三つ並べましたが、自白事件と否認事件は対になる言葉ですけど、冤罪事件は別の観点からの言葉です。
議論の整理のための基礎知識として簡単に説明します。
分かりやすくするために捜査段階の話は省略していますが、基本的な考え方は同じです。
刑事裁判を大きく二つに分けますと、自白事件と否認事件に分けられます。
これは被告人の裁判に対する姿勢または主張の違いによる区別です。
現在の裁判というのは、対立する当事者がそれぞれの主張をぶつけ合い、裁判官がどちらの主張がどの程度正しいかを判断して裁判するという構造を持っています。
刑事裁判では、まず検察官が、被告人はこれこれこういう犯罪を犯した者である、という主張を行います。簡単に言うと、起訴するということです（手続的には起訴状朗読ですが）。
この段階では、あくまでも検察官の主張にとどまります。
検察官の主張というのは、検察官の言い分であって、それが事実かどうかは証拠調べをしてみないと分かりません。
「主張」と「事実」は別物であるという理解がとても大事です。
これが理解できないと、裁判というものが理解できません。
このような検察官の主張に対して、今度は被告人側（被告人と弁護人）が認否を行います。
ここで、自白事件と否認事件が分かれるわけです。
自白事件というのは、要するに検察官の主張を認める事件です。つまり、「被告人は、検察官の主張どおりの犯罪を犯しました。」という主張をするわけです。
これに対して、
否認事件というのは、被告人側が「検察官の主張するような犯罪事実はない。」と言って、検察官の主張に対して被告人側が争う主張をする事件です。
ここでも注意すべきは、自白（認める意見）も否認も、被告人側の主張であるということです。
「主張」と「事実」は違う、という命題はこの場合にも妥当します。
どういうことかと言いますと、
自白事件の中には、
自白どおりに被告人が検察官が主張する事実（起訴事実）を犯している事件（被告人が真犯人である事件）（１）
と、
自白はしているが被告人は真犯人ではない事件（例えば身代わり事件）（２）
があるということです。
同様に、否認事件においても、
被告人が真犯人ではないので（正直に）否認している事件（３）
と
被告人は、真犯人であるけれども、責任逃れのために（嘘をついて）否認している事件（４）
があります。
そして、冤罪事件というのは、上記の（３）に類する事件のことになります。
自白事件か否認事件かは、被告人側の主張の違いによる区別ですが、冤罪事件というのは実際に被告人が罪を犯したという事実があるのかないのかという観点からの用語です。
刑事訴訟法が定める被告人側の諸権利は上記（３）の場合を想定して、冤罪事件が生じることを防ごうとしているのですが、その結果として、（４）の場合の被告人にも罪を免れるための手段を与えることになります。
しかし、それはそれでやむを得ないという価値判断ないしバランス感覚があるわけです。
また、（２）のような場合を容認しないというのが、日本の刑事裁判の考え方です（民事裁判は別です）。
Ａという人に対する有罪判決が確定した後であっても、Ａが身代わりであったことが発覚すれば、身代わりになった理由如何を問わず、検察官が再審請求を行って無罪であることをはっきりさせます。
しかし、任意の意思に基づいて被告人側が認めるならば、それでいいではないか、というアメリカの制度のような考え方もあります。
これは刑事裁判に民事裁判的な考え方を持ち込んでいると評価することもできます。
アメリカの司法取引の考え方の中には、被告人側が、自分が真犯人であるか否かにかかわらず、現実的な利害得失の判断に基づいて有罪と認めるならば、それに従っていい、という考え方があるようですが、日本でそのような意味での司法取引が受け入れられるかどうかは相当疑問です。
しかし、（１）の場合を想定して、いろいろ考える余地は十分あると思っています。
その結果として、（２）の場合（身代わり事件という言いではなく、真犯人ではないけれども罪を認める事件）が増えることが予想されますが、それは、制度設計の論理としては、既に述べたように、（３）の場合の被告人を保護しようとすれば（４）の被告人にも手を貸すことになるが、それもやむを得ない、というのと同じだろうと思われます。
完璧な制度は作ることは不可能だということでありまして、あらゆる場面において、妥協点を見いだす必要があるというのが制度設計の実際です。
妥協している部分を指摘して、それが制度の本来的目的であるかのうように評価し、制度を批判するというのは、制度論というものを理解していない無責任な的外れ論理、簡単に言えば批判のための揚げ足取りに過ぎないものです。
責任をもって制度を設計し、またその制度を運用しようと思えば、常に衝突する理想の狭間に身を置くことになりますので、みんな悩みながら仕事をしているはずです。
せっかくなのでコメントします。

