最近は、小倉弁護士からの攻撃に対する防衛エントリばっかりで、「そんな話はもういいよ。」と思われている従来からの読者の皆さんも多いと思われますので、その点につきまして一言釈明させていただきます m(_ _)m
旧ブログ（元検弁護士のつぶやき）における医療問題論争当時から読者の皆さんならご存知なのですが、2008年6月 8日の小倉秀夫弁護士のコメントから小倉弁護士の私のブログに対する粘着攻撃が顕著になったと記憶しています。
小倉弁護士の意見が、議論のルールに従ったものであればよかったのですが、他人の意見は誤読する、誤読を指摘しても間違いを認めない、ありえない極端の仮定の例を持ち出して自説を基礎づけようとするなどの議論を混乱させる発言しかしなかったことから、それにいちいちブログで反論していたのでは本来の議論に重大な支障を来す事態になりました。
そこで、私としましては、対小倉弁護士反論専用ブログとして「モトケンの小倉秀夫ヲッチング」（以下、ヲチブログ）を立ち上げて、小倉弁護士への反論・批判はそこでやっておりました。
（今となっては、「ヲッチング」というタイトルはあまり適切ではなかったと思いますが、ブログの趣旨はそういうものです。）
今回もそうすればいいのではないかというご意見があるのは十分承知しているのですが、何分、ヲチブログのアクセス数はあまり多くありません。
小倉弁護士の「la_causette」とは比べものにならないはずです。
そのような状況において、小倉弁護士は、私を批判するために、刑事司法の実情まで歪めた説明を始めました。
折しも裁判員制度が施行されるこの時期に、弁護士の肩書をもって刑事司法の実情を誤解させるような発言を容認するには、私の器は小さすぎます。
というわけで、当ブログで反論させていただいております。
今回のような状況に身を置きますと、実名でブログを書くことのリスクが身をもって痛感させられます。
一般的には、実名でブログを開設することはお勧めできません。
実名でブログを開設することのリスクを実名主義者の小倉弁護士が証明しているというのはなかなか面白い現象です。
小倉弁護士に絡んで、すでに何度も何度も指摘されていることですが、ネットの発言に基づく諸問題は実名主義を採用したからと言って解消されるものではない、ということがよくわかります。
実名であろうと匿名（ハンドル）であろうと、要は発言者の人格の問題に帰着するようです。
このブログが小倉問題一色になるのは私の本意ではありませんので、時間をみつけてブログのレイアウト変更やその他の方法（計画中です＾＾）でブログの雰囲気を変えたいと考えています。

「議論における誘導尋問」という新たな概念について

この場面で、小倉先生以外に誰かが重視しているのかふしぎですねえ？
それ以前に、質問発端のエントリー（14/06/2009 端的に，質問してみる。）で、モトケンさんが手順を踏んでいた件ですが。
と質問の趣旨を確認しているのに対し、と逆質問で返した。真意を欺瞞で覆う者には本質論を語る資格が無いのでは。
ブログの人気よりも正しい法律知識の普及（間違いだらけのオグ◎ンブログの訂正）を優先させたモトケン先生を改めて尊敬しますm(_ _)m
一時は誤解されても誠実性と良心的態度は、長い間に人の心を打ちます。(ﾟДﾟ)マヂデス
1年半くらいROMしています。初めて投稿します。変な時間の投稿ですが、IPを見てお分かりの通り、ヨーロッパからです。仕事で駐在しております。このところの流れを見るに見かねています。
間違いを素直に認められない人とは話をする意味がないのです。早く関係を切ったほうがいいです。話の通じない人というのはある一定数は必ず存在するものです。通常の難しいけど興味深い法律議論に戻りましょう。
これまでのかの人の非論理性は見る人が見ればすぐにわかります。私は法律の専門家ではないですが、かの人の議論の仕方はかなり稚拙なものだと見てすぐわかります。揚げ足取り、藁人形、属性批判。さらに自己矛盾。いわゆる文系の世界はよくわかりませんが私の属する理系の世界では、それらの論法を用いれば一発で信頼を失うでしょう。というかむしろ見たことさえありません。
自浄作用にも限界があります。ほっときましょう。
先生の情熱は是非、真摯な学生さんに注いでください。学生さんはマジメにとんでもないおかしな事を言ったりします。それを怒らずに、一生懸命指導してあげること。モトケン先生はそれができる方だと感じています。

