最近、死刑になってもかまわない、とかもっとあからさまに死刑願望を口にする人間が目につくのですが、こういう人たちは自分が死んだらどうなると思っているのでしょうか？
誰にも分からないことですが、多くの宗教は悪行を行った者が死ぬと地獄に堕ちると説いています。
もしそれが事実なら、このような人間は死んでから本当の後悔をするのでしょう。

最近、死刑志願の確信犯的通り魔瞬間連続殺人（同時多発瞬殺を含む）が増えたような……。対策は教育しかないのだろうか＿|￣|〇
この手の、いわゆる「拡大自殺」的な事をする人間と言うのは、時代・地域を問わず、(数の多い/少ないは有るかもしれないにせよ)出るものじゃ無いですかね？
この手の連中への対策が有るとすれば、出るのを完全に防ぐのは無理(元から数こそ少ないかも知れないけど)、ってのが、その「対策」の出発点のような気もします。
「死刑になっても良い」と言うのは、一種のハタ迷惑極まりない「自殺」であって、「自殺」を考える所まで追い込まれた事の無い人間が、(非難するにせよ、その逆にせよ)その内面を、兎や角言ってもなぁ、と言う気も……。
私は死刑については反対なんです。
死刑が凶悪犯罪を抑制するという考えも有るでしょうが、最近の傾向は人生に絶望した人が無理心中みたいに他人を殺して自分は死刑にしてもらうのを望むというのが流行のような。
死刑は有りだけど死ぬより酷い目にあわせるのは人道的じゃないというのもよく判りません。
生かしといてがっつり後悔させたいと思っちゃいます。
自殺願望の人は「死ぬより酷い目に遭っている」と思っていそうですよ。
刑事としては、事件被害者の慰撫にも復讐を容認は具合悪いし「犯人の後悔」はウエイト大きいでしょう。
で、裁判で与える刑罰には、自殺願望者や道連れ殺人者に「後悔してもらわなくちゃあ成らない」との考えも含まれているはず。
それには「考えを改める」がポイントですが。
さんざん間違いを指摘されても考えを改められない人を結構見かけるので、刑罰が等価に後悔に繋がっているとは言えないのが悩ましいです。

今回の「死刑になっても構わない」や「誰でもよかった」とか、以前の「自殺は痛いから嫌だ」や「早く死刑にしろ」等、自己中心の極みに聞こえます。
真実を追究して再発防止を図ることはやるとして、それとは別に（書くのもおぞましいことですが）、自殺する方がましだと思えるような罰を科すことで、社会としてけじめをつける必要が有るように思います。
死刑が凶悪犯罪の抑止にならないのは既に知られていますが、被害者遺族にとっては死刑を望む犯罪者に対しても死刑と言う罰を与えるのがいいのでしょうか。
個人的には冤罪対策(死刑は不可逆)と社会の安全の保持の点で死刑にかえて終身刑を作ればよいと思っています。日本では死刑廃止はまだしばらくかかるでしょうが裁判員制度がそのきっかけになる可能性もありますね。
うーん。本人の望みどおり、速やかに死刑にしてほしいですね。
それが本人に対する罰になるかどうかはともかく、量刑としては死刑で当然だし、せめて死刑でないと遺族もやりきれないでしょう。

現在の報道にあるような供述を維持すると、「通り魔みたいに人を殺したかった」「誰でもいいと思ってやった」「ガソリンはたくさん殺せるから」というような証言からは無差別の殺意が認められますし、防犯ビデオ映像の、ガソリンをバケツで客に向かって撒いたのも殺意がある証拠になり得るかと思います。要は「放火したら人が死んでしまった」のではなくて、通り魔の手段として、ナイフの代わりに火を使ったというだけかと。
もちろん捜査段階の供述ですので、裁判で引っ繰り返すかもしれませんが。
思うに、「死刑になっても構わないから、凶悪犯罪がやりたかった」人（犯罪そのものが目的で死刑が犯罪への抑止力にならなかった人）と、「死刑になりたくて凶悪犯罪をした」人（死刑そのものが目的で犯罪はその手段に過ぎない人）とは、自暴自棄など似ている面もありますが、本質的には違うようにも思います。前者は死刑になってもならなくてもいいのでしょうし、後者は死刑にならないと目的が果たせないので困るでしょう。
麻雀のアトヅケ理由かも知れないですけど（犯人の事後の正当化）、

