この略式裁判の制度などは、まさしく司法取引の一形態だと思うのですが･･･。
と述べられましたが、被疑者または弁護人の同意によって、本来よりも手続を簡略化できるという意味で、私も広い意味での司法取引と言っていいと思います。
略式手続の概要についてはウィキペディアを紹介しておきます。
簡単に言うと、検察官が罰金１００万円以下の刑罰でかまわないと思う軽罪で、被疑者が犯行を認めており、簡単な手続で裁判を受けてもかまわないという同意をすれば、正式な裁判手続を行わずに、いわば裁判官の書面審理によって犯罪事実を確認して罰金刑を科すという手続です。
正式な裁判手続で裁判をすれば２～３か月かかるところを、身柄事件なら１日くらいで結論が出てしまうものです。
この制度をうまく活用すると、例えば軽傷の傷害事件で逮捕・勾留された場合などは、せいぜい２～３日の勾留で罰金を払ってすぐ出てくることができるということも可能なのですが、実際はそううまくはいきません。以下は、以前にどこかのエントリで書いた記憶があるものですが。
略式裁判に対しては正式裁判の請求ができるということになっていることが、実は被疑者の早期釈放の障害になっているのです。
正式裁判の請求権というのは、被告人が一旦略式裁判で罰金刑を受けたとしても、その結論に不満があれば、もう一度きちんとした裁判手続で裁判のやり直しを求めることができるという権利のことです。
このような正式裁判の可能性があるということは、手続的に被告人の利益の保護を考えたものですが、検察官から見れば被告人側からの正式裁判請求の可能性がある以上、正式裁判を想定した慎重捜査を行うことになります。
慎重捜査を行って何が悪いんだ、という意見が聞こえてきそうですが、要するに、今認めていたとしても将来否認する可能性を考えて捜査する結果、１０日の勾留（場合によってはそれ以下）で略式裁判が可能な事件でも勾留延長して２０日間勾留される場合が多くなります。
傷害事件の例でわかりやすそうな例え話を言えば、AがBを殴って全治２週間くらいの怪我を負わせたという事案で、初犯でかつ被害弁償も済んでいるということであれば罰金刑でいいような事案なのですが、Aが正式裁判を請求してその場で、「Bが先に手を出したから殴られないようにするために殴ったんだ。」と一言いえば、直ちに正当防衛で無罪という可能性が出てきます。
そうすると、検察官としては、正式裁判を請求されて無罪の主張をされてもそれに対する反論ができるように、正当防衛などの無罪の理由になりそうな事実がないことを含めて捜査することになります。
そうすると、到底２～３日の捜査では終わらず、場合によっては勾留延長をして２０日間目一杯勾留してから略式裁判の手続に入ることになってしまう場合が多くなります。
想定例の一つとして、別エントリに次のようなコメントをしました。
弁護人の立場で言えば、次のような場合がとても多いのです。接見してみると被疑者はこう言います。
私は最初から罪を認めているんです。 正直に話しているのにどうしていつまでたっても外に出られないんですか？ 明日にでも外に出ないと会社を首になってしまいます。 先生、なんとかしてください。それを聞いた弁護人は、事案から見て略式罰金で済むと思って主任検事に面談してこう言います。
検事さん、被疑者は素直に認めてますし、事案から見て罰金でいいんじゃないですか。 明日にでも略式手続をとってください。すると、主任検事はこう言うのです。
弁護士さん、被疑者は今は認めてますけど、罰金にして釈放したとたん、「俺は無罪だ。」と言って正式裁判の請求をしないと保証できますか？ 検察庁としては、後で正式裁判が請求されて否認されたとしても対応できるように捜査を尽くす必要があります。 ご希望には沿えかねます。その結果、最悪の場合は２０日間勾留されて略式罰金になるわけです。
被疑者に正式裁判を請求する意思など全く無い場合であっても。そして、会社を首になってしまいます。
略式手続は被疑者が犯罪事実を認めていることが前提となっています。
事案が軽微で被疑者が認めているので、簡単な手続で早期に捜査と裁判を終わらして、被疑者を早く刑事手続から解放しようという意味を持つ制度ですが（もちろん、検察庁や裁判所にとって手間が省略できて有利）、正式裁判請求権という手続的権利を認めた結果、その本来的な目的がスポイルされてしまうという結果が生じてしまうのです。
被疑者の利益を図るための手続的権利を保証すると、それが逆に被疑者に不利益に働いてしまう現象が生じます。
これは制度設計がうまくいっていないからだろうと思います。
だからと言って、現行の略式手続から被告人の正式裁判請求権を奪ってしまうだけの法改正をしたとしたら、それは被告人の不利益な方向に大きくバランスを崩します。
正式裁判請求権を奪うなら、それに見合う被告人の利益を守るための補完制度が必要になります。
私は、補完制度として、弁護人の同意に基づく略式手続については正式裁判請求権が生じないという仕組みにすることが考えられると思います。
そういうことになれば、逮捕勾留の初期段階から弁護人がついて、事案を把握し、罰金刑にとどまらせるための必要な弁護活動（示談等）を行えば、今より早期に身柄を解放される人がずっと多くなると思います。
このような結果は、刑事弁護の勝利です。
刑事弁護の勝利をもたらす「弁護人の同意に基づく略式手続については正式裁判請求権が生じないという仕組み」は弁護人の権限強化に他ならないと考えています。
実は、私が今述べたような考えの基づいて採用された制度があります。
平成１６年の法改正で採用され、平成１８年から施行された即決裁判手続です。
これは、検察官が執行猶予付き判決が相当と考えた比較的簡明な事案で、被疑者と弁護人の承諾が有る場合について採用される裁判手続で、できるだけ早い時期に公判期日が定められ、原則として第一回公判におして即日判決がなされます。
そして、即決裁判手続では、弁護人の同意を要件としていることに基づいて、事実誤認を理由とする控訴を認めないことにしています。
この制度をもう少し手直しすると、罰金では済まないけれど執行猶予相当の事案について、もっと早く社会復帰させることのできる制度になると思います。
執行猶予判決というのは、犯人を刑務所に服役させずに社会で更生させることを目的とした制度です。
その目的を達成するには、犯人の生活環境を破壊しないことが重要になってきます。
しかし、身柄拘束したまま長期間裁判を続けますと、生活環境が破壊されてしまいます。
その結果、犯人の更生可能性は著しく低下します。
そのような弊害を生じないようにするためにも、即決裁判手続がもっと機能するようにする必要があると思います。
そのためには、弁護人の権限を強化するとともにできるだけ早い段階で弁護人が関与できるようにし、そして弁護人に同意権だけでなく、より積極的な申立権を認めるべきではないかと考えています。
即決裁判も同様ですね。

