酒井容疑者、自宅に吸引用ストロー４２本「数回吸った」（asahi.com 2009年8月11日4時8分）
東京都港区の酒井容疑者の自宅マンションから押収された吸引用ストローは４２本だったことが、警視庁への取材で分かった。
この「４２本」という数字に、ニュースの見出しにするような意味があるのかな～、と思ったりして。
袋詰めのストローは、１００円前後で４０本から１００本買えてしまうのですから、全然大量とは言えません。
仮に、５０本入りの袋詰めで買ったとすれば、使ったのは８本だけということになりますし、それが全て覚せい剤の吸引に使われたとは限りません（ジュースを飲むのに使ったかも知れません）。
となるとこの記事を書いた記者さん（朝日だけではありません）は、４２本という数字にどのような意味を読み取って記事にしたのだろうか、と思ってしまいます。
単に、警察から情報を得たので記事にした、というだけの記事に見えます。
同様に、「吸引用」という言葉も当てになりません。
覚せい剤を吸引する目的で新たに購入したというのであれば「吸引用」と言っていいかも知れませんが、ジュースを飲むために買っておいたストローを覚せい剤の吸引の際に使ったというのであれば、「吸引用」という言葉はミスリードになる恐れを感じます。
追記
もっとも、「数回吸った」という供述の信用性については別問題ですが、それは押収されたストローの本数で判断すべき問題ではないと思います。
僕は「吸引用ストロー」というのは、覚せい剤の吸引専用ストローだと思ってました。そういう特殊なストローが闇で売られているのかと。
そして、そのストローが数十本もあったということで、「のりぴーはヘビーな常習者だったんだなー」と思っていました。
見事にミスリードに乗せられたのかも。
吸引用というのは、ドラマ等で見られるような、市販のものを短くカットしたものかと思いました。
この事件関連では、「起訴猶予処分になるかもしれない」というほうに不満(?)があります。少なくとも、芸能界は麻薬、覚せい剤等について甘過ぎるような印象を持っています。実際はどうなのでしょうか?
しばらくぶりにコメントします。
これ正しくは「警察が覚せい剤吸引用の疑いがあるとして押収したストローは４２本」なんですよね。本来の用途は、調べが終わってないだろうし、まだ未確定。
おそらく、取材に対する警察の回答もそのようになっていると思われます。
にも関わらず、「吸引用ストロー４２本を押収！！（と警察が発表した）」としてしまうのがマスコミクオリティなんでしょうねぇ。
それにしても本件で興味深いのは、マスコミは日頃は警察から事件情報を提供されても、「ニュースバリューなし」として黙殺するような情報でも、こと著名人が関わるような事件だと、さも「新事実」や「特異な状況」であるかのように報道されてしまいます。
「被疑者が有名人だと警察の報道発表が多くなる」と思っておられる方も多いと思われますが、実際は「マスコミの取材が増えて、入手情報を記事にする閾値が極端に下がるだけ」なんですよね。
このように、日頃私達が目にしている「事件報道」とは警察から得た情報そのままではなく、マスコミによって取捨選択・加工された情報であることを認識しなければならないでしょう。
ちなみに、燻蒸気の吸引に慣れた常習者の場合、熱で変形したり、融けたりし易いポリストローは、あまり好まない傾向があるようで、多くの場合、ガラス管やアルミホイルを管状にしたものを使っていますね。

はっきり言って、0.008グラムは、所持としてはほとんど立件限界と言っていい数値（要するに、使用時に身体に効果が現れるギリギリの量）で、ヤクザ相手でも起訴の判断に至らない可能性があると思われます。
おそらくはシャブ抜き目的の逃走のおかげで、使用罪の立件も難しそうです。
それでも勾留を取ったということは、本命は別のところにある、なんて言ってみたり。

草彅君の場合は、厳重な捜査でも犯罪性が出無かったので、復帰に障害の無いことがはっきりした。
芸能界と薬の関係や報道のハシャギ具合、誤導や捏造報道を覚えているので、もし自分が警察の立場なら｢捜査の手抜き、隠蔽だ｣等と騒がれるリスクを考慮して対処すると思います。
有名人、特に芸能人対象の捜査が厳重になることは、事件後処理の観点からは妥当だろうと。
ひねくれた見方をすれば，コンビニでまとめ買いをしたけど，４２本は手つかずに残った。ゆえに，規範的障害に直面して躊躇した，という有利な情状証拠？

素人考えで恐縮ですが、警察・検察とすれば、世論を背景にして、立件の基準を低くするチャンスを探っているんだろうな、と思っています。
１．報道態勢（「逃げ得は許さない」という処罰感情を形成している）
２．有名人の起訴・有罪による薬物乱用防止効果（大義名分が立つ）
３．裁判員制度の開始（市民感覚を反映させないといけない）
すべてにおいて、起訴、有罪への強い追い風（のりPにとっては逆風）が吹いているように思いますし。
３．のタイミングもかなり大きいなと感じています。
（自身が、その啓蒙に関わっていたのは皮肉ですね。）
ヤクザなら起訴でなくて、のりPなら起訴というのは、私個人としては割り切れないところではありますし、現状での起訴は「疑わしきは罰せず」にも反するように思っていますけど・・・。