足利事件の場合は、現段階では真犯人では無いと思われるわけですが、自白はありました。この場合は“自白はしているが被告人は真犯人ではない事件（例えば身代わり事件）（２）”に分類されるので、“冤罪事件というのは、上記の（３）に類する事件のことになります。”からすると冤罪ではないと考えるいうことでしょうか？

足利事件の犯人とされた菅家さんは、他の２つの「万弥ちゃん事件」と「有実ちゃん事件」にも容疑をかけられて、自白もしていたようです。しかし、起訴はされていません。これは物的証拠が無かったからだと、理解しています。自白のみでは被告人を有罪となし得ず、補強証拠が必要ということでしょう。
“刑事訴訟法が定める被告人側の諸権利は上記（３）の場合を想定して”いるだけではなく、（２）の場合も想定しているのではないでしょうか？

（２）の自白はしているが真犯人ではない事件には、身代わり事件以外にも警察の取調べによってやっていないことを自白させられた場合も多いと思いますが、その場合も“それはそれでやむを得ないという価値判断ないしバランス感覚”となるのでしょうか。

真犯人でない被告人が、公判でも一貫して罪を認めて刑罰を受ける場合を「冤罪」と言うべきかは疑問があります。これは言葉の定義の問題ですが。

そう考えてもいいと思いますが、理論的には、補強法則というのは、被告人側の諸権利というよりは、裁判所の自由心証に対する制約（自由心証主義の例外）と見るべきだと思います。
もっとも、真犯人でないものは処罰してはならない、という意味での実体的真実主義の表れとも言えますし、虚偽自白による冤罪処罰の可能性を低下させるためのものと見れば、冤罪被告人保護の制度とも言えます。
なお、このエントリの説明では、公判における自白を念頭においており、自白は任意性のあるものという前提で説明しています。身代わり犯人を例示しているのはその趣旨も含んでいます。

誤解を恐れずに言いますが、現行の制度では（というか人間による裁判である限り）、誤判つまり冤罪の発生は不可避です。
もし、文字通りの意味で冤罪は絶対にあってはならない、と言うのであれば、刑事司法制度を廃止するほかありません。
現行司法制度は、発覚するしないにかかわらず冤罪は発生する、もっと端的に言えば発生している、という事実を織り込んでいます。
そして、冤罪をできるだけ少なくするとともに、罪を免れる真犯人をできるだけ少なくするように考えて制度設計が試みられています。「試みられています。」というのは、現行制度が完璧なものではなく、今後も改善されていかなければならないと思うからです。
そういう意味で、「それはそれでやむを得ないという価値判断ないしバランス感覚」が要求されていると考えます。
但し、「「それはそれでやむを得ない」というのはどの程度のバランスを言うのかが深刻な問題になるのであり、現行制度がバランスが取れているものであるかについては、重大な問題が指摘されています。
取調べの可視化は、まさに、冤罪防止の要請の観点から崩れているバランスを回復するための議論ということになります。
念のために申し添えますが、このエントリは足利事件プロパーのエントリではありません。
わかりやすさ優先で、かなり単純化しているところも多いです。

