人質司法という言葉の意味についてウィキペディアでは以下のように記述されています。
人質司法(ひとじちしほう)とは、日本国において、被疑者又は被告人が被疑事実又は公訴事実を自白する場合に比べ、これを否認する場合には勾留による身柄拘束が長期化し、釈放がされにくくなる傾向にあるという社会的事実に対し、身柄を人質にとって自白や警察や検察の意に沿った供述を得ようとしているものとして、検察庁や裁判所、あるいは現行法制を批判する際に用いられる語。
しかし、この説明には若干正確さを欠くところがあると思われます。
まず、「現行法制」つまり制度の問題というよりは、制度運営の問題だという点です。
現行法制つまり現在の刑事訴訟法における勾留の要件は以下のとおりです。
第六十条 裁判所は、被告人が罪を犯したことを疑うに足りる相当な理由がある場合で、左の各号の一にあたるときは、これを勾留することができる。
一 被告人が定まつた住居を有しないとき。
二 被告人が罪証を隠滅すると疑うに足りる相当な理由があるとき。
三 被告人が逃亡し又は逃亡すると疑うに足りる相当な理由があるとき。
上記は被告人つまり起訴後の勾留に関する規定ですが、起訴前についても同様の要件で勾留されます。
次に人質司法で問題になるのは保釈ですが、保釈の要件は
第八十九条 保釈の請求があつたときは、次の場合を除いては、これを許さなければならない。
一 被告人が死刑又は無期若しくは短期一年以上の懲役若しくは禁錮に当たる罪を犯したものであるとき。
二 被告人が前に死刑又は無期若しくは長期十年を超える懲役若しくは禁錮に当たる罪につき有罪の宣告を受けたことがあるとき。
三 被告人が常習として長期三年以上の懲役又は禁錮に当たる罪を犯したものであるとき。
四 被告人が罪証を隠滅すると疑うに足りる相当な理由があるとき。
五 被告人が、被害者その他事件の審判に必要な知識を有すると認められる者若しくはその親族の身体若しくは財産に害を加え又はこれらの者を畏怖させる行為をすると疑うに足りる相当な理由があるとき。
六 被告人の氏名又は住居が分からないとき。
これらの要件の個々の当否については議論があると思いますが、勾留にしろ保釈にしろ、人質司法との関係で最も問題になるのは、「罪証を隠滅すると疑うに足りる相当な理由」です。
たしかに、「罪証を隠滅すると疑うに足りる相当な理由」があるのであれば保釈を認めるべきではないという考え方自体は制度としてはそれほどおかしいものではないと思います。
しかし、問題はその運用にあります。
多くの事件において、多くの裁判官が、「罪証を隠滅すると疑うに足りる相当な理由」を極めて抽象的なもので足りると考えているところが問題なのです。
言い換えますと、「罪証を隠滅すると疑うに足りる相当な理由」を極めて抽象的なもので足りると考えるということは、「罪証を隠滅すると疑うに足りる相当な理由」を認めようと思えばほとんどどんな事件でも認めることができるということになり、どんな事件でも勾留が認められ、保釈請求や却下される、つまり被疑者、被告人の身柄は拘束されるということになります。
刑事司法には手続段階に応じ、様々な立場の人間が関与します。
取調べにおいては、警察官や検察官がの仕事ぶりが問題になります。
しかし、身柄拘束の問題については、裁判官の仕事ぶりが問題になるのです。
なぜなら、現行犯人逮捕や緊急逮捕などの短時間の例外を除き、被疑者・被告人の身柄を拘束するためにはすべて裁判官の許可が必要だからです。
警察官や検察官の一存で被疑者・被告人を勾留することはできません。
つまり、人質司法といわれるものの問題は、裁判官の問題であるわけです。
検察官や警察官が被疑者を逮捕しようと思えば、普通は、裁判官に逮捕状の発付を請求し、検察官が被疑者を勾留しようと思えば、裁判官に勾留を請求する必要がありますが、裁判官がその請求を認めなければそれまでです。
被疑者を釈放しなければなりません。
つまり、裁判官が身柄拘束を認めなければ、警察官や検察官だけで人質司法などやりようがないのです。
その意味で、ウィキペディアが検察庁を人質司法の主体のように見ているのはやや的外れという感じがします。
脇役の一人ではありますが。
人質司法が裁判官の問題だとしますと、人質司法と取調べ可視化の問題は直接的な関係を持ちません。
取調べの可視化は警察官や検察官による取調べの適正を確保することについては有効ですが、供述の信用性の確保を担保するものではありません。
となると、取調の完全可視化（全面録画）が実施されたとしても、裁判官の意識が変わらない限り、人質司法は依然として残ることになります。
で、裁判官の意識はどうなんだろうということが問題になるのですが、最近、すこしずつまともな方向に変わりつつある気配のようなものを感じるときがあります。