これは実は法律まったくしろうとのギャラリーである私にはものすごくありがたいです。

さらに知識の豊富なコメンテーターが追加の説明を加える。
この流れでたくさん勉強させてもらいました。
たぶん最初から正しい知識だけがズラズラ書いてあっても私みたいのは読みませんもん。（笑

モトケンさんが誘導尋問であるからということで回答を拒否した件ですが
私が不思議に思うのは
当初、小倉弁護士の主張は
文章表現として誘導尋問ではないという主張だったのに、
最近ではブログにおける質問であるから等々
シチュエーションを問題として誘導尋問ではないという形に変化していることです。
これは小倉弁護士の主張が、

という主張に変化したと理解しても良いのでしょうか？
もし、そうであるならば、

拒む理由が敵意くらいしか無さそうなのに、議論に入る為の質問には答えない「おぐらべんごし」は。
唯我独尊の小宇宙で、敵意に基づく妄想に支えられているのでは？

裁判官が供述の信憑性を判断するとき，「～証人Ａの供述～は捜査段階から一貫しており，詳細な反対尋問にも耐えて矛盾がなく」とか，「～証人Ｂの供述～は，当公判廷におけるものでも重要部分で不自然に変遷し，その変遷理由を合理的に説明できないばかりか，反対尋問で証言で主尋問での証言内容（速記録のとおり）を証言していないなどと否定するもので」とかあるのは，小倉さんには理解されないでしょう。
「君子豹変」をこんな意味に使う人は前代未聞！！
開いた口がふさがらない（私、この台詞は初めて使います）
本来は「議論で相手方の主張を正しいと認めたら、潔く自分の考えを改める」といった意味。
その為には謙虚さが前提と成る、謙虚の重要を示す言葉でも有ります。
一貫性の欠如を容認とはほぼ真逆の思想。
これほど小倉べんごしに聞かせたくて（どこかで使う予定でした）、又似合わない言葉が、氏自身から（意味を取り違えて）出てるとは。
『誘導尋問』の議論についてあまり興味が持てず、ほとんど流れを理解できていない立場から、無責任にコメントします。
そもそも弁護士というのは、論理を戦わせる職業という側面があると思いますし、おかしいと思うことについて徹底的に戦うということは全然ＯＫだと思います。
ただ、「小倉弁護士」という単語の入ったエントリが連発されるのを見ると、パッと見、「荒れてる感」「荒んでる感」を感じるところはありますね。
「荒れてる感」を感じさせないために、エントリのタイトルに「小倉弁護士」って単語を入れないというのはどうでしょうか。もしくは『誘導尋問』関連以外のエントリもちょこちょこ合間にはさむとか。
まあ、瑣末な対策ですし、モトケン先生のポリシーに反するかも知れませんが、ブログを開いたときのパッと見の印象というのも気になるところではあります。
小倉さんは、言動がちょっとだけ他の弁護士と変わっていますが悪気はない善人な方だと思います。そうでなければ「オグリン」「オグたん」という愛称が自然発生的に生まれて、その愛称でも呼ばれることはないと思います。
ただ、類稀なる集中力と執着力と追及力の才能が高く、一種独特の思考方法と誰も気づかなかった論理展開や論旨を発案する天才肌があるので、我々一般通常人の常識や普通の人の想定の範囲を超えるため、結果的に誤解を生んで反発する方も多いかと思います。
それと、嫌味・皮肉・当て擦り・罵倒・嘲笑は、小倉さん語で言えば、ただの小倉式強調用法に過ぎないだけだ、と判れば腹も立ちません。また、[自説批判・間違い指摘]＝[人格攻撃]＝[敵認定]と三段跳で即決する愛らしいそそっかしさがありますが、これもご愛嬌でしょう（善人の善意の証拠）。
さらに、小倉さんは小倉さんなりの信念を貫いて（これは一貫しています）、自説に基づく社会正義の普及・浸透にプライベートな時間を大幅に割いて公益に奉仕している、そういう認識でいると思います。
そうでなければ、昼間はもちろん深夜未明早朝まで時間をかけて、自ブログのエントリーを記述したり、典拠となる資料を図書館に寄って調べたり、広大なインターネットを検索して英文資料を検出したり、多方面にわたって様々な自説を次々と投稿する（不幸にして無理解な人から「出張放火」と揶揄されていますが）ようなことは、誰にも真似できないでしょう。
嫌味や皮肉や当てこすりは、戦闘機で言うチャフやフレアに相当すると思います。
小倉弁護士初心者は嫌味や皮肉の部分に注目したり、反応してしまいがちですが、ここに反応してしまうと、小倉弁護士の論点がこっそり変わっていたり、主張が全く別なものになっていることに気が付かないのですね。そのため、真面目な人であればあるほど混乱してしまいます。
嫌味や皮肉や当てこすりは一種の目くらましであり、議論を勝利に導くための高度なテクニックだと思うのですよね。
ディベートの達人だと思います。
どこかの掲示板でやり合った時がありますが、その時の印象は強く残っています。
・議論に勝利することが目的である
・立場を少しずつ変えて攻撃してくるので反撃が難しい
・論点が巧妙にすり替わっている
・意図的な誤読により、相手が反論する気を失わせる
・負けを認めなければ勝ちだと思っている
・弱みを絶対に見せない
・相手を自分の土俵に乗せるのがうまい
ネット上での議論に勝利するための高度なテクニックを身につけていると思います。消耗戦に持ち込むのが非常に上手なのですね。結果として、論争相手は不毛かつ非生産的な時間を費やすことになってしまいます。
「君子豹変す」は誤用してる人は多い気がします。
そういえば今朝の天声人語に書かれてたことわざ見てぴったりすぎて思わず顔がほころびました。
「這っても黒豆」