この事例は、自白があって、有罪の一審判決が確定し（報道によると、公判段階でも否認しなかったようです。）、服役し終わったあとに、真犯人があらわれて無罪が明らかになり、再審がなされて無罪となった事例です。こういう事例こそ、疑問の余地のない冤罪の例だと、普通は考えるのではないでしょうか。
モトケンさんの定義によると、この事例は「冤罪」にはあたらないということになります。
「これは言葉の定義の問題ですが。」とされていますが、ちょっと通常の「冤罪」の用法と離れ過ぎています。
横からゴメンナサイ。
想像で申し上げますが、モトケンさんは上記の想定を、いわゆる親分の身代わりにムショのお勤めをはたす下っ端子分、このような真犯人でない被告人の事例をも想定されておられるのでは？このような身代わりで有罪判決を貰いに来る事例は、果たして「冤罪」の範疇に入るのだろうかと私も疑問に思います。
刑事裁判において最も優先されるべきは、(3)の場合に有罪判決が出されないことだと思います。それが大原則じゃないでしょうか。
ただ、その原則が徹頭徹尾貫かれている感じもしないんですね。個別の事件を取り巻く状況によって、あるいは裁判官の個性によって「ゆらぎ」があると言うか。その部分で問題を感じます。
プロの裁判官でもゆらぎがあるのですから、裁判員制度の元ではどうなるんでしょうか。

エントリの趣旨とずれたところで、揚げ足取りは勘弁してほしい、というのが正直な気持ちです。

至極当たり前だと思うんです。でもね、自分がその立場（冤罪被害者）になったらたまらんだろうな。とも思うわけです（笑い）。
結局冤罪問題を考えるときに、
冤罪を完全に防ぐことはできない。と同時に冤罪被害にあった人をどうやって救済するか？ というかその心情を汲み取って...いやいや自分がその立場になったらどう思うか？ ということを考えて制度設計されねばならないでしょう。って当たり前だと思いますが。
以下飲み屋の余田話程度の内容で恐縮ですが、
日本の捜査・裁判では以前として自白偏重主義的なところがあると思います。まずこれを改める。代用監獄をやめる。拘置日数を最大で10日程度に短縮する。

正式裁判かはたまた略式か、さらには不起訴かの判断は、捜査機関であり公訴権のあるる検察ではなく、予審にゆだねる。ということが必要なのかなぁ？なんて素人考えですが思います。
予審段階で、
”あなたの刑罰はこれこれこの程度で、これは略式裁判が可能ですがどうします？”と予審裁判でやったらどうなのだろう？ と思うのです。そのときにはもちろん、検察側の求刑は決まっていなくてはいけませんし、その後変更は出来ない。被告側も略式を受け入れたのなら、正式裁判を求める権利はない。
ようするにどちらの側にも後出しジャンケンはさせない。ということなんですが。

この「問題発生リスク」というのが冤罪発生リスクのことであれば、それを「細部での些少な」と言うのは適切ではないと思います。
重大かつ深刻な問題ではあるが不可避だ、というのが私の認識です。
冤罪被害者には、憲法29条3項的な補償が必要と思います。
刑事補償法の上限額は撤廃、少なくとも大幅に引き上げるべき。

冤罪発生が重大かつ深刻な問題との認識は私も同じです。ですが現実問題として、発生する余地を完全にゼロにする制度設計は不可能です。純粋物質と称しても、それは99.99％のフォアナインであったり、あるいはシックスナインやテンナインなのかもしれません。
冤罪発生の抑止でも、完全に抑止することはできません。テンナインであっても発生頻度はゼロではありません。私が些少なという表現を使ったのは、このように発生の頻度が小さい場合という意味で使いました。
で、世の中に完全とか完璧があり得ない以上、フォアナインで良しとするのか、あるいはテンナインでも未だ不完全とするのか、それは社会がどこで割り切るかの問題でしょう。すなわち冤罪の発生頻度のリスクを何処まで小さくしたら、社会が納得するかの問題に帰結するかと思います。
百億に一つの可能性すら許せないのか、百億に一つであれば止むを得ないと納得するのか、そこは社会の総意が決める部分でしょう。