学説の通説的見解によれば、勾留を判断する上では、根拠となる具体的事実が必要と解されています。
下級審裁判例に「罪証隠滅は抽象的な可能性では足りず、罪証を隠滅することが何らかの具体的な事実によって蓋然的推測されうる場合でなければならない」というのがあります。
（大阪地決S38.4.27下刑集5-3・4-444）
しかし、勾留状には当該事件において勾留を必要とする具体的な事情は記載されませんし、
勾留理由開示の手続きによっても、裁判所は刑訴法60条１項の各号のどれによって勾留したかのみを明らかにすれば足り、
具体的にこれこれの事実があるからとまで、説明する義務はないとされています。
よく行政処分などで、行為の正当性を担保するために「理由付記」を要求することがありますが、
勾留に関しては、決定者たる裁判所が対外的に理由を説明しなくてよいとされていることが、判断が甘くなる要因の一つではないかと思います。
検察庁が請求して、裁判官が認めるという構図なのであれば、検察庁も主体の一つであり、少なくとも裁判官と同程度か、それ以上の責任があると思うのですが。脇役にすぎないとお考えになるのはなぜですか。
それとも、検察庁が拘束請求をしなくとも、裁判官の独断で身柄拘束をすることがあるのでしょうか。
身柄拘束の決定権は誰にあるのかという問題です。

逃走・罪証隠滅の可能性を示す具体的根拠の提示が必要であるといっても、逮捕直後の段階では実際に、長期間逃走していたり、逮捕時に激しく抵抗したり証拠の隠滅を企図したとかいう事実がなければ、「被疑事実を否認している」か「具体的捜査が未了」以外に勾留の根拠を示すことは難しいのが現実でしょう。
しかしその程度の根拠であっても、「逃走・罪証隠滅の虞が皆無であるとは断言できず、実際に逃走・罪証隠滅が図られれば、犯罪立証に極めて深刻な影響を与えてしまう」と強弁されれば、裁判官としても、それを否定することは困難となってしまうのでしょう。
そして、実際に逃走・罪証隠滅が発生してしまった場合に、その責任を負う者が存在しないのも、裁判官が勾留請求の却下に躊躇する一因ではないかと考えます。
その点を踏まえた一つの考え方として、逮捕直後からの積極的な被疑者弁護の実施により、弁護人の監護の下、被疑者が逃走・罪証隠滅を行わない可能性が担保されるのであれば、裁判官としても、検察官の逃走・罪証隠滅の可能性の主張について、より厳格な審査を行うことができるのではないかと考えてみました。
検察の言うことは正しくて、自分らはそれを追認すれば良いとでも思ってるんでしょうね裁判所は。
で、間違ってたら検察が悪い。
「検察が間違うとは思ってなかったので自分たち（裁判所）に責任はない」とでも考えているのでしょう。
足利事件で謝ったのは結局警察と検察だけなんですよね。
冤罪の主役は裁判所だと思うんですけどいつもだんまりを決め込んでるんですよね。
弁護士会も１審での弁護士の方針が間違ってたことは無視して検察批判しかしないし。

素人ながら、意識の問題なんでしょうか？と疑問を持ちました。
判断に際して、どういう説明を受けて、どういう調査をしているのか私は分かりませんが、会社の業務上の判断でも、細部までの把握や個々のケースにおける対応策がない限り、慎重策というか抽象的ないし一般的な見解を出すしかないです。
細部までの把握が十分でないなら、検察とのやりとりがいるのでしょうし、逃走・証拠隠滅への対策として、No.4 感熱紙（刑） さんがお書きになっているような案も有効でしょう。
「意識の問題」に帰着するのかもしれませんが、一般の会社の「安全確保」なんかも「意識をそうさせている障害」があれば制度などでそれに対策するものなので。

検察官側に最終的な決定権はないにしても、法律の専門家として拘束決定を求めている以上、「脇役」というのは違和感があるように感じたのです。私の中のイメージでは、検察庁と裁判所との共犯関係によって、強固な人質司法体制が確立しているものと考えておりました。
ところで、弁護人が、被告人の権益を守るという立場から、「内心では身柄拘束が仕方ない事案とは思いつつも、身柄の解放を求める」という場合がありうることは理解しているつもりです（有罪が確実視される事案での無罪主張とパラレルに）。

コレは少々決め付け過ぎかと思いますが･･･。裁判官が、検察官と以心伝心の共犯関係と言われたら、裁判官は皆こぞって憤慨することでしょう。
裁判官は推定無罪の原則で、虚心坦懐に検察側と弁護側の主張を聞き比べなければならない立場です。裁判官の判断が、被告人に有利なものか、それとも不利なものになるのか、裁判官が何の気兼ねもなく無私無心の立場で判断する。それでなくては裁判の公平性なんて誰も信じなくなります。
検察からの拘留請求においての裁判官の判断が、人質司法となるか否かの分かれ目であって、裁判官が自信を持って請求を斥ければ被疑者は釈放されます。検察がどういう思いで請求してこようが、認めるかどうかは裁判官次第の筈です。だからこそモトケンさんは「主犯格は裁判所」であって、検察は「脇役」だと言われるのでしょう。