FRさんのご意見は十分理解できますが、現場を知る身として失礼を承知で言わせていただくならば、そのお考えは些か穿ち過ぎかと思います。
警察が薬物の末端乱用者を検挙するのは「薬物からの離脱」と「入手経路の解明」が目的であって、その人物を刑務所に送り込むためではありません。
あえて言えば、被疑者の薬物使用を絶ち、密売人の情報を入手できるなら、執行猶予が付こうが不起訴になろうが、警察的には重要なことではありません。
また、上記の目的のために必要があれば0.001 グラムでも逮捕状を請求しますし、反対に身柄拘束せずとも上記の目的が達成でき、逃走罪証隠滅の可能性が皆無であるならば、1グラムの所持でも任意事件として処理することも不可能ではありません。
これは検察も同じだと思います。
もっとウルトラＣな弁解は，子供のジュース飲用に買っておいたストローをたまたまた使ってしまったとか……。

ともあり、少なくとも使用した物も含まれているようなので、使用済みも未使用も含めて42本ということなのでしょう。
もっとも、重要なのは「覚せい剤をあぶって口で吸った形跡」があるストローの有無とその本数であり、総数には何の意味もないと思います。42本中の過半数に覚せい剤を使用した形跡があるというのなら別ですが。
覚せい剤に使用した物も残っていたということなので、覚せい剤吸引セットみたいな感じで、薬と一緒に保管してあったのを見つけたのだと私は思いましたが、実際の所どうなんでしょうかね。

私のように薬物その物さえ現物を見たことも無いものにとりまして、薬物販売・使用等に対する刑罰の加減ということがよく分からないので、差し出がましい疑問なんですが。
日本は薬物に対する刑罰が軽すぎるように感じるのです。
だからといって、感熱紙様はじめ、警察に難癖をつけるつもりではありません。
常用者については、中毒からの救済は人道上としてももっともなことではあるのでしょうけど・・・。
厳罰の法制度にしたところで、現状より使用者が減らないものなんでしょうか？
まあ、飲酒の交通違反等につきましても、酒気帯び～酩酊状態まで加減はあるようには思いますが、そのことを含めても軽いなと思えるのです。
今回の酒井さんの所持量についても発表されている量がピンときません。
もし、薬物使用事犯の裁判員裁判があったら、私には皆目見当が付かず、法廷の雰囲気に流されてしまうだけになってしまいます。余計な話でした。

起訴されるにせよ、されないにせよ、普通の会社員だと、逮捕された時点で解雇とか辞職を勧められるとかが一般的だと思います。そして、同じ業界他社への転社も困難でしょう。それに比べて、芸能界はほとんどが復帰している印象があります。

薬物事犯に関しては、使用罪は確かに緩刑と言えなくもありませんが、密輸入や密売目的所持、特に麻薬特例法（国際的な協力の下に規制薬物に係る不正行為を助長する行為等の防止を図るための麻薬及び向精神薬取締法等の特例等に関する法律）が適用された場合の刑罰は相当に苛烈です。
私の経験になりますが、検挙した密売の元締め（女性）、といっても一部地区で長期間小口相手に商売をしていた程度で、逮捕時の所持量も数グラムといったものでしたが、密売事実を積み上げた結果特例法が適用され、判決は懲役１３年、１０００万円近い追徴金が課せられました。
また密輸入の片棒（運び屋）でも、７、８年の懲役はザラにあります。（まあ中国なら死刑ですが）
要は、覚取法も麻向法も、法としての主眼は「持ち込ませない。流通させない。」ことに置かれており、使用に関しては、重罰よりも早期の社会復帰により、薬物からの離脱更生を目指していると言えます。

芸能界はミュージシャンのＭ氏やＮ氏のように、自分の努力で再出発することも容易ですが、その分タレントのＴ神のように再犯率も高くなるのでしょう。
個人的意見になりますが、自分の努力次第で容易に再出発が可能であるという点に関しては、一般社会が芸能界を見習ってもいいと思います。
私は、薬物使用はある意味「自己に対する殺人行為」だと考えています。
一度でも使用してしまえば、もう二度と「使用する前の人生」には、どんなに願っても戻る事は不可能です。
正に「人間やめますか？覚せい剤やめますか？」です。
しかし、薬物と決別し、新たな人生を踏み出すことは可能です。
ただそれには、生まれ変わるくらいの覚悟と努力が必要であることを被疑者本人も周囲の人も肝に銘じなければなりません。

薬物事犯についての刑罰に対して、私は全てを一括りに考えてしまっておりました。
使用しての凶悪犯罪の犯人に対する扱い方には、一抹の不安などが残りますが、良く理解できました。
毛髪は１カ月で１センチ伸びるそうですから、丸坊主にしない限り、２～３カ月前の覚せい剤使用歴は毛髪鑑定でバレバレになるようです。