個人的な感想なんですが、拘留、罰金、執行猶予付きの懲役などの比較的軽い刑だったらば、犯罪の事実がなくても有罪になる人が僅かに存在したとしても、「世の中、理不尽なこともあるよね」と言えなくもないです。
が、それが禁固、懲役の実刑となれば本人はたまらないでしょうし、死刑であったらとんでもない、と思います。
少なくとも死刑については、確率としてゼロにならないのは理解できますが、いまいる全ての死刑囚について冤罪がなかったと確信めいた気持ちを抱かせて欲しいものです。
さて、この個人的感想が割りとコンセンサスを得られるものだとしての話ですが、もしそれを裁判の結果に反映されるような形で制度設計をしたとしたら重い犯罪であればあるほど、事実の認定が慎重になり、従って無罪になりやすくなる、ということになりかねないですよね。こうなれば、重い犯罪を厳しく裁いて欲しいという（多分大部分の）市民感情に反する制度になってしまうというジレンマが生じる。
解決策としては、事実認定の確信度みたいなものを量刑に定量的に反映させるということはありえるのかなとも思います。つまり、「懲役XX年だったら有罪にできるけど、死刑にするほどの確信は無いから無期懲役にしよう」みたいな感じで。でも、事実に基づいてのみ罰則をするという原則に照らすと、筋が通らなさそうです。
えっと、思考実験をしてみて、出発点では矛盾しない複数の理想とか理念を現実に適用すると、どちらも立てることができなくなるということはありえるんだよな、というだけの話なんですが。長々とすみません。

冤罪の発生が理論上ゼロにできない以上、必ず発生し得るという認識を心の反対側に置かないといけないと思います。
船は沈没しないように細心の注意を払って設計しても、必ず沈没します。不沈船設計は不可能ですし、沈没事故発生はゼロにできない以上、沈没したらどのように対処するか、という想定をした上で船を運航するしかありません。そうした必ず沈没し得る認識を反対側に置く結果が、救命ボートや救命胴衣などの設備であり、捜索救難の体制整備であり、損害補填の海上保険システムでしょう。
司法でのシステム設計や発想もこれと同じで、冤罪は発生しないよう努力すべきなのは論を待ちませんが、同時に発生した場合のカウンターシステムを考えておくべきです。No.11 fuka_fuka さんの
というご意見に私は賛同いたします。ただし問題なのは、冤罪での死刑執行でのカウンターシステムをどうするのかです。死刑廃止、あるいは死刑判決であっても執行の無期停止（実質的に仮釈放無しで自然死するまでの禁固刑）を行うのか･･･。
これも理論的な解が得られる問題ではなく、社会の納得の問題として議論せざるを得ないと思います。

物事を冷静に見ることができない人間(含：私)が多い社会においては、事件発生の都度「推定無罪」の原則を周知徹底しないと「裁判員制度」にも悪影響を与えそうに思います。

「匿名の卑怯者」による「コメントスクラム」（いずれも小倉秀夫用語らしいですけど）による萎縮効果をハゲシク主張されている当の小倉弁護士によって、このブログが最も強い萎縮効果を受けているというのは、興味深い現象ですね。
要するに、粘着個人攻撃の発生やそれによる悪影響については、投稿者が匿名であるか実名であるかは何の関係もない、というか一応社会的評価の高い立場にいる実名者のほうがその悪影響が強い、ということが実名論者の投稿によって日々証明されている、と言う事実は、すでに多くの人が指摘してますね。
検察官や裁判官に対して「過失」に問う、ということの意味ですが、刑事または民事の法的責任を問うということでしょうか？
「冤罪であった場合」というのは、裁判的には、無罪判決が確定した場合か再審無罪になった場合に当たると思いますが、被告人が無罪または再審無罪になったからといって、起訴した検察官や有罪判決をした裁判官に対して、最終的に無罪になったという一事をもって法律的責任を問うことはできないです。
制度論的観点で言いますと、裁判というものは、訴えた側（刑事では検察官）が勝つ場合（有罪になる場合）も負ける場合（無罪になる場合）もあることが当然のこととして予定されています。
無罪になったからといって個人責任を問われたのでは、検察官は誰も起訴しなくなるかも知れません。
有罪判決が上級審で無罪になったら個人責任を問われるとなったら、検察官がかろうじて起訴した事件も片っ端から無罪にしてしまうかも知れません。
そうなると、有罪判決を受ける者が激減し、その効果として冤罪は確実に減ると思いますが、処罰を免れる真犯人の数は激増すると思います。
もっとも、上の説明（かなり極論です）は、「無罪になったという一事をもって法律的責任を問うことはできない」というにとどまり、判決に至るまでの検察官の捜査や公判活動、裁判官の判断に故意または重大な過失に基づく違法または不当な行為によって冤罪が生じたということが認められれば、個人が民事の賠償責任が問われる場合があります（国家賠償法１条）し、また、刑法の第１９３条以下の規定に触れれば、刑事責任を問われる場合も考えられます。
この問題は、旧ブログで医療過誤事件における医師の責任と冤罪事件における司法関係者の責任の対比としてかなりろんじられているはずです。
しかし、大量の過去ログの中に埋もれていますので、私自身もここを読めばわかるというような指示ができません。
興味があって、おもいっきりヒマのある方は、過去ログを読むのも面白いかも知れません。