どちらがより、ちゃんとした判断をすることが求められているか、という問題です。
で、令状主義の趣旨からすれば、裁判官の方によりちゃんとした判断が求められていると言えるでしょう。

検察は検察のモノサシで勾留請求するかどうかの判断をするので、裁判所には「こりゃ確かに罪障隠滅の可能性が高そうだわ」ってやつから「罪障隠滅の可能性は低そうだし、勾留はいらんのじゃね」ってやつまでいろいろ上がってくる。検察の価値基準の中では、本来の職責である国民の安全、事件の解決の方が優先順位が高いでしょうから。
で、裁判所は、裁判所のモノサシで、検察の請求をチェックし、可否の最終決定を行うのですが、その裁判所のモノサシが検察のモノサシに近くなり、判断が甘くなっているというのが人質司法の問題じゃないですか。
裁判所の判断のモノサシの話ですので、もちろん主役は裁判所、ちゅうことでしょう。
確かに、起案者である検察に「勾留請求はもっと抑制的にしろ」とモノサシを変えるよう求めることもできる訳ですが、決定権者である裁判所のモノサシがそもそも狂ってるのなら、「そっちを直せ」というのがシステム全体から見れば常道なのではないかと思います。決定権者のモノサシをきちんとすれば、必然的に検察の請求も抑制される（忙しい中、却下されるのが分かってる無駄な作業をしたい奴はいない）でしょうし。
そうした話の中に、その手続きに着手するかどうかの判断段階における検察官個人の内心の問題を持ち出しても、議論が錯綜するだけで意味がないのではないでしょうか。

で、例えば「不良がでる原因は誰の問題か？」で、「この工程の作業者」となって、作業に何らかの障害（マニュアルが曖昧など）があることもほぼ明確になったら、作業者の意識の問題、じゃなくて、「その要因を直せ」というのがシステム全体から見れば常道なのではないかと思います。