と思うことが多くなりました。
被害者には「落ち度」が無いのに、手前勝手な犯人のせいで殺された。きっとこんなことで死にたくないと思い、当然恐怖を感じつつ亡くなったのではないか、と想像します。
多くの「罪もない」人にそのような思いをさせた犯人が、自分は「望み通り」死刑になる。「懲罰」という点から見たとき、納得できないものを感じます。せめて、自分の行った行為の非道さに気付かせ、反省させてから執行する、ということはできないのかな？、と素人としては考えてしまいます。
もっとも、ハムレットのように、ざんげする暇も無く殺されて亡霊となった父の仇を討つのに、叔父が祈っているときには殺害を思いとどまる、という考え方もありますが。（つまり人間は祈っている時に死んだら天国に行き、ざんげも臨終の儀式もなく死んだら地獄へ行くよ、という考え方です）
自分から死刑を望んでも、すぐには執行されず反省と悔恨の日々を送らなければならない、ということになれば「死刑希望｣殺人「腹いせ無差別」殺人の抑止力になるかもしれない、と淡い期待を持っています。

全く同条件で「再現・比較」実験ができない以上、推論の域を出ないようにも思います。

正しいかどうかはともかく、「死刑にすればいいんじゃないか」とは思います。
命の重み、他人の死、というものを理解できていないにもかかわらず「死刑を望んでいる」者が、「死刑」執行前に実感もなかった死というものの重みに気づくかもしれません。（逆に言えば、己の死をつきつけられてすら気づかない者に気づかせる手段は私には浮かばない）
現時点で、「死刑を望んでいる」という者が死刑執行される時点でも「望み通り」として死んでいけるものなのか、単に「命」・「死」への認識甘さを表明しているだけなのか、はっきりさせてもいいんでは？

しかし、一方で、それ故に死刑と単純な結び付けをして、よいのだろうかと思います。他人を究極まで憎み続けて天国に行けるのだろうか？あるいは、そんな憎しみを持ち続けて幸せだろうか？許すことができずとも、他人を殺すことを、遺族が望み、社会が遺族に代わって殺すことが正義なのだろうかと。

死刑に関する事実と数字 より法理論上は、生命刑たる死刑の方が拘禁刑たる終身刑（仮釈放なき無期懲役）より重くなります。
しかし、行刑面では、死刑執行待機拘禁では人格崩壊まで精神が荒廃するのは極めてマレなのに、終身刑だと「社会復帰の望みもない生涯塀の中の生活が延々と死ぬまで続くという絶望感」からか１０年過ぎあたりで人格変容ないし人格崩壊が進むという研究結果が出ています。そのため、フランスでは終身刑こそ残虐な刑罰だと廃止して仮釈放の恩典機会を必ず与える（社会復帰という生への希望）という動きが出てきました。
これからすると、死刑より終身刑の方が精神破壊刑として残酷なので、「いっそのこと殺してくれ」と暴動が起きたり（実際に米国では発生しています）するので、死刑を廃止しても終身刑がある限り、犯罪抑止効果はさほど変わりがないという研究結果も出そうです（実際、記憶ではイェール大学発信のレポートが出ていた）。
年間の自殺者数は３万人を超えてますね。
このエントリの趣旨は死刑の犯罪抑止力ではありません。

被害者の遺族の心情、ということが必ず言われるのですが、死刑廃止国では、被害者の遺族はどう心の整理をつけているのでしょう。データを知らないのですが、死刑廃止にしてからリンチが増えた、ということがあるのでしょうか。死刑廃止にしても、恨みから犯罪に走る遺族が生じないのであれば、死刑はないほうがいいに決まっています。死刑廃止を後悔して死刑を復活させた国というのはあるのでしょうか。死刑を廃止してよかった、という国が圧倒的に多いのではないのでしょうか。
そもそも犯罪を抑止することは極めて困難であり（犯罪動機の上位を占める「金」と「女（犯罪者が女の場合は男、同性愛者の場合は同性のパートナー・・・うむ、ややこしい）」と「怨恨」はなくなりそうもないので）、どんな極刑も抑止力にならないことは歴史が証明しています。
対して、冤罪で誤って処刑してしまった場合は、取り返しがつきません。
政治犯や精神病者（政治犯を精神病者扱いする独裁国家も後を絶ちませんが）を除き、死刑になるような犯罪を犯す人は、人格（人格異常と精神異常に明確な境界線を引くのは困難です・・・）の問題や、生育歴の問題があることがほとんどでしょう。本人だけの責任問題ではなく犯罪に至るのだと考えます。
抑止力というなら、強いていえば、教育ではなく（教育という名のもとの強制や独善はあとを絶ちません）、包容力なのでは。家庭でも社会でも、です。
元外科医先生、お示しの文書をよく読んでいただけると分かると思うのですが、
「死刑が他の刑罰よりも有効に犯罪を抑止するという説得力ある証拠は、科学的研究によっては一貫して得られていない。」という当該文書の見解と「死刑が凶悪犯罪の抑止にならない」というのは、全く違う意味を指すと思うのですが。
前者（つまりご提示の資料）は、あくまで「死刑が終身刑より抑止力を持つことは、これまで科学的に立証されていない」というだけのことでは。