私はそうは思っていません。
ネットでは議論が可視化されます。
論点ずらしなどの証拠が残るんです。(取調べの可視化と一緒。笑
生の議論で記録が残らなければごまかされる人も多いかと思いますが、ネットではあの技法は墓穴を掘ります。
＞消耗戦に持ち込むのが非常に上手なのですね。
これは同意。
たぶんみんな今まで途中で嫌になって諦めてたのだと思います。
最後まで諦めず対応なさる人がいなかったため、このやり方を有効だと誤認なさったまま今にいたるのか、本人もいいやり方ではないと認識しててやめられないのか....
それは「高度なテクニック」ですか？
単に、勝ち目のなくなった戦場を片っ端から放棄して闇雲に戦線を拡大するだけの・・・言い換えれば次々に「敗戦」を積み重ねるだけの、議論者としての低級さを自ら実証するだけの愚策なんじゃないですかねえ。
負けても負けを認めないで、いつまでもチョロチョロ逃げ回っているから、相手がうんざりするのはあると思いますけど。
ショボい詐欺師ならば、その場その場を取り繕うことが辛うじて出来れば、なんとか「商売」を継続していけるかも知れんですが、職業が弁護士の人が、それで通用しますかね？
小倉弁護士は、モトケンさんが「論点ずらし、ごまかし」をしていると思っているのではないでしょうか？
私が「論点ずらし、ごまかし」をされた経験から、(私が) 追及するならこうするだろう、が、小倉弁護士の文章に近い気がします。
そうとも限りませんよ。論点ずらしなど面倒なことはせず、
コメント書き込みであれば、一方的に非難しつつ、削除されます。
対抗策は、自分のブログがあれば、自分のブログに書いてトラックバック、ですが、
実生活上での論点ずらし・無視で困っています。一方的に振り込まれたカネも返したいので、私のブログ開設に伴い、相手の実名をだして、コメント等の反応を待っているのですが、いまのところ、気がつかないのか、わざと気がつかないふり(無視)をしているのか、先方の反応がありません。(相手の立場に配慮しつつ書いているのがいけないのか？)その場合は、トラックバックを削除され、無視されます。
なにかいい方法、ないですかね？
もうひとつ。
「ディベート」って、本来、司会進行役や審判役がいるのです。裁判所で言えば裁判官役が。
小倉ｸﾝお得意の、論理性の欠けた発言、不規則発言、話題逸らしなどなどは減点対象であり「敗北への一里塚」です。
“朝生”なんかのせいでディベートについて間違ったイメージが広まっているのかとは思いますが、ディベートにおける本来の勝利とは「論理性で相手を上回る」ことです。少なくとも「反論」の論理性が、自説のそれを上回らせないことです。
火元を広げまくって本旨を有耶無耶にした程度では「勝ち」になりません。
la_causette（01/07/2009）が、「論」と認められるには。
１．エントリーで仮定した『無実の罪で刑罰を課されるリスクを高めてでも弁護人の目を気にすることなく捜査機関側の人間と雑談を楽しみたい被疑者』がla_causette以外に無視できない数存在する？ことを証明し。
２．罵倒らしき文言『冤罪好きの汚名を着る度量～』の根拠を明示しなければ成らない。
ところが２．の根拠を作るネタの質問
が不発で墓穴の状態。小倉べんごしは自分の論は説明できず無根拠に罵倒を繰り返すのみで、強弁が更に劣化している。
結論が毎度おなじみでもう面倒くさいけど外って置けない性分が・・・
ディベートの本則は、雄弁術ともいい、要するに説得（力）です。その判定は、もちろん技能に基づく学術的なものもありますが、多数の聴衆者の投票(説得された・感銘した）が基本です。
歴史的有名な、ケネディとニクソンのＴＶ討論では､ディベート学的（レトリカル学術ポイント）には６対４でニクソンが勝ちましたが、ＴＶ視聴者（オーディエンス；世論）の評価は逆に４対６でニクソンが負けました。後年、「ニクソン大統領」が世論を気にし過ぎたため、ミスター・ギャラップ・プレジデントと呼ばれるように変節した起源とされています。
法的制度のディベートなら、法学者や実務家の支持も大事ですが、普通の一般通常人を説得して感服させる理論根拠・理想への視野・現実的妥当性がなくてはなりません。もちろん両方が欠けたら惨めのイナゴもとい一語に尽きます。