白片吟K氏さんのこの文章でしっくりきました。（そこをきちんと分けて考えておらずひっかかっていたので）
「人質司法」という専門用語の狭義の意味と広義の意味などが私など素人には分かっていないです。
お役に立てたようで嬉しいです。
「人質司法」は法律に載っている言葉ではないし、比較的新しい言葉なので、まだよく知られていませんよね。
あらためて見ると、Wikiの定義も専門用語が多くて、一般の方が一読してわかる、というものでもないかもしれません。
一般の方にもわかりやすい「人質司法」の定義って考えてみたのですが、良いものは浮かびませんでした。
ワタシ個人としては、
捜査側がもう十分証拠握っているのに、否認している人は自白している人よりも長く拘束されちゃうのはずるいぞの論
って感じにとらえています・・・。
誰の問題かと云われれば、防御側にとって問題だと私は思います。
否認してる事件なのに弁護人と十分に打合せする時間もなくなっちゃうんじゃないのかと心配です。
原因の所在が誰にあるかと云われれば、裁判所が法務省の下部組織にしか見えないような現状を徒に眺めているだけの「我々」にあるように感じます。
そう思ったところで、次のエントリ記事を拝見しにゆきます。
勾留と権利保釈，裁量保釈はそれぞれ異なるものなのできちんと分けて議論した方が良いのではないでしょうか？
検察官は余罪（別罪）の取り調べを除けば，原則として起訴後に被告人の取り調べをすることはないのであって，起訴した公訴事実について自白を求めるために身柄拘束を利用することを目的として保釈意見を出すことはほとんどないと思われます。
自白との関係では保釈の段階の問題ではなく，勾留の際の問題なのではないかと思われるのです。
実際，起訴後に自白したとしても証拠調べが終わる前に保釈が認められることは実務上少ないのではないでしょうか？
実務の運用はこのような感じではないでしょうか？
1. 検察官が勾留請求をする。
2. 裁判官が「罪障隠滅のおそれ」と「逃亡のおそれ」を比較的に抽象的に判断するため，勾留請求が認められる。
3. 検察官が公訴提起する。
4. 被告人，弁護人から保釈請求がなされる。
5. 裁判官は2と同じように「罪障隠滅のおそれ」を認めるため権利保釈は認められない。
6. 裁判官は裁量保釈の検討をする。→認められれば裁量保釈
7. 証拠調べが終わる。→「罪障隠滅のおそれ」が消滅するので権利保釈が認められる。
前記の通り自白が問題となるのは主に1から3までです。
2は確かに裁判官の問題ですが，そもそもは検察官の勾留請求がなければ裁判官が判断することはないのであって，実際問題，「罪障隠滅のおそれ」について今以上に相当具体的な疎明が求められれば困るのは検察官ではないでしょうか？
裁判官が抽象的に「罪障隠滅のおそれ」を判断することは問題の一端ですが，これを厳しくしたときに検察官の職務が遂行できるか？ということを考えると検察官は本当に脇役に過ぎないのかということには大きな疑問を感じます。
２と５の場合は、前提状況が相当異なります。
２の段階では、捜査の初期または途中ですから、一般的には捜査側の証拠固めが十分でなく、その意味で証拠隠滅の余地（客観的可能性）は大きいです。
しかし、５の段階では検察官は公訴を維持にするに足る十分な証拠が収集されたとして起訴しているわけですから、証拠隠滅の客観的可能性が２の時点と比較にならないほど減少しています。
私は、捜査段階においては、人質司法というよりは取り調べのあり方の問題だと思っています。
取調べのあり方の問題としても見れば、その主役は言うまでもなく警察官と検察官です。
２の場合においては、前提条件として「警察、検察その他の機関の逮捕により身柄が拘束されている状態」であることに留意するべきでしょう。
逮捕されているということは、その時点で既に被疑者に「逮捕罪名にある犯罪を犯したと疑うに足る理由」が存在し、裁判官によりそれが認められている状況（現行犯逮捕の場合は追認ですが）にあるということです。
「罪を犯したと疑うに足る理由」（真犯人である理由ではない）が存在する以上、逮捕時点において否認しているあるいは捜査未了の状態にある被疑者を勾留しなかった場合の逃走・罪証隠滅の可能性の理由には相応の具体性があるとも言えます。
４～７の部分に関しては、既に身柄が警察の手を離れていますから、外野からの意見になりますが、正直否認していても起訴している以上保釈は仕方ないんじゃないかと思うことはあります。
たまに検事から、取調官として被告人の保釈に関する意見を求められることがありますが、私個人としては、余罪捜査中であったり、暴力団組員等の（自認していても）ほぼ間違いなく逃走することが確実である身柄の場合を除き、否認していても保釈には反対しない場合が多いです。
ただ、現状否認している被告人が保釈後に逃走しないための担保が保釈金のみ（ですよね？）なので、裁判官としては判断に困るという部分は少なからずあるのではないでしょうか？
ちなみに、身柄拘束からの早期解放を引き替えにした自白の強要については、警察内部においても以前から不適正な取調べであるとされてきましたが（理由はモトケン先生の別エントリでの解説のとおり）、本年４月より施行された被疑者取調べ適正化のための監督に関する規則の第３条２項ハ及びホに該当する監督対象行為として、既に禁止されている状態です。
そして、将来的に全面可視化が導入されることになれば、結果的には不正な取調べが根絶されるとともに、自白撤回を正当化するための常套句であった「身柄解放を引き替えに自白を迫られた」という抗弁が失効することになるでしょう。
モトケンさんレスありがとうございます。
捜査段階において、取り調べのあり方が問題となるという点については異論はありません。
ただ，人質司法という批判が，捜査機関による身柄を利用しての自白の獲得に向けられたものだとすれば，捜査機関が被疑者を取り調べるのは起訴前であるのが原則であることを考えると，起訴後の問題である保釈を中心に裁判官の責任であるとすることに疑問を感じたということです。
この点は確かにその通りですが，収集した証拠が供述証拠を中心としたものであれば，不同意されれば簡単には証拠能力を獲得できないので，なお原供述者に対する働きかけによる罪証隠滅のおそれは勾留請求の際と大差ないとも考えられます。
だから証拠調べが終了するまでに保釈が認められるのは，ほとんど裁量保釈という運用がなされているのではないでしょうか。
また，自白していれば保釈が認められ易いのかといえばそういうことでもなく，どちらかといえば実刑見込みか，執行猶予，罰金見込みかなど，最終的に体刑に処せられるかということの方が判断の上で重視されているように思われます（裁量保釈の場合です）。

モトケンさんへの返信にも書きましたが，人質司法に対する批判は，主に起訴前勾留に対して向けられたものではないかというのが私の意見です。
仮に裁判官が権利保釈における罪証隠滅のおそれに対する判断基準を変えたとすれば，起訴後に権利保釈がなされる割合は高くなるとは思います。
しかし，起訴後に取り調べが行われるのは例外的なことであって，自白を強要されるということは原則として考えられないので，むしろ最大23日間の起訴前勾留が批判の対象なのではないのかと思うからです。
このこと自体は悪いことだとは思いませんが，本来，利益誘導による自白は任意性に疑いを生じさせるのであって，捜査官は厳に慎むべきであることは当然で，このような規則を必要とすることに問題の根深さを感じます。
