性や真偽が重大問題として浮上します。
となると、弁護人が取調べの全過程を検証しなければならない事件というのは相当数にのぼることが予想されます。
取調べ全面録画の次に、ぜひ２４時間監視システム録画も検討してもらいたいですね。
取調べ全面録画が採用されると、取調室以外での「ささやき」が多用されそうな懸念があるので。
でも、ますます検証に時間が掛かるようになりますね。
6月14日は24時間あるはずなのに１分間欠落している。とかビデオの速度が1439/1440に減速されていて、１分が隠されてるとか。

そもそも、録画録音をやるとしたら、スーパーなどと同じ一箇所での録画録音一元管理で行わないと、管理出来ないと思いますよ。（それこそ不注意による録画忘れが多発しかねない）
もちろん、天井、壁、床、1ｍピッチで超小型カメラを配置して一元管理ですよね。ストレージ価格も低下の一方だし。
それに加えて、全捜査員に「取調官レコーダー」の着装を義務づけましょう。
そしてそれだけだと、「捜査機関が画像を改変した」という苦情が出るでしょうから、被疑者の視点から捜査機関の動きを監視する「被疑者レコーダー」も取り付けましょう。
で、その記録はすべて裁判所が一元管理するということで。