米国でも１９６０年代までは、「草原の小さな家」や「奥様は魔女」の世界が当たり前で、地域社会・職場社会のコミュニティ（ボランティア慈善事業参加）や教会活動などで、何かあったら困り事や悩み事を目のうちに問題を発見して、おせっかいなほど相互協力扶助して解決できたようです。しかし、ベトナム戦争やマフィアの浸透や核家族と都市化？等で、「孤独な群衆」の素地にミーイズム社会が加速度的に波及し、何でも訴訟というギスギスした社会に変貌を遂げ、ご存じのとおり、凶悪犯が跋扈する世界に変わりました。
日本も似たところがあるという研究結果も頻発しています（特に社会学）。
その対策の一つは、地方公務員が長期的視点で取り組んでいるものとして、地域社会のコミュニティの復活と公徳心教育ですが、ＮＨＫの「ご近所の底力」のようには、なかなかうまくいかないところが悩みの種です。戦前の隣組と修身（軍国道徳教育）という負の遺産に対する警戒心があるからです。

秋葉原事件で犯人に対する「賞賛」の声がネット上に流れた、という報道には寒気がしました。いまや家族などに対するあてつけだけでなく、単に自分より「幸せそうな」人間を一瞬にして不幸な目にあわせることが目的になっている、ということにどうしようもない無力感をおぼえます。

仮名で顔写真も出ない少年事件で、「自分が起こした事件がどれだけマスコミに大きく取り上げられたか、友人の反応はよかったか。」を気にしていた少年のレポートを読んだことがあります。
マスコミは一部助長していることは間違いないと思いますが、実名報道主義云々ではないかもしれません。強いて言えば犯罪報道自体に犯罪を助長する｢側面」（模倣犯の全国的拡散）は否定できないかと思います。
確かに、”報道行為全般（特にストレートニュースでないもの）そのもの”が、広い意味で個々の犯罪行為の社会への波及範囲を増幅する、一定程度の強さをもった増幅装置になってる気はします。
私も、教育等の問題点を見直して精神文化を再構築するのが、かかる自爆的凶悪犯罪抑止への正道だと思います。しかし、問題事項は一部既出分を含めて、教育、核家族化、雇用形態、経済格差、急激なＩＴ化、報道のあり方、等々多岐にわたりそうなので、一朝一夕に成果が出るとは到底思えません。
それまでの間、類似犯行を決意する犯人の気持ちを挫く名案は無いものでしょうか。
今の懲役刑を延長するだけで、かなりの効果があると思いますよ。
常習犯（常習累犯窃盗など）のほとんどが、お金を隠してますから。
憲法違反だとは思いますが、敢えて肉刑復活を提案してみます。
身体障害を負わせるけど、死刑にしない。

これの次のエントリー「再犯防止を…」にあった「教育刑的効果」という言葉を見てビビッときたのですが、「死刑になっても構わない」的発想の犯罪に対しては、刑期中（死刑の場合は執行までの間）厳しい教育刑（修身刑？とか）を科すのが良いのではないかと思いました。
その教育刑や死刑そのものの厳しさを様々な角度から広く報道すれば、中には犯意が萎えて思いとどまる場合もありそうに思いました。対症療法的な対策でしかありませんが。
稀にしか起こらないことについては、その背景や対策を論じても的外れに終わってしまうものかも知れませが…。
現状では、何もかも失って自暴自棄になった者であれ、何かかけがいのない大切なものを守ろうとする者であれ、事前に犯罪を抑止することは難しいように思います。
…事後に逃げ回る輩ならまだしも、死ねば良かろ？と開き直る奴につけるクスリはありません。自爆テロにしろ、無差別殺傷にしろ、同じ事であろうと思います。刑罰が死刑であっても無期懲役であっても、穴吊りや鋸引きであっても、やはり同じ事です。
逃げようとする意志のある者であっても、昔、王や皇帝を殺そうとして逃げ切れなければ残酷な刑罰が待っていることは周知のことでした。しかし、荊軻や善住坊など、歴史に繰り返して刺客という存在が現れては消えて行きます。
こういう稀な人々に対しては、抑止力はあってもわずかということなのでしょう。
稀ではない普通の人について考えてみるなら、かつて、自棄に陥ろうとした人々に対して、多くの場合に救済手段が用意されて来たわけです。確かにこの数年間、財政逼迫と予算不足から、その部分が急速且つ大きく弱体化したことは間違いありません。また、新たに生じた問題については、まだ何の手も打たれていないに等しい状況です。
何かを守ろうとしている人については、それを得ようとする人が対極にいる以上、対策や救済は容易ではありませんが、まだしも交渉の余地はあるように思います。
単純化するなら、その社会的コストを負担することを考えた方が、より効果的な犯罪抑止力が発揮されるのではないかと思います。