極論や極端例で人が説得できるでしょうか？ 理論的一貫性を欠いて、カメレオンのようにコロコロ立場やポリシーが変わる人を信頼できるでしょうか？ ケネディの歴史的事実に基づいた例示列挙（ギリシャ神話や古代ローマ帝国の歴史的事実からソビエト亡命者の声明まで）と大上段から感情的に敵対者を罵るニクソン（生卵を投げた老婆に「ピッチ！，ファッキング・バスタード！」）とでは、どっちが偉大なる説得者・伝道者（グレイト・コミュニケータ）でしょうか？
最近は、そういうことを良く思い出します。
どちらが議論を通じて自分の目的を果たせたか，ということを考えれば勝者なんて明らかだと思うのですが．
ブログ主は自分の議論の正当性をネットの読者が認めてくれれば，それだけで目的を果たしたと満足できるのでしょうか．おそらく，むしろ肝心な目的を達成できていないのではないかと愚考します．
一方で，相手が，ディベートでの客観的な勝利やネット上での賞賛を目的に議論をふっかけてきていると，まだ信じられますかね．多分，そんなこととは無関係に，目論見は十二分に達成されてしまっています．
そういう意味で議論を勝利に導く技術に長けているという意見には同意です．
ネット世論は現実社会の２％程度の影響力しかありません。
所詮は部分社会の法理が適用されるバーチャルな世界です。
それでも、その世界で事実に基づいた実務や法理論の啓蒙には少しの意味があるでしょう。
高目路線の方は、印象操作レトリックで政敵を攻撃したり（最後はカーター元大統領まで二期目の選挙で使った）、執拗に「論破論理」を主張したり（論破は無意味と粘着攻撃する人を含む）ですが、そこには仮想敵しか視野になく、一般聴衆への説得や啓蒙という視点が欠落しており（デュカキス候補）、だから、大方の支持を得られないのだと思います。
ただ、長期的視点で見れば、あれほどピッグス湾事件で誹謗中傷罵倒嘲笑・印象操作（自作自演）の嵐に塗れたケネディは、鉄鋼カルテル事件、キューバミサイル事件、東ベルリン事件などで手腕を発揮して、大衆の支持は結局（以下略）。
人が信念を貫くとき、仮想敵にかまってる暇はなく、批判を覚悟で己の信じる道を進むのが、大衆の支持を受けて制度の変革へ進める遅々とした進展でも一番の近道ではないかと。
ピッグス湾事件のとき、ケネディは｢正直こそ最良の選択｣と判断し「全ての責任は私にある」と記者会見（テレビ生中継）で言ったため、国民の支持率がアップしています。このとき、「勝利には１００人の父親が名乗り出るが、敗北は孤児である。東洋のことわざである」と言ったのは有名ですが、毎日新聞特派員でワシントンＤ．Ｃ．駐在だった大森実氏が報道官のサリンジャーに「東洋にはあんなことわざはない」と突っ込みを入れ、サリンジャーが「中東のことわざかも」と応じた、というエピソードを大森さんの本で読んだことがあります。
もっともケネディは、ＣＩＡに対してはその軍事行動および後始末の失敗の責任を厳しく追及し、アレン・ダレス長官、チャールズ・カベル副長官を更迭しただけでなく、ゆくゆくは組織の解体まで考えていたようです。
鉄鋼危機の時のスピーチも興味深いです。ソレンセンが用意した草稿に（押さえきれない鉄鋼業界に対する怒りのせいで）かなりきつい調子で業界を非難する文言をアドリブで入れ、記者がその激しさに驚いたというエピソードが残っています（ソレンセン「ケネディの道」）
近年になって女性にだらしなかったことがおおっぴらに語られるようになったケネディですが、あの明るさ・率直さ・記者会見で見せる当意即妙のユーモアがアメリカ国民を魅了したのでしょう。いまでも人気は歴代大統領の中でトップクラスです。
ニクソンは貧しい少年時代を送ったことがある種のコンプレックスになってしまい、少し暗い感じの人でしたね。上院議員時代から「トリッキー・ディック」と言われ（副大統領候補になるとき、不正献金疑惑を晴らすための｢チェッカーズ・スピーチ｣で愛犬チェッカーを引き合いに出し、泣いたのは有名です）やましいところがある人、というイメージが付いて回りました。オリヴァー・ストーン監督の映画「ニクソン」でアンソニー・ホプキンス演じるニクソンがケネディの肖像を見つつ「国民は君には理想のみを見、私には現実のみを見る」というラストシーンは印象的でした。ニクソンも悪いことだけをした大統領ではないのですけどね。