私も，即決裁判における弁護人の同意という制度は，なかなか踏み込んだ制度であるなあ，と思っています。
ただし，即決裁判でも，法廷における「同意の撤回」は認められています（３５０条の８）。いうなれば，法廷での急な無罪主張も可能です（有罪申述をしなければよい。）。略式における正式裁判の申立とは理屈と申立期間は違いますが，慎重捜査が求められていることは間違いないように思います。

被疑者の国選弁護制度が拡充された今，モトケンさんのおっしゃるとおり，弁護人からの申立制度（特に，正式裁判申立権がなく，あるいは同意の撤回を容易には許さない制度を伴うもの）があれば，いろんな人が幸せになるなあと思います。
ただし，やっていないけど，早く出たいから認める，弁護士も同意する，という悲惨な状況も起こりえます。
これを回避するための制度が，略式における正式裁判申立であるという面もあります。
即決裁判にはこの申立権がないこと（つまりは，事実誤認を理由に控訴できないとしていること）については，略式請求には，「事案が明白」の要件がない一方，即決裁判には，この要件が求められていることからも説明できます。

ですから，（あくまで現行法での理屈ですが）「事案明白」の要件を略式にも作れば，正式裁判の申立をとりあえず否定し去る根拠ができるかと思います。ただ，先ほど書いたような「同意の撤回」の問題は生じるのですが。

あと，別エントリでも書きましたが，あくまでも捜査官の武器にはなっていない（取引の材料ではない）という点は，略式にしろ即決にしろ，司法取引に似ていると言うには，そぐわないという印象です。

結局，アレインメントや司法取引を正面から認めることのできない立法機関というような話になるように思います（なんて後ろ向きな発言か）。何とか着地点が見えればいいのですが。