現行制度について補足。
同条２項により、公務員個人が、国から求償請求される場合があるという趣旨です。
国家賠償法によっては、被害者が公務員個人を直接の相手方として賠償請求できないことは、確立した判例です。“公務員バリア”
●国家賠償法
第１条 国又は公共団体の公権力の行使に当る公務員が、その職務を行うについて、故意又は過失によつて違法に他人に損害を加えたときは、国又は公共団体が、これを賠償する責に任ずる。
２ 前項の場合において、公務員に故意又は重大な過失があつたときは、国又は公共団体は、その公務員に対して求償権を有する。
私見では検察官の起訴判断や裁判官の判決に重大な過失（社会的な意味で）があった場合にまで保護する必要があるのかは懐疑的に思っています。
制度論に昇華させることができないレベルの感覚的なコメントで恐縮ですけどね
裁判員裁判で冤罪が生じて再審無罪となったら、裁判員に損害賠償や謝罪要求の嵐とならないか心配です。法律上は、裁判員もその職務行為は臨時公務員として国家賠償法で故意または重過失がなければ免責ですが、世論やマスコミのバッシングは事実行為なので止められません。

英米では、陪審員の自由な評決を保護するため、法律または自主規制で、陪審員の評決判断それ自体への批判が許されない場合が多いかと思います。国会議員の発言無答責（日本国憲法５１条）と同じ法理で。

マスコミが（「自覚的」に）バッシングするかどうかについては私は疑問なしとはしませんが、そのような場合には、少なくとも評議の秘密を暴く（別名「検証」）ことに血道を上げるのは間違いないでしょうね。
その道のプロである職業裁判官とマスコミの場合は「付き合い」のフォーマットが確立しているのに比べると、民間の裁判員を相手にした「取材」には、マスコミが“付け入る余地”が大きくあるでしょうし。

職業裁判官ならまだしも、市井の民の裁判員が評決で死刑に一票投じるのは、相当な心理的バリアがあると思われます。職業裁判官だって、徹夜と思われる真っ赤な目で死刑判決を宣告する人もるのですから（前夜は横になっても一睡もできなかったのでしょう）。
そういうノリで死刑に一票を投じることができるのであれば、どうぞ。

容疑者が逮捕された時点でまだ「容疑」なのにこんなやつは死刑にしろって書き込みがネット上にあふれますから。
特別な思想のある人ははねられるんでしょうが、ごく普通のはずの人たちが「吊るせ！！」って言うから怖いです。
「そういうノリで死刑に一票を投じることができる人」も一定の割合で裁判員になるだろうなと危惧しています。

昨日、東海テレビ制作の「光と影」という、光市母子殺害事件弁護団密着ドキュメンタリー番組がＮＨＫで放送されていました。

食べたい人が食べればいいのに、何で最後の一個になると手を出さなくなっちゃうのかなー？ ちなみに僕は自分が食べたければパクっといっちゃいます。