その肉体的ハンディと圧倒的な死への恐怖を克服してユーモアを忘れない不屈の精神力を打ち立てたケネディですから、女性との浮名をモンローウォークで流したのもご愛嬌ということで。私の長い闘病生活を支えるエピソードです。もし奇跡的な回復を遂げて驚異的なリハビリ（脳神経系統の再生成）に成功したら、私も浮名を流してやろうという希望の光とともにｗ。(。_・☆＼ ベキバキ
元大統領のトルーマン氏が「あなたはまだ若い。もう少し辛抱して成熟するまで出馬を思い留まることを勧告する。」と大統領選への出馬を反対したとき、ケネディは、即座にニューヨークで記者会見を開き「４４歳以下の人間に信頼と指導力がないと除外するなら、ジェファーソンは独立宣言を書けなかったし、ワシントンは大陸軍を指揮して独立戦争を闘えなかった。マディスンは合衆国憲法を起草できなかった。そして、そもそもコロンブスはアメリカ大陸を発見できなかったのである。（中略）合衆国は、その若いパワフルさを象徴するように、４４歳以下の人々で作り上げられたと言っても過言ではない。（中略）今こそ、新しい機会と問題に取り組むため、ニューゼネレーションのリーダーシップが必要なときなのだ。」と反論しています（ワシントンポスト；ニューヨークタイムズ；ＡＢＣアーカイブス）。
この歴史的事実による説得は、大学時代に英語の授業のテキストで読んで感動を覚えました。しっかり赤点とって単位は落としましたが（汗。「具体例を出せゴラァ」と言われる前に反論できない確たる歴史的事実を突き付ける説得力は、ぜひどっかの誰かさんに読んでもらいたいです。m(_ _)m
なお、ケネディのディベート技術は、有名な「ヒット・ゼム・オフン＆ヒット・ゼム・ハード」だけではなく、「主要点に番号をふる箇条書き形式を用い、短文を尊重し、ときに頭韻をつける趣味があった。……ユーモアと単刀直入な言い回しは、彼の強い自信の反映であった。」（セオドア・ソレンセン著，山岡清二訳「ケネディの遺産」（ケネディ・レガシー）１４２頁）というものが根幹でした。
これも、私がなるべく真似をしたいと思うところで、長文を弄び意味不明・論旨不明確なのにトリッキーな引用や嫌味や当て擦りを多様するどっかの誰かさんに忠告したい論旨です。m(_ _)m