即決は，執行猶予相当の事案に限られていると思われますが，これを殺人等に広げるには，道のりは相当困難です
ただ，この議論は，非常に面白いと思います。

その問題も含めて「この制度をもう少し手直しすると、罰金では済まないけれど執行猶予相当の事案について、もっと早く社会復帰させることのできる制度になると思います。」ということになります。
この問題は司法取引にからんで指摘される問題点ですが、現状では、認めたら早く出られると思ってやってもいないことを認めたのになかなか出して貰えず、長期間の身柄拘束の後に有罪判決を受けてしまう、というもっと悲惨な状況が起こっています。 それに比べれば、認めた以上は早く出られることが保証される、という制度のほうがまだましです。 被疑者の置かれている状況によりますが。 誤読曲解する人がいますので念のために付言しておきますが、冤罪が生じてもかまわないと言ってるわけじゃありませんよ。 被疑者の現実的利益を考えた場合には、苦渋の決断をしなければならない場合があるのであり、そのような場合には苦渋の決断に見合う結果が保証されたほうがまだましだ、という意味です。制度の本来的意味としては、真犯人が自白している場合限定の制度であるということは、当然の前提です。
ここまで書いても意図的に誤読（意図的な誤読はねつ造と言うべきですが）をする人がたぶんいるんですけどね。あなたのことですよ。小倉秀夫弁護士！
同意の撤回を自由に認めると司法取引と言うにはお粗末すぎる制度であることは間違いありませんね。
現状では被告・弁護側の権限がほとんどないのですから、バランス的にはそんなもんでしょう。
司法取引という言葉をあまり強い意味で考えない方がいいと思っています。
司法取引的な考え方を必要かつ妥当な範囲でぼちぼちと導入していくというのが現実的な考え方ではないでしょうか。
そこいくと米国の実利主義というかプラグティズムは徹底していて、州法によって異なりますが、おおむね「司法取引に基づく有罪の答弁」は、抗争権（責問権）の放棄と看做されて、答弁の撤回が認められません。そして検察官の犯罪（罪体）立証も証拠も不要となり、ただちに伝聞法則が解除された自由な証明と職権主義に基づく情状審理となり結審に至ります。
それどころか、日本の「被告人質問」は、黙秘権の放棄となり、宣誓の上で偽証制裁下の下で証言することとなります。
これは、日本の現状から見たらトンデモ刑事手続きで対極に位置しますが、司法取引（バーゲニング）の有効性を米国市民は信じてほとんど疑わないそうです（陪審員制度同様に）。それで本来は有罪の者が罪を免れても、本来無罪の者が有罪の答弁で冤罪を背負うことになても、「それはやむを得ない。失うデメリットよりも得られるメリットの方がはるかに大きいからだ。」（ニューヨーク大ロースクール元教授Ｂ.Ｊ.ジョージJr.）という価値観（価値判断）に裏付けられているようです。
これが，被疑者段階から保釈を認め，ミランダルールを法定化し，取調べ弁護人立会権を当然に認める米国の標準モデルの刑事手続きです。

一時期、痴漢冤罪（無罪判決が出るケース）が多発しました。
痴漢（迷防条例）の場合、自認しているものは、簡易送致の対象となり、事件捜査を地域警察官が行います。
普段、まともな事件捜査などやったことが無い交番のお巡りさんが主体となって行うため、捜査内容が煩雑で要点を押さえていないものが有りました。
彼らは、被害者の目撃供述があって、被疑者も認めてるから、大丈夫と思っていたのです。
その結果、一部の話ですが、被疑者が弁護士のアドバイスのもと、略式裁判の判決を受けた後、正式裁判を請求し、その煩雑な捜査結果のため、無罪判決を引き出したものが有ります。
しかし、現在は保安係の指揮を受けて、事件処理しているので、その様なケースは無くなると思います。
司法取引に基づく有罪の答弁＝抗争権（責問権）の放棄
捜査側からすれば、早くそういう法体系が出来て欲しいです。
捜査側の負担が非常に軽くなる。

現実の訴訟事案の場面を想定してみれば明らかですが、相手方当事者から突きつけられた「自分に都合の悪い“事実”」に対し、それに「答えない」ことがどのような結果を招くか。
弁護士稼業の人なら誰かに尋ねられるまでもなく知悉していることと思います。にも拘らず、そのような方法を採用するとするなのは、無能の証です。
さもなければ馬鹿者でしょう。仮にそのどちらでもないならば相手方を利することが目的の、裏切り者です。
何れにせよ依頼者に損害を生じさせることしか出来ない「欠陥品」と評さざるを得ません。
